Zachariah Burnett (M)

     Zachariah Burnett was the son of Jeremiah Burnett and Judith P. Blackburn. Zachariah Burnett was born circa 1794 at Virginia.1,2,3 He married Unknown ? (1st w-o Zachariah Burnett) before 1819.4 He married second Mary Ford, daughter of Elisha Ford and Elizabeth Duncan, on 23 September 1830 at Knox Co., Tennessee.1,5,2 Zachariah died after 1860 at probably Knox Co., Tennessee.6
     
     Zachariah apparently had a first wife and children. The 1830 Knox County Census shows Zachariah with 1 male and 3 females born between 1815 and 1830. No female old enough to be his wife is shown. He married his second wife, Mary Ford, in September 1830. Zachariah was a Justice of the Peace for Knox Co. and was licensed to perform marriage cermonies at least from 1842 to 1846 and perhaps longer7.

     Zachariah's second wife, Mary Ford, was an older sister of Nancy Ford who married George M. Burnett, Zachariah's son from his first marriage.

     In the Census of 1850, Zachariah was listed as a head of household at Knox Co., Tennessee. He is listed at age 66, occupation as a farmer with no property value given, and as having been born in Virginia.. Also enumerated in the household: Mary Ford, Zachariah H. Burnett, James R. Burnett, Elisha Douglas Gibson Burnett, Martha Jane Burnett, James R. Sherrod, Charlott ? (w-o James R. Sherrod), Mary Angeline Sherrod and Kelistin Sherrod.3

Jeremiah Burnett (M)

     Jeremiah Burnett was the son of Joseph Burnett. Jeremiah Burnett was born in 1768 at Buckingham Co., Virginia.1 He married Judith P. Blackburn, daughter of John Blackburn and Mary Griffin, circa 1792.2 Jeremiah died before July 1821 at Knox Co., Tennessee.3
     
     Jeremiah is first found on the 1789 Tax List of Buckingham County, Virginia, beside his father Joseph. He was 21 years of age at the time. He is listed the following year of 1790 and not shown thereafter. He first appears in Knox County, Tennessee, records about 1789 in John Burdin vs Jeremiah Burnett. In 1806 he is on the tax list with 1 tithe, 50 acres of land. In 1807 he is on three juries. Also in 1807, April 18, Jeremiah and Benjamin Burnett secure a bond of $5,000 for John Amonet, cotton inspector., and on August 4, there is a survey of 106 acres of land in the District of French Broad, So. Holston for Jeremiah by Robt. Armstrong, Deputy Surveyor. In July 1809 he is again a juror and on November 23 is granted 106 acres and one rod of land on Shooks Creek, Knox County. In 1810 there is a court case George Wrinkle, Admr. of George Wrinkle, dec'd ... vs Jeremiah Burnett & Benjamin Burnett ... a cose of debt of $33.37 plus $3.31, the debtors court cost in which 179 acres of land belonging to Benjamin Burnett is attached. On March 4, 1813, Joseph Burnett sold to Jeremiah Burnett, 77 acres and 1 rod for $200 on French Broad River joining George Wrinkle. This was a deed from his father and the last record of Joseph in Knox County. He died sometime after this date.4

     Deed to Jeremiah: 106 acres + 1 rod: beginning at a pine & running with Fosters line S57E, thence with vacant land S3E to a Postoak, S75W to a Hickory, S54W to a Pine, then with Chesley Paine line N47W to a stake, then with the vacant land N45E to the beginning.5

