FRANCIS II


The second Francis Mauldin found to come to the American Colonies was one that arrived 13-14 October 1680 aboard the ship 'Virginia Factor' bound London to Maryland. This individual paid is passage.

He also settled in Calvert County, MD in the Port Republic area. On 26 April 1861 he had 250 acres of land surveyed and it was named "Prevent Danger".

Christ Church Calvert Co., MD Francis Malden one of the first Vestrymen gave one acre of "Prevent Danger" to the church. The first court of the church was held Feb 7, 1692 in the fifth year of William & Mary.

It is unknown who he married. It is highly suspect that he had at least three children if not more. The highly suspect children was Francis Mauldin that became known as Major Francis Mauldin, Elizabeth Mauldin that married David Delemere February 27 1700/01, and Ann Mauldin b c 1692 that married William Amos.

Elizabeth Mauldin married David Delemere in Port Republic Christ Church Calvert Co., MD. No further information about this family.

Ann Mauldin b c 1692 married about 1712 in either Cecil or Harford Co., MD William Amos b c 1690 in England. The reason for listing her before Maj Francis Mauldin is to better tie a relaltionship between Ann's decendent and Major Francis's decendent. William Amos purchased land 1710 in Maryland.

An excellent book "Children of Mt. Soma" by Gertrude Stevens gives and excellent account of the Amos family. I shall only highlight the information as it pertains to this document.

Other children of William Amos, Jr and his first wife Hannah McCommas were Anne, William, Eleanor b c 1755 d 1803 m William Bull, Mary, Priscilla, James, Luke, Nancy, Benjamin and Hannah.

Rachel Bull the wife of Mauldon Amos was the daughter of Jacob Bull and his wife Rennis Bussey who were married 17 Oct 1752 in St Johns, Joppa, MD. Rachel was born 13 Sept 1755 and died 22 Jul 1836 in Jones County, GA. Mauldon Amos died 22 May 1845 in Lagrange, Troup Co., GA. His will was probated in Lagrange.
Mauldon & Rachel's daughter Martha Amos b 1773 in Harford Co., MD d 1851 or 1861 in Thomaston, Upson Co., GA. She married Henry Mauldin, grandson of Major Francis Mauldin in Columbia County, GA January 1798.

Major Francis Mauldin attained the rank of Captain of Maryland Militia in Calvert County, MD. He attained the rank of Major in Cecil County, MD. There is some speculation that he had risen to the rank of Colonel in Maryland Militia since a document from a Deleware Friends (Quaker) church listed his rank as Colonel.

The first account of Major Francis Mauldin was his purchase of land in Cecil County, MD in 1702.
William Dare sole 700 acres to Francis Mauldin. Land joins Thomas Bull. This land was called Rich Mountain, Land later called Bull's Mountain and Mauldin's Mountain.
Cecil County 1711, the estate of Thomas Bull was appraised by Francis Mauldin & Nicholas Hyland. Thomas Bull 33A.17 1 CE 1234.18

Major Francis Mauldin's will of 1732 lists three sons by name and five daughters that are unnamed. He lists his second wife as Executrix of his estate.
The maiden name of his first wife was determined by a notice 18 April 1727 on his daughters coming marriage. "Ann Moulden relative of Douglas Brammer." This entry suggests that her mothers mother's maiden name was Brammer. It could also suggest that her grandmother's maiden name could be Brammer, but it is more likely her mother's maiden name.

In the name of God, Amen. I Francis Mauldin of Calvert Co., Maryland, Gent., being sick and weak in body but of sound and perfect memory, do make and ordain this instrument of writing to be my last Will and Testament as follows:
Viz - I give and bequeath to my eldest son, Francis Mauldin, the plantation where I now live, being the lowest part of a tract of land called "Collets Town" to him (bought of James Roberts) and his heirs and assigns forever. Then I give unto my son the said Francis Mauldin, part of the land and marsh which I bought of James Roberts, being to the Westward and Southward of the Bonnils here after mention, beginning at a bounded poplar tree being the North East bounded tree of Collets Town which stands in the branch called the North East branch of Back Creek and from the above said poplar with a straight line to a great stone at the head of a cove of the marsh to the river channel of Back Creek which comes to the eastermost side of Locust Point Landing, then up the channel westward to the head which is between two hills called Kiss Acres Hills, then up the valley over the main road until it intersect Collets Town all of which land and marsh with the bounds before mention, I give unto my said son Francis and to his heirs and assign forever.

