BURIAL GROUNDS.
REPORT OF THE TOWN CLERK.
AT A MEETING OF THE HEALTH COMMITTEE, HELD ON THURSDAY, THE 4TH DAY OF JULY, 1878

THE Town Clerk Begs to submit the subjoined Report, pursuant to a resolution of the Health Committee of the 11th April, 1878, with reference to the burial grounds within the Borough of Liverpool.

     1 - By the statute 16 and 17 Vic, cap 134, sec 1, it is enacted "that in case it shall appear to Her "Majesty in Council, upon the representation of one of Her Majesty's Principal Secretaries of State, "that for the protection of the public health the opening of any new burial ground in any City or Town, "or within any other limits, save with the previous approval of one of such Secretaries of State, should "be prohibited, or that burials in any City or Town, or within any other limits, or in any burial grounds "or places of burial, should be wholly discontinued subject to any exception or qualification, it shall be "lawful for Her Majesty, by and with the advice of Her Privy Council, to order that no new burial "ground shall be opened in such City or Town, or within such limits, without such previous approval: "or (as the case may require) that after a time mentioned in the order, burials in such City or Town, or "within such limits, or in such burial grounds or places of burial, shall be discontinued wholly, or "subject to any exceptions or qualifications mentioned in such order, and so from time to time "circumstances may require."

     2 - Pursuant to the powers contained in this section, Her Majesty has made orders with reference to several of the burial grounds within the Borough, of which the following is an abstract: -

7th of April 1854...