     The last Will and Testament of Jeremiah Burnett Deceased was produced to court for probate where John Hawthorn, and R. R. McBath subscribing witnesses thereto made Oath that they saw the said Jeremiah Burnett sign and seal the said Instrument of writing and heared him pronounce publish and declare the same to be his last Will and testament that he was at the time of publishing of sound mind & perfect Memory to the best of their Knowledge and belief - which Will is ordered to be Recorded and is in the words & figures following to wit: In the name of God, amen, I, Jeremiah Burnett of the County of Knox and State of Tennessee, being Sick And weak of body but of Sound and disposing memory for which I thank God and Calling To mind the Uncertainty of human Life and being desirous to dispose of Such Wordly Substance as it has pleased God to bless me with -- I give and bequeath the same in manner following, that is to say: 1st, I desire that my perishable property be immediately Sold after my decease as much as will pay all my Just debts. 2nd, After my Just debts is paid I give my wife Judith all my real and personal estate during her natural life after her decease my desire is to divide my real and personal property Equally among my children all but my bible which I give to my youngest Son Wm when comes of age and lastly I do hereby constitute and appoint my sons Zachariah Burnett and Benjamin Burnett executors of this my Last will & testament hereby revoking all other wills or testaments by me hereto fore made in witness whereof I have Set my hand and Seal this 26th Day of March 1821 Jeremiah (X) Burnett (Seal), Witnesses to the same John Hawthorne, R. R. McBath.3

     Zachariah and Benjamin were "empowered to take possession all and Singular the goods and chattels right and credits of the Said testator" the first monday of July 1821. An inventory of Jeremiah Burnett deceased indicated eighty four acres of land, one grist mill, two head of horses, twelve head of cattle, seventeen head of hogs, fifteen head of sheep, one pair of cart wheels, three feather beds and furniture, one cupboard and wares, one table, one pair of Stellyards, one chest, two cotton wheels, one check Reele, one pot, one oven, one skillet, six chairs, one loom, one plow and gees, two fallin axes.

     In Jeremiah's estate inventory there is listed a Grist Mill. In 1848, some Jeremiah's heirs, William M. Burnett, Lemuel Burnett, Zachariah Burnett, and Blackburn Burnett, sold their "fee simple interest in the land to take effect and be united with the possessions after the death of Judith Burnett who had a life estate in the same," to their cousin, Joseph Burnett, son of Benjamin. A clear title could not be recorded until after the death of Judith in 1859. After Joseph bought the land in 1848, he sold it to his brother Jesse Burnett on March 27, 1849.6 He purchased land on 20 June 1810 at Knox Co., Tennessee.

Judith P. Blackburn (F)

Pedigree

     Judith P. Blackburn was the daughter of John Blackburn and Mary Griffin. Judith P. Blackburn was born circa 1772 at Virginia.1 She married Jeremiah Burnett, son of Joseph Burnett, circa 1792.2 Judith died before March 1859 at Knox Co., Tennessee.3
     
     Bork indicates that Jeremiah wife, Judith, may have been a Blackburn.

     Will of Juda Burnett, from Bork's The Burnetts and Their Connections: Written 19 February 1859, proved March 1859, Knox Co. Tennessee, Bk. :82: In the name of God, Amen. I, Juda Burnett, of the County of Knox & the State of Tennessee, being of sound mind & memory & considering the uncertainty of this frail & transitory life, do make, ordain, publish & declare this to be my last Will & Testament...that is to say...after my lawful debts are paid & discharged, the residue of my estate real & personal, I give, bequeath & dispose of as follows: #1 - All the property, real & personal, that I have or will remain to me from my son G. W. Burnett, Deceased's Estate, I do will & bequeath to my grandson Jackson T. Burnett...As to what property I before my son G. W. Burnetts decease, I make no disposition. #2 - Likewise, I make & constitue my son in law William [did not give a surname], my special Executor of this my last Will & Testament until my Grandson, Jackson T. Burnett becomes of age, then I make said Jackson T. Burnett, my Executor.      Judith P. Blackburn went by the name of Juda.