Then I give unto my son Benjamin Mauldin, Timber Neck Plantation and all the land and marsh I bought of James Rob erts exclusive of the land before mentioned given to my son Francis, as the deeds from said Roberts will make appear, to him and his heirs and assigns forever, and further it is my will that in case my son Francis Mauldin dies without issue lawfully begotten that then the land before metioned as given him shall to and be my son Joseph Mauldin and his heirs and assigns forever.

As to my personal estate after my lawful debts are justly paid, I leave the same to be equally divided amongst all my children, this is to say, my 3 sons and 5 daughters and further it is my will that my son-in-law Zebulon Hollingsworth have the liberty of having 2 of my negroes named Wings and Bess, paying to the estate what they are appraised at.

Further, it is my will that my three sons shall have the benefit of their labour after they arrive at the age of eighteen years in cse they follow plantation business, and further it is my will lthat my son shall not be donfined to live with any father-in-law against their wills, but that they be placed to learn and work or bound out to trades, in the best manner my Friends hereafter named can do for them.

Further, it is my will that my true and well beloved wife, Bridget Mauldin, be my whole and sole Executrix and further it is my will that my wife be not compelled to pay my children all at once to improvish the family, but to pay as she can whilst she lives a widow. But if she marries, it shall be paid on demand for fear of the embezzlement of the estate.

It is likewise my particular will and devise that my trusty and well beloved neighbors and friends, Edward Johnson, John Kinky, Thomas Johnson, Nicholas Hyland, and Zebulon Hollingsworth, will be so kind to advise and assist my Executrix Bridget in the Administration of affairs and to admonish and advise my 3 sons to refrain from bad company and Sabbath breaking in all cases which may be for the good both of their souls, bodies, and estates. And further if so please them, I advise that Thomas Johnson, Jr. and Nicholas Hyland, be bondmen for my Executrix and Edward Johnson and John Kinky, appraisers of the estate.

Further, I will that my son Francis, pay his brother Joseph thirty pounds current money when he arrives at age, and that my son Benjamin, likewise pay him the said Joseph at the same time, twenty pounds like money. But in case money is scarce, then the same to be paid in Country Produce by both at market price by the advise of my friends aforesaid.

Further, it is my will that in case my son-in-law John Dawson should bring any account against the estate, that it shall be abated or barred out of his wife's share, which I hope he will not pretent to

Further it is my son Benjamin's land be not hurt by the cutting of any timber or clearing any land without side the present fence.
Further, it is my will that if any person should pretend to insinuate for their own advantate to the damage of the estate, that my Friends before mentioned will restrain them from the same. I do likewise by those presents Make and ordain this my last Will and Testament and hereby revoking and making void all other wills where I have hereto those presents set my hand and affixed my seal this first day of October in the year of our Lord one thousand seven hundred and thirty two.

At the time of signing of this will, all three sons were less than eighteen years of age. The Maryland assembly lists his son Francis as being born in 1719 and dying in 1762. Since Benjamin was younger according to the will then his dob would be c 1720-1721. And Joseph who was a product of his second marriage was born about 1723.

Bridget Belaine was first married to James Robinson who died in 1719. In 1738, Cecil County Maryland, Bridget Maldin witnessed a land deed with the Rev Hugh Jones. Later, in 1740-calender of wills information:

Reverend Hugh Jones and his wife Bridgett took oath on Dec 14, 1739 that test. told them at the "The Glebe House" St. Stephens Parish that she wished her dau - Parr to have estate coming to test. from her lat husband also she gave her son John certain pers. At that time she sent other childe out of the room.
It appears, that Bridget (Belaine) Robinson Mauldin took as a third husband the Reverend Hugh Jones. It is reported that Rev Jones lived to be about 90 years of age.

Zebulon Hollingsworth and his wife Ann Mauldin had the following children: Elizabeth Hollingsworth b 6 Feb 1728, Stephen Hollingsworth b 13 May 1730, Jesse Hollingsworth b 12 Mar 1732 d 30 Sep 1810, and Zebulon Hollingsworth, Jr. b 17 May 1735 d 24 Mar 1812. Zebulon Hollingsworth married again after Ann's death. He had a son Jeptha b 30 Aug 1745 with his second wife.

Francina Mauldin and her husband Samual Bayard had the following children: Peter Bayard b 16 Jun 1732 d 1819, John Bayard b 29 May 1734 d 13 Dec 1812, Mary Bayard b 10 May 1736 d 1825, Joseph Bayard b 9 Jan 1737 d 1825, Rebecca Bayard b 26 Sept 1739 d 1825, and Stephen Bayard b 23 Jan 1744 d 13 Dec 1815.

