Deed
James Langill, Senior and wife, to Joseph Langill
Registered 7th February, 1856, 10 o'clock p.m. on the certificate of William Langill, J.P.
This Indenture made the twenty-sixth day of April in the year of our Lord,
one thousand, eight hundred and fifty-four,
between James Langill, Senior,
of River John, in the County of Pictou, Yeoman,
and Agnes, his wife, of the
one part and
Joseph Langill, James' son, of River John aforesaid, in the
County of Pictou aforesaid, Yeoman, of the other part.
Witnesseth that in consideration of the sum of one hundred pounds of lawful
money of Nova Scotia
to them in hand paid by the said Joseph Langill at or
before the execution of these presents,
the receipt whereof is hereby
acknowledged.
They the said James Langill and Agnes, his wife, have and
each of them hath granted,
bargained, sold, aliened, enfeoffed, released,
conveyed and confirmed and by these presents each of them doth grant,
bargain, sell, alien, enfeoff, release and confirm unto the said
Joseph Langill, his heirs and assigns, all that certain lot of land situate,
lying
and being on the south side of the Mill Brook Road
in the settlement of
River John in the County of Pictou aforesaid, abutted, bounded and described
as follows.
Viz., beginning on the south side of the Mill River Road aforesaid at the
north west angle of a lot of land now belonging to the said Joseph Langill
and running thence south on the said lot twenty-two chains to the north
boundary line of Jacob Langill's farm lot, thence west on said farm lot
twelve chains and sixty links to the north west angle thereof, thence south
on the said farm lot forty-seven chains and fifty links to the north
boundary line of a lot of land granted to Joseph Langill, now deceased,
thence west along said boundary line six chains and forty-five links to a
stake and stones,
thence north forty-seven chains and fifty links to a stake
and stones thence east
six chains and twenty-five links to a stake and
stones,
thence north twenty-one chains and fifty links to a stake and stones
on the south side of the Mill Brook Road aforesaid
and thence east along the
same twelve chains and eighty links to the place of beginning,
containing
forty-nine acres, more or less, with all and singular the privileges and
appurtenances
to the said lot of land belonging or in any ways appertaining
and the reversions and remainders,
rents, issues and profits thereof and
also all the estate, right, title, interest, property, claim and demand
whatsoever both at Law and in Equity
of him the said James Langill and all
the Dower and right or title to Dower
or other interest of her, the said
Agnes, his wife, in, to, out, of or upon the same or any part or parcel
thereof.
To have and to hold the said lot of land and premises with the appurtenances
hereinbefore sold and conveyed or intended so to be and every part and
parcel thereof unto him the said Joseph Langill, his heirs and assigns to
his and their only proper use, benefit and behoof forever.
And the said
James Langill for himself, his heirs, executors and administrators doth
hereby covenant with the said Joseph Langill, his heirs and assigns as
follows.
That is to say that, at the time of the execution of these
presents he,
the said James Langill, is lawfully sized of an indefeasible
Estate in Fee Simple
of and in the said lot of land and premises with the
appurtenances hereinbefore described and hereby sold and conveyed or
intended
so to be and that he the said Joseph Langill, his heirs and assigns
shall and may from time to time
and at all times hereafter peaceably and
justly enter into, have, hold, occupy,
possess and enjoy the same and every
part and parcel thereof without any lawful suit, molestation,
eviction or
disturbance from any person or persons lawfully claiming the same or any
part or parcel thereof and also that he the
said James Langill and his heirs
the said premises hereinbefore sold and conveyed and every part and parcel
thereof
together with the appurtenances unto him the said Joseph Langill,
his heirs and assigns against the lawful claims and demands of all and every
person and persons
whomsoever will warrant, maintain and for ever defend by
these presents.
In witness whereof the parties to these presents herewith set their hands
and seals the day and year hereinbefore first written.

Received on the day of the date of the within Deed of Indenture from the
therein named Joseph Langill, the sum of one hundred pounds of lawful money
of Nova Scotia, being in full the consideration therein mentioned to be paid
by him to me.

I do certify that Mr. John Gould, a subscribing witness to the within Deed
came personally before me and made oath that he was present at and witness
to the executing of the same by the parties whose names and seal are there
set.