     In the Census of 1850, Judith was listed as a head of household at Knox Co., Tennessee. She is listed at age 78 and as having been born in Virginia.. Also enumerated in the household: Griffin W. Burnett and Jackson Tallant.1

Joseph Burnett (M)

     Joseph Burnett was the son of Jeremiah Burnett [I] and Mary McDaniel. Joseph Burnett was born by 1743 at Virginia.1 Joseph died after 4 March 1813 at Knox Co., Tennessee.1
     
     June Baldwin Bork, The Burnetts and Their Connections, indicates that she cannot say for sure that Joseph was the son of Jeremiah Burnett. She believes he was from the records she found and from the names he gave this children.

     Joseph remained in Buckingham Co. Virginia for at least 29 years before moving to Knox Co., Tennessee. He was well established in Buckingham County by the time he appears tax list available in 1764 with 200 acres of land. He appears on all tax lists through 1792. Joseph married about 1765, probably in Buckingham Co., but there is no mention of his wife.

     Knox County was formed in 1792, the last year that Joseph appeared in Buckingham County. Reports of new vacant lands opening for settlers in Knox County had reached Buckingham. It is believed that Jeremiah preceded his father and brother to Knox County. It is likely they traveled the Great Wagon Road, the most important inland road of the pre-Revolutionary period.

     Joseph and his sons, Jeremiah and Benjamin, were the first Burnetts to settle in Knox Co. shortly after is was formed in 1792. They lived along the southern banks of the French Broad River and just across the river from the settlement of Mecklenburg.2

     Joseph bought 77 acres and 1 rod, land on French Broad River located from his father for the use of Academies in Knox Co., District of French Broad and Holston Rivers on waters of Shole Creek.3

Jeremiah Burnett [I] (M)

     Jeremiah Burnett [I] was the son of John Burnett [II] and Amy Gatewood. Jeremiah Burnett [I] was born in 1718 at Essex Co., Virginia.1 He married Mary McDaniel on 16 October 1738 at Talbot Co., Maryland.1 Jeremiah died probably after 1777 when Jeremiah is mentioned twice in the accout of the estate of John Talbot, once as Jere and once as Jerr, probably meaning that there were two men by the same name.1
     
     Jeremiah was born on Piscataway Creek in South Farnham Parish. Jeremiah's mother, Amy, evidently was pregnant with Jeremiah when her husband John died. Jeremiah was not mentioned in his father's will which was written 17 September in Essex Co. naming his five children. John died eight months later at age 47, shortly before 21 May 1718, when his will was proved in court. In 1771, Jeremiah's brother, Joseph, died intestate in Essex Co. where he had been a wealthy man with land in Essex, his home plantation, and also in Dinwiddie and Caroline Counties. Joseph's son, Richard, filed his Administrator Account with the Court in Essex on 22 October 1773 and listed on his account was the following words, "By articles inventoried and not sold which his brother Jeremiah Claims, totaling 15 pounds, 17 shillings and 6 pence. Joseph had sons Jeremiah, Joseph, Leonard ... but when these names were listed by Richard, he said only their names and did not give relationship to his father, meaning Richard had to define who the above "Jeremiah" was. This statement proves without doubt that Richard was referring to two Jeremiahs, one the brother and one the son of Joseph.2

     When Jeremiah was 12 his mother and his step-father, David Scott, moved to Spotsylvania County and this is probably where he was raised.

     There is a marriage record dated 16 October 1738 in Talbot Co., Maryland to Mary McDaniel of St. Peter's Parish and another dated 27 January 1746 in New Jersey to Rebecca Brown of Burlington. According to Bork in The Burnetts and Their Connections neither of these have been researched and either or both could belong to this Jeremiah. This will need to be researched further.