I have not been able to document children for either Benjamin or Joseph Mauldin. A listing of children had been published for Benjamin and his wife Ann, but it is highly unlikely that Benjamin would be fathering children in the 1730's.

Francis (Capt) Mauldin married c 1740 Mary Ketridge Sluyter b c 1720. Mary was the daughter of Benjamin Sluyter and his wife Elizabeth Boone. Her siblings were Henry, Peter, Benjamin Jr, Rebecca, and Elizabeth.

Captain Francis Mauldin was a Captain of Maryland Militia and also a member of the Maryland Assembly.

Will of Francis (Capt) Mauldin 12 Jan 1762
In the name of God, Amen. I, Capt Francis Mauldin of Cecil Co., in the Province of Maryland, Gent., being of perfect mind and memory thanks be given to God for the same therefore calling to mind the immortality of my body and knowing that it is appointed for all men once to die, do make and ordain this instrukment to writing to be my Last Will and Testament in manner and form as follows I Imprimis
I give and bequeath to my son Francis the Plantation where on I now live with all lands thereunto adjoining and appurtenants there unto belonging to him the said Francis Mauldin and his heirs and assigns forever except what is hereafter bequeathed. Also, one negro boy named Simond.
Second, I give and bequeath to my son Benjamin all that piece or parcel of land that I the testator bought of Henry Baker, adding thereunto all that swamp and land that is to the Southward and Southeast thereof, and next adjoining thereunto. Beginning at the eastermost side of said swamp, at the bay shore about two perches from said swamp, on dry or fast ground running from thence with a straight line until it makes it four perches wide from the swamp of fast land and then running as the swamp goes four perches from the said swamp on fast land till it comes within one perch of a Spring called Graneys Springs, then altering the course and going on perch below the spring unitl it goes two perches to the Eastward of said springs and from thence with a straight line to a oak tree marked with six notches standing by the main road that leads to Turkey kPoint to the Head of Elk River, and then from said oak with a straight line to another marked oad with four notches, standing in a alley that leads into Back Creek. Also, one negro boy named Lone, which land and negro boy as described, I give unto my son Benjamin Mauldin, his heirs and assign forever.
Thirdly, I give and bequeath unto my son William Mauldin, one negro boy named Phill and one negro girl named Nan. Further it is my will and desire that my son William be bound out to such a trade or business as my executors shall think fit until he come of the age of twenty one years old.
Fourthly, I give and bequeath unto my son Henry Mauldin, one negro boy named Gabriel, and one negro gil named Salle. Further, it is my desire that my son Henry after my executor has given him lessons that he be bound out to such a treade as my executor shall think fit.
Fifthly, I give and bequeath to my daughter, Rebecca Mauldin, one negro girl named Bess.
Sixthly, I give and bequeath to my daughter Elizabeth Mauldin, one negro girl named Hannah.
Seventhly, I give and bequeath to my daughter Mary Kitridge Mauldin, one Negro girl named Jean.
Eighthly, I give and bequeath unto the child that my wife now goes with, one negro boy named Jack.
Ninethly, it is my will and desire that my executor shall give the son of John Hunt one years schooling and find him common attire when there is a school kept in the Neck where my executor now lives.
Tenthly, It is my will and desire that in case any of the aforesaid bequeathed negroes should die before they come into the purassign of the aforesaid Legatess then the same shall be made good by such negroes as shall be hereafter born from the present stock of negroes and not before given away or bequeathed by the Testator.
Eleventhly, It is my will and desire that my sons Francis, Benjamin, William and Henry receive the land and negroes as aforemention and described at the age of one and twenty years old or day of marriage.
Twelthly, It is my will and desire that if in case my son Francis or my son Benjamin, should die without lawful issue born in wedloc, it is then my will and desire that my son William Mauldin may have and enjoy either of the lands as before described.
Further, it is my will and desire that in case my son William Mauldin should die out of this life before he comes to the age of twenty one years or day of marriage, then it is my will and desire that my son Henry Mauldin should have and enjoy my Francis and Benjamin Mauldin land as described, if in case they should die out this life without lawful issue borned in wedlock, and if in case the said Henry should die out this life without having any lawful issue borned in wedlock, then it my will and desire that the next heir at law should have and enjoy the same forever.
Thirteenthly, It is my will and desire that my daughters Rebecca, Elizabeth, and Mary Kitridge, and the child my wife now goes with shall receive their respective legacies at lawful age or day of marriage.
Fourtenthly, my will and desire is that my beloved wife, Mary, keep my estate in her hands during her widowhood or marriage of my children, and after my just debts be paid and the legacies before mentioned be also paid and all other incident charges and my well beloved wife;s third of my estat be taken out, then the residue, and remainder part of my estate be equally divided between all my children, that shall then be alive.
Fifteenth. It is my will and desire that my two Friends Col. Nicholas Hyland and Mrs Robert Hart or the survivor of them be trustees or overseers and it is my desire that they or the survivor of them take the charge, trouble, and authority to see this and every part thereof put into execution.
Sixteenthly, and lastly, It is my will and desire that my well beloved wife, Mary, be appointed and constituted made and ordained, my only sole Executor of this my last Will and Testament and I do hereby utterly disavor, revoke and disannull all and every other former Testaments, Wills, and Legacies and executors by me in any way before this time named, will and bequeathed. Ratifying and confirming this and no other, to be my Last Will and Testament. This the twelfth day of January, One Thousand Seven Hundred Sixty Two.

