Deed
James Langill, and wife, to Henry Heighton
Registered 12th March, 1856, 7 o'clock p.m. on the certificate of K. McLean, J.P.
This Indenture made at River John this tenth day of January in the year of our Lord,
one thousand, eight hundred and fifty-six,
between James Langill of Cape John, in the County of Pictou,
and in the province of Nova Scotia, of the one part and Henry Heighton of the county aforesaid.
Witnesseth that the said James Langill and his wife,
for and in consideration of the sum of forty pounds
of good and lawful money to them in hand paid at or before the ensealing and delivery of these presents,
the receipt whereof is hereby acknowledged.
Sold, remised, released, enfeoffed and confirmed and by these presents do agree,
sell, remise, release and forever make unto the said Henry Heighton,
his heirs and assigns a certain share of the late Henry Heighton's lot of land
lying and being at Cape John in the County of Pictou aforesaid.
That is to say, about twenty acres, more or less,
being the whole share of James Langill and wife as their share
of the late Henry Heighton's property,
being the whole of their claim on the said property,
be the same more or less with all and singular the houses
and houses, barns, stables, buildings, improvements, ways, water, watercourses, woods,
privileges and appurtenances thereof or thereto in any way belong or in any way
appertaining with the reversion or reversions, remainder and remainders, rents, issues and profits
thereof together with all the estate, right, title, interest, claim, property and demand
of the said James Langill and wife of, and, in, to the same, every part and parcel thereof.
To have and to hold the same share or parcel of land and premises herein
before described and its appurtenances to him the said Henry Heighton,
his heirs and assigns, to his and their only proper use, benefit, interest and
behoof forever, peace of all encumbrance and the said James Langill for
himself, his heirs, executors and administrators doth in an by these
presents covenant, promise and agree to and with the said Henry Heighton,
his heirs and assigns in manner, form and effect following that is to say
that the said James Langill now stands seized of a good and sufficient
estate of and in the premises and every of its appurtenances and good right,
full power and lawful authority to grant, sell and convey the same as herein
and hereby granted, sold and conveyed or intended so to be and further that
the said James Langill, his heirs and assigns and administrators will
warrant and defend the said share of Henry Heighton, deceased, which the
said James Langill and wife claims as their share of the late Henry Heighton
estate against all lawful claim or claims of any person or persons claiming
same or any part thereof.
In witness whereof the said parties hath to these presents their hands and seals subscribed and set the day and year first above written.

Personally appeared before me one of Her Majesty's Justices of the Peace for the County of Pictou,
the wife of the within named James Langill, Catherine,
who being examined separate and apart from her husband acknowledged
that she freely, voluntarily and without compulsion,
relinquished all her right of Dower or any other interest of, in and to the within conveyed lot of land and premises

Personally appeared before me, George S. McLean, one of the subscribing witnesses
to the said Deed who saith upon oath that he was present at the executing of the said Deed.