     After the above marriages, there is no mention of Jeremiah again until the 1763 Tax List for Hanover County, where he is shown with 100 acres and his son, Isaac, with 128 acres. The Hanover tax lists did not begin again until 1782 and Jeremiah is missing. Isaac was still there with 319 acres and 9 white tithables, including his son John. Jeremiah served in the Revolutionary War in Capt. William Campbell's Company under Lt. Daniel Trigg and Alexander Cummings. In May 1774 Court Orders, Bedford Co., Virginia, Jeremiah Burnett was paid 8.6.6 for service in Capt. William Campbell's Company under Lt. Danile Trigg and Alexander Cummings. On 7 June 1774, Montgomery County, Virginia, Grants under the Royal Land Company by order of the Council (the charge was 3 pounds per 100 acres), Jeremiah Burnett surveyed 256 acres on Middle ford of Holston River joining lands of James Thompson, where he now lives. On 31 March 1781, Court Orders, Bedford Co., Virginia, Jeremiah Burnett in Lt. Triggs Company of Militia in Revolutionary War. Enlisted in Bedford Co under Capt. Wm. Campbell.2

John Burnett [II] (M)

     John Burnett [II] was the son of John Burnett [I] and Lucretia Johnston. John Burnett [II] was born circa 1660 at Old Rappahannock Co., Virginia.1 He married Amy Gatewood, daughter of John Gatewood and Amy ? (w-o John Gatewood), before 1702 at Essex Co., Virginia.2 John died in May 1718 at Essex Co., Virginia.1
     
     John was born on Piscataway Creek where his father had settled. Old Rappahannock Co. was abolished in 1692 and this area became South Farnham Parish, Essex Co.

     When his father died intestate, John, as the oldest son, would have inherit his father estate by the laws of primogeniture after a portion was set off for his mother, Lucretia. In August 1691, there were some problems between John and his mother, perhaps regarding their share of John Senior's estate. John Junr. may have taken over more than his share. This may be why Lucretia named her only other son, Thomas Junr. as the executor of her will. John owned a tobacco plantation and along with his brother Thomas Junr. was in the tobacco importing and exporting business.3

     John owned a tobacoo planation and was in the business, with his brother Thomas, importing and exporting tobacco. John and Thomas owned at least one ship and were in and out of the Virginia Colonies by way of the Rappahannock River that flowed into the Atlantic Ocean. On three occasions, indented servant boys imported by John Burnett II, were brought into court to establish their ages and thereby their time of indenture. They were: in 1699, Thomas Reed, age 12 years; in 1700 Thomas Dudding, age 14, and in 1702 John Rice/Price?, age 9 years. When they became of age or their indenture ended, John Burnett, their master, was to give each an allotment of corn for planting and new clothes to start a new life in a new country. Dudding and Rice came together on the same ship before 1700, as in 1704, John was granted a Certificate for 500 acres for importing 10 persons into the Colony. The two boys were on that list.4

     The abstract John's will is dated 17 Sept. 1717, in Dorman's abstracted and compiled Essex County, Virginia Records. However it also says that the will was proved 21 May 1717, and the bond of Amey Burnett as executrix of John Burnett also is dated 21 May 1717. There would appear to be something wrong with one of these dates. Bork in her book The Burnetts and their Connections gives the later date as 21 May 1718 which is probably the correct date.

     The inventory of John's estate was recorded 16 June 1718. A violin was included in the inventory. Total valuation of £244.02.03, including seven Negroes valued at £141.6

     John evidently did not know that his wife was pregnant with another child, Jeremiah, when he wrote his will as he is not mention nor were there any mention that his wife was expecting. The accounting of the estate of his son, Joseph, who died in 1771 in Essex Co., said "By articles inventoried and not sold which was his brother Jeremiah claims." This establishes Jeremiah as a son of John.

Amy Gatewood (F)

Pedigree

     Amy Gatewood was the daughter of John Gatewood and Amy ? (w-o John Gatewood). Amy Gatewood was born in the 1680s at Rappahannock Co., Virginia.1 She married first John Burnett [II], son of John Burnett [I] and Lucretia Johnston, before 1702 at Essex Co., Virginia.2 She married second David Scott after 1718 at Rappahannock Co., Virginia.3 Amy died after 1749 at Spotsylvania Co., Virginia.3
     
     Amy was born on Hoskin's Creek in South Farnham Parrish near where John Burnett II's family lived.

