Whereas, Christian Martin, Sr.,
late of Earl Township Lancaster County and State of Pennsylvania, deceased;
in his last Will and Testament, dated, May 1st AD 1875 and duly proven
May 11th AD 1876, directed that his sons should choose three and his daughters
two appraisers disinterested impartial men to value and appraise his two
Farms.
Therefore, we Moses S Martin, Samuel
S Martin, henry S Martin, Abraham S Martin, Reuben S Martin and Levi S
Martin, the six sons of said Christian Martin, deceased have chosen John
B Sensenig of Earl Township and John L Mohler and George L Bauman of Ephrata
Township; and we Susanna, wife of Monroe Mohler; Magdalena, wife of Samuel
L Zimmerman; and Anna S Martin, the three daughters of said deceased have
chosen Amos Martin and John Martin both of Earl Township, as appraisers
to value the two Farms of said deceased. In witness whereof, we have
hereto set our hands the 27th day of May, AD 1876. Moses S Martin;

S Martin; Magdalena S Zimmerman; Anna S Martin; Susanna Mohler.
We the undersigned, appointed by the
children of Christian Martin, Sr., deceased; to value and appraise the
two farms of said deceased, as here in before stated, hereby report that
after having viewed the several premises we have under the directions given
in said decedents will valued the farm situated in said Ephrata Township
containing 76 acres and 145 perches, at one hundred dollars per acre, amounting
to $7690.62 and the farm in Earl Township containing 83 acres at one hundred
and fifty dollars per acre amounting to $12,450.00.

We the undersigned hereby agree to
and accept the farm of 76 acres and 145 perches of land above mentioned
at the above valuation money, and hereby bind ourselves our heirs, executors
and administrators to the payment thereof under and as directed in the
will of said Christian Martin, deceased. In witness whereof we have

And whereas the said Christian Martin
in his last will and testament directed that all advancements made to his
children should be accounted for in the distribution of his estate, and
all his children should be made equal in share, and that those to whom
the aforesaid farms were devised should retain their whole share of his
estate, taking in account their advancements) out of the valuation money,
and pay the net balance to his other children in installments, for which
they should give their notes, without interest until maturity.
Now Know all men by these presents,
that we Moses S Martin, Samuel S Martin, Susanna S Mohler, wife of Monroe
Mohler, Magdalena S Zimmerman, wife of Samuel S Zimmerman; and Anna S Martin,
five of the nine children of said Christian Martin, deceased; all of Lancaster
County and State of Pennsylvania, do hereby acknowledge that we have received
from Henry S Martin, Abraham S Martin, Reuben S Martin and Levi S Martin,
the other four of said deceased's children and devises and acceptors of
the farms herein before mentioned. Each the sum of fourteen hundred
and thirty one dollars and ninety six cents in notes payable as directed
in the last Will and testament of said deceased
And therefore we do by these presents
severally release, acquit and for ever discharge the said Henry S Martin
and Abraham S martin and their respective heirs, executors and administrators
and likewise the farm accepted by them at the valuation made thereof by
the hereintofore named appraisers; (which tract of land is bounded and
described as follows, beginning at a Post thence by land of Samuel Landis,
south thirty two degrees and three quarters west, thirty four perches to
a post; thence by the same, north forty nine degrees and half west forty
perches and a quarter to a post; thence by land of John L Mohler, south
fifty nine degrees west; ninety two perches and eight tenths to a post;
thence by land of Abraham Bowman, south forty four degrees east seventy
nine perches and three tenths to a post; thence by the same, north forty
five degrees and a quarter west, eleven perches and one tenth to a ----,
thence by the same, south forty four degrees and a quarter east, forty
six perches and eight tenths to a ---; thence by land of said John L Mohler;
north forty four degrees and a quarter east, forty two perches and fifteen
hundredths to a stone; thence by the same, south thirty three degrees and
a quarter east, thirty one perches and six tenths to a white Oak tree;
thence by land of David Mohler, north thirty nine degrees and a half east,
twenty three perches and four tenths to a ---; thence by land of Simon
Mohler, north sixty eight degrees and a quarter east; eight perches and
eighty five hundredths to a stone; thence by the same, north nineteen degrees
west; one hundred and fourteen perches and two tenths to the place of beginning
containing seventy six acres and one hundred and forty five perches.)