This will gives quite a bit of information. First the son Francis is most likely 21 years of age. Benjamin is probably over 18 years of age. William is probably under 18 years of age and Henry who needs schooling is probably under six years of age.

In the name of God, Amen. This seventeenth day of April, in the year of our Lord one thousand and seven hundred and seventy, I Francis Mauldin, Gentleman being in a sick and low condition but of perfect mind and memory, thanks to God for the same, then calling to mind the mortality of the body and knowing that it is appointed for all men once to die, do make this my last Will and Testaments, annulling and making void all other Wills and Testaments that hath or shall be made whatever in the words and manners as following:
I resign my Soul to God who gave it, and my body to the Grave, in hopes of a Glorious Resurrection through then minds of Christ Jesus my God and Savior. I order my body to be buried in a decent and Christian manner. All my just debts to be duly justly fully paid, and from the rest of the worldly goods that hath pleased God to bestow upon me, I leave and bequeath in the following manner.
Impris - I give and bequeath all my wearing clothes and one piece of lead colored cloth to be equally divided between my two brothers, Benjamin and William.
Item - I give and bequeath unto Margaret Sims the sum of five pounds, Pennsylvania Currency, to be paid the said Sims the first day of December next following the date hereof.
Item - I give all the rest of my personal estate unto my youngest brother, Henry Mauldin, and my youngest sister Mary Kitridge Mauldin, unto them equally to be divided between them and if either of them should die before the years of maturity, that my whole personal estate is to be and bequeathed to the surviving one And, if my brother Henry and sister Mary Kitridge Mauldin should die before the ate of maturity, that then it is to be equally divided between my brothers Benjamin and William Mauldin, and the crop of wheat, that is now in the ground with all the personal estate bequeathed to younger sister, I order to be converted into cash and in three years after this date to be put to interest for their benefit or use.
And lastly, I leave my younger brother Benjamin Mauldin to be the whole and soll Executor of my personal estate, and to have the charge and education of brother Henry and sister May if ever there should happen to be occasion for this same, this I confirm pronounce and declare to be my Last Will and Testament.

This will adds to the fact that Henry Mauldin and sister Mary Kitridge Mauldin were minors in 1770 and that Henry probably did not sire a child in 1761.

It is believed that Henry Mauldin is residing with brother William since he was not listed in the census.

Will of Benjamin Mauldin dated February 1804 Cecil Co., MD is incomplete in that part of it has been lost. The following is all that has been found:
In the name of God, Amen. I Benjamin Mauldin of Cecil Co., State of Maryland being very sick and weak in body but of sound and disposing mind, memory and understanding considering the certainty of death, and the uncertainty of the time thereof and being desirous to settle my worldly affairs and thereby be the better prepared to leave this world when it shall please God, to call me hence, Doe thereof make and publish this my Last Will and Testament, in manner and form following.
First and Principally, I commit my sould unto the Hands of Almighty God and my body to the earth to be decently buried at the discretion of my Executrix herein after named and after my debts and funeral charges are paid and my wifes third taken, I desire to bequeath as follows.
It is my will and desire that my plantation shall be divided between my two sons, Thomas and James, beginning for a division line between them on the Bay shore at High Water mark opposite to the ditch cut through my meadow then with the ditch as far as it extends then up the valley until it intersects a gully at the side of the field then with a straight line from said gully across the field until

This indenture made the fifth day of Nov 1796 between Henry Mauldin of Cecil County, MD and Phillip Roach of the same county. Twenty three acres for 11 lbs current lawful money of the State of Maryland signed. sealed, and delivered in the presense of Stephen Hyland, Jeremiah Baker.