     In 1730 Amy and David Scott moved to Spotsylvania Co., Virginia. David died there and Amy was appointed Administratrix of his estate on 4 April 1749. Amy probably died in Spotsylvania Co. also as Bork indicates that there was no evidence of her returning to Essex Co.

John Burnett [I] (M)

     John Burnett [I] was the son of Thomas Burnett and Margaret Johnston. John Burnett [I] was born before 25 December 1610 at Aberdeen, Scotland. John was christened at St. Nicholas Parish on 25 December 1610 at Aberdeen, Scotland.1 He married Lucretia Johnston, daughter of Andrew Johnston and Janet Matheson, circa 1657 at Old Rappahannock Co., Virginia.1 John died in February 1686 at Old Rappahannock Co., Virginia.1
     
     John Burnett is listed among "Persons of Quality" at age 24 aboard the ship Abraham of London, Mr. John Barker, Master, bound for Virginia, arriving 24 October 1635. This may have been a first visit to Virginia to survey the situation prior to bringing his own ship with supplies from England and Scotland prior to receiving the warrant from the King. The earliest known land patent to John was on 23 May 1637 to John Burnett, Merchant of Edinborough, 150 acres in the upper county of New Norfolk.2

     On 2 July 1638, King Charles I granted a license from Greenwich, England to John Burnett, a warrant in trade in Virginia, to wit: "Warrant from the King to the Governor of Virginia or other officers whom it may concern for John Burnett of Aberdeen, the sole merchant of our Kingdom of Scotland, that hath supplied the plantations of Virginia and become Our tenant there, and his factors to have free commerce and traffic between Scotland and Virginia" upon paying the usual customs and entering into bond to unlade anywhere other thatn in the Ports of Scotland. The cargo, which John arranged to ship to Scotland, was primarily tobacco. One of the records of trading between Aberdeen and Virginia paid 1.00 for his anchorage. No doubt the Burnett ships returning home to Virginia carried a variety of Scottish goods as well as those of the European countries with which Aberdeen had strong trading links.3

     On 28 December 1668, Thomas Gaines deeded 365 acres of land "for diverse good causes and valuable consideracons me thereunto moveing" to John Burnett. The 365 acres was part of a patent of 730 acres.4 On 15 May 1691, this land was surveyed at the request of Jno Burnett, Son to the within Jno. Burnett and described "beginning at the great leaning Red Oake above ye land of Hold by ye Maine Pocoson of Piscattaway Creeke being the beginning of ye said Patent, and runing thence North 11d E. 220 poles to a red and white Oak on ye North side a branch, thens S. 88 d. E. 190 poles to a red Oake by a Path; thence N.W. 287 poles to two Cornr: red Oakes on a levell; thence South West 128 poles to ye tow white Oakes by a Path; thence S. 21 d. 15 m. W. 268 poles to ye siad Pocoson to three Maples, and thence down alongst ye said Pocoson its severall courses to ye place it began."5

     It would appear that John Burnett did quite well and could be considered among the upper class of the Colony. The will of his wife, Lucretia, contained many luxury items that would be used by a lady of the upper class.6

     John sons, John II and Thomas Junr., also took part in the importing and exporting of goods, primarily tobacco.

     In her book, Bork state that she believes that John became ill, perhaps even wounded by Indians, in the later part of 1685. By 3 March 1686, he had died and his estate was ordered inventoried.

     Lucretia Johnston was the daughter of Andrew Johnston and Janet Matheson. Lucretia Johnston was born before 22 March 1629 at Aberdeen, Scotland. She was christened St. Nicholas Parish on 22 March 1629 at Aberdeen, Scotland.1 She married John Burnett [I], son of Thomas Burnett and Margaret Johnston, circa 1657 at Old Rappahannock Co., Virginia.1 Lucretia died in October 1709 at Essex Co., Virginia.1 Lucretia had her will probated on 10 October 1709 at Essex Co., Virginia.2