THAT no new burial ground shall be opened in the borough of Liverpool, or within two miles of its boundaries, without the previous approval of one of Her Majesty's Principal Secretaries of State: and that burials within the same be discontinued, with the following modifications, from and after the eighteenth day of April then instant (except as is herein otherwise directed), viz. :-
     Burials to be wholly discontinued in St Paul's Churchyard, St Thomas's Churchyard, St Anne's Churchyard and under the Church, St Phillip's Churchyard, Trinity Churchyard and under the Church, St Mark's Churchyard, St Andrew's churchyard and under the Church, in the Baptist Burial Ground, Everton Road, in the Burial Grounds of All Saints' Roman Catholic Chapel, of Great George Street Chapel, of Newington Independent Chapel, Renshaw Street, of St Nicholas' roman Catholic Chapel, Copperas Hill, of St Peter's Roman Catholic Chapel, Seel Street, and in the vaults under the two chapels, in St Peter's churchyard, in St Nicholas' Church and Churchyard, in the Burial Ground of St Patrick's Roman Catholic Chapel and under the Chapel, and in the Wesleyan Methodist Burial Ground, Upper Stanhope Street. With the exception of private vaults and graves, no more than one body to be buried in any grave in the burial grounds of the Necropolis and of St Mary's Cemetery, of the Scotch Presbyterian Church, Oldham Street, of the Scotch Presbyterian Church, Rodney Street, and of St Anthony's Roman Catholic Chapel, Scotland Road; and burials to be wholly discontinued in the last three-mentioned grounds from and after the first of January, one thousand eight hundred and fifty-five. With the same exception, no more than one body to be buried in any grave in St Michael's churchyard, and burials to be wholly discontinued therein from and after the first of January, one thousand eight hundred and fifty-five. With the same exception, no more than one body to be buried in any grave in the churchyard of St George's, Everton. With the same exception, no more than one body to be buried in any grave in the burial ground of St Anne's Chapel, Edge Hill, no burial to take place within twenty feet of the schools; and with the same exceptions, burials to be wholly discontinued therein from and after the first of January, one thousand eight hundred and fifty-five. Burials in the vaults of this Chapel to cease forthwith. Burials to be wholly discontinued in St Martin's churchyard, from and after the first of august, one thousand eight hundred and fifty-four: in the burial grounds of Brunswick Chapel, Moss Street, and of the Unitarian Chapel, Renshaw Street, from and after the first of January, one thousand eight hundred and fifty-five; and in the Quakers' Burial Ground, Hunter Street, from and after the first of January, one thousand eight hundred and fifty-six. 
     Burials to be wholly discontinued in all that part of St Martin's Parochial Cemetery which has already been buried in, and to cease wholly within the cemetery from and after the first of August, one thousand eight hundred and fifty-four. Burials to be discontinued forthwith in all the part of the Independent Chapel Burial Ground, Toxteth Park, which is situated to the east and south of the Chapel, and to cease wholly therein, from and after the first of January, one thousand eight hundred and fifty-five.
8th of June, 1854...
     That so much of the Order in Council of the seventh of April last, as regulates and directs the discontinuance of burials in the churchyard of Trinity Church, Liverpool, and under that church, and also in the churchyard of St Michael's, Liverpool, be, and the same is hereby repealed.
3rd of July, 1854...
     That so much of the Order in Council of the seventh of April last, as directs the discontinuance of burials in St Peter's Churchyard, in the town of Liverpool, he hereby repealed.  
11th of August, 1854...
     That so much of the Order in Council of the seventh of April last, as directs the discontinuance of burials in St Martin's Churchyard, Liverpool, be hereby repealed.
13th of Sept, 1854
    That such parts of the Order in Council of the seventh of April last, as direct the discontinuance of burials in St Thomas's churchyard, Liverpool, be hereby repealed.
7th of Dec, 1855
     That burials be discontinued, from and after the first of January, one thousand eight hundred and fifty-six, in the Quakers' Burial Ground, Hunter Street, Liverpool, except in ground which has never been previously buried in.
22nd of Oct, 1856
     That no new burial ground shall be opened in any of the undermentioned parishes without the previous approval of one of Her Majesty's Principal Secretaries of State; and that burials in the said parishes shall be discontinued, with the following modifications, from and after the fifth day of November next (except as is herein otherwise directed), as follows, viz: -
     Liverpool. - Beneath the Churches of the Holy Trinity and Christ Church, Liverpool, and (except in family vaults and brick graves, which can be opened without the disturbance of soil that has been buried in, in which each coffin shall be embedded in charcoal and separately entombed in an airtight manner, and in purchased family graves, not less than five feet deep, which can be opened without the exposure of remains, for the burial only of members of the families of their owners), in Holy Trinity Churchyard, in Christ Churchyard, in St John's Churchyard, in St Martin's Churchyard, and in St Michael's Churchyard, in Liverpool.
     Walton-on-the-Hill. - Beneath the Roman Catholic Chapel of St Anne, Edge Hill, in that Parish of Walton-on-the-Hill, and in that part of the burial ground thereof which is within twenty feet of the school-room, and also in the rest of the burial ground, and in the churchyard of St James', Toxteth Park, in the said parish, except in graves never previously opened, one body only to be buried in each, unless in family graves now existing for the burial of members of the same family - such graves being not less than five feet deep, and which can be opened without the exposure of remains, and in now-existing vaults and brick graves which can be opened without the disturbance of soil that has been buried in, in which each coffin shall be embedded in powdered charcoal and separately emtombed in an airtight manner.
16th of Nov, 1857...
     That the regulations for burial grounds, provided under the Burial Acts, and annexed to this Order (omitting that numbered III.), be established in respect of all burials in common graves in St James's Cemetery, Liverpool
13th of Nov, 1858...
     That the officiating priest, or other person or persons, having the case of the vaults under St Anne's Roman Catholic Chapel, Edge Hill, near Liverpool, do adopt, or cause to be adopted, the following measures in respect of such vaults, viz: - That the coffins in the said vaults be completely covered with soil mixed with charcoal, or McDougal's disinfecting powder, and entombed by brickwork in an airtight manner.
9th of Sept, 1865...
     That burials shall be discontinued forthwith, wholly, in the churchyards of St John and of St Peter.
20th of Dec, 1867...
     Forthwith, wholly, in the church and churchyard of St Thomas, except in the vaults belonging to Miss Leathers and Mr Edward Parry, in which each coffin shall be embedded in charcoal and separately entombed; that is, enclosed by brickwork or masonry properly cemented.
7th of Oct, 1869...
     That burials be discontinued in the following burial grounds: - St Michael's Liverpool. - Forthwith, wholly, in the church of St Michael, Toxteth Park, in the parish of Walton-on-the-Hill, and also in the churchyard, except in family vaults which can be used without baling out water, and except in family graves which can be opened to the depth of five feet without the exposure of coffins or the disturbance of remains, and that at least a day's notice of any intended burial be given to the Surveyor of the Toxteth Park Local Board of Health.
10th of May, 1872...
     That burials be discontinued (except as is herein otherwise directed), forthwith, in the Necropolis cemetery, in the Parish of Walton-on-the-Hill, in the County of Lancaster, except in graves in which every coffin buried shall be separately entombed by stonework or brickwork properly cemented, or by concrete not less than six inches in thickness, that no earthen grave that has been buried in shall be reopened, unless it be a private grave, in which case the soil within a foot above the previously-buried coffin shall be left undisturbed, and that no grave shall be opened less than four feet deep.
     Forthwith, in the St Mary's Cemetery, in the Parish of Walton-on-the-Hill, in the County of Lancaster, except in graves in which every coffin buried shall be separately entombed by stonework or brickwork properly cemented, or by concrete not less than six inches in thickness, that no earthen grave that has been buried in, in that part of the said Cemetery which is north of a line drawn from a point seventy yards south of the East end of the Northern Wall to another point fifty yards south of the West end of the Northern Wall, shall be reopened, unless  it be a private family grave, in which case the soil within a foot above the previously-buried coffins shall be left undisturbed, and that no grave shall be opened less than four feet deep. 
13th of May, 1875...
     That burials in St Anthony's Roman Catholic church, Liverpool, be discontinued forthwith, wholly, in the catacombs beneath the said church.