and administrators and likewise the farm accepted by them, at the valuation
made thereof by the said appraisers; (which tract of land is situated in
said Earl Township, bounded and described as follows: beginning at a stone
on the Turnpike road; thence by land belonging to the estate of Henry M
Musser, deceased; north sixty six degrees east, sixty three perches and
seven tenths to a stone in the run; thence down the run, by land of Elizabeth
Weaver and Christian W Zimmerman, respectively, the four following courses
and distances, north twenty two degrees west, twenty three perches; north
nineteen degrees and a half west, twenty eight perches and a half, north
seventeen degrees west, twenty one perches and one tenth and north thirty
seven degrees and a half west, twenty eight perches and four tenths to
a stone; thence by land of John Reiff, south eighty eight degrees west,
one hundred and forty perches and thirty five hundredths to a stone; thence
by land of Anna Ditlon, south twenty degrees and a quarter east forty three
perches and fifty five hundredths to a stone on said turnpike road; thence
on the same by land of Reuben Reidenbach and Isaac Martin; respectively
south fifty seven degrees east, one hundred and twenty nine perches and
eight tenths to the place of beginning containing eighty three acres.)
from the payment of our respective shares out of the valuation money of
said two tracts of land ; and from the further payment of any share or
interest in, or out of the said two tracts of land.
And we, Henry S Martin, Abraham S Martin,
Reuben S Martin and Levi S Martin, hereby acknowledge that we have retained
each, his full share of the whole estate of said Christian Martin, deceased,
(including the advancements made to us by our said father, before his death,)
in the land which we accepted at the valuation made thereof, under the
directions of the will of said deceased; and we hereby severally release,
acquit and forever discharge each the other, and each the other's land
accepted, from the payment of any share, right or interest in or out of
the several tracts of land accepted by us; and we also release, acquit
and for ever discharge Moses S Martin, Samuel S Martin and Henry S Martin
the executors of the will of said Christian Martin, dec'd and their respective
heirs, executors and administrators from the payment of any share, legacy
or interest in or out of the personal estate of said deceased.
And we, Moses S Martin and Samuel S
Martin, two of said executors hereby acknowledge that we have retained
our respective equal shares out of the personal estate of said deceased.
And we, the said Susanna S Mohler,
Magdalena S Zimmerman and Anna S Martin; do hereby acknowledge that we
have received from the said three executors of the will of said deceased;
viz; Susanna S Mohler, the sum of fourteen hundred and thirty nine dollars
and twenty cents; Magdalena S Zimmerman the sum of thirteen hundred and
seven dollars and seventy cents and Anna S Martin; the sum of eighteen
hundred and ninety four dollars and ninety one cents in full satisfaction
and payment of our respective shares out of the net balance of the administration
account filed by said executors and which with our respective advancements
is in full of our respective shares of the whole personal estate of said
Christian Martin, deceased; and therefore we do by these presents severally
release, acquit and forever discharge the said executors and their respective
heirs, executors and administrators and the estate of said deceased from
the further payment of any money, share, legacy or interest in or out of
the estate of said deceased; and we the said Abraham, Reuben and Levi S
Martin, Susanna S Mohler, Magdalena S Zimmerman and Anna S Martin release,
acquit and forever discharge the said executors their heirs and assigns
from all actions, suits, accounts, claims and demands whatever in anywise
relating to the estate of said deceased, or the administration thereof
by the said executors; and we the said Moses and Samuel S Martin, Susanna
S Mohler, Magdalena S Zimmerman and Anna S Martin, release, acquit and
for ever discharge the said Henry, Abraham, Reuben and Levi S Martin, the
acception of said farms from all actions, suits, accounts, claims and demands
whatever in anywise relating to the said two tracts of land or the apraisement,
or the acceptance thereof.

Before me an alderman, in and for said city
personally came the above named Moses S Martin, Samuel S Martin, Henry
S Martin, Abraham S martin, Reuben S Martin, Levi S Martin, Magdalena S
Zimmerman, Anna S Martin and Susanna S Mohler and severally acknowledged
the foregoing appointment of appraisers to be their act and deed and desired
the same to be recorded as such, and the above named Henry S Martin, Abraham
S Martin, Reuben S martin and Levi S Martin severally acknowledged the
foregoing acceptance of the respective farms to be their act and deed and
desired the same to be recorded as such; and the said Moses S Martin, Samuel
S Martin, henry S martin, Abraham S martin, Reuben S Martin, Levi S Martin,
Susanna S Mohler, Magdalena S Zimmerman and Anna S Martin and severally
acknowledged the foregoing release to be their respective act and deed
and desired the same to be recorded as such.
The said Susanna and Magdalena being
respectively of full age and by me duly examined separate and apart from
their respective husbands and the contents thereof being firs made known
to them, declared that they did voluntarily and of their own free will
and accord sign, seal and as their own act and deed deliver the same without
any coercion or compulsion of their said husbands.
