The Certificate of Death, Arkansas file 8i9 of Herbert Mitchell, identifies Herbert's father as Benjamin Franklin Mitchell and his mother as Paralee Clark. A letter to me from Elsie Marie Hinchcliff Mitchell, wife to Herbert, lists B.F. as her father-in-law. The letter also lists names of Herbert's siblings.

B.F. was born on a Tuesday.

The 1900 US Census, (Arkansas, Independence County, Roll 61 Book 2, Page 45), shows Benjamin Mitchell, wife Paralee, and children: Charlie, Benjamin M., General L., Lillie R. J., John ?, William, Edward O., Daisy D., Albert H. S., and "Babe." The "Babe" would be Herbert Mitchell, my grandfather.

1920 Federal Census, (Arkansas, Jackson Co., Byrd Twp, West Div., Roll T625_66, Image 682, dwelling 433), As head of house - Benjamin F. Mitchell, age 58, wife Cora, 29, stepsons George and Robert Earl Roberts.

*Cousin James Tims, son of subject's daughter, Daisy Mitchell Tims, has news clippings telling of the murder of B. F. Mitchell at the age of 78. According to the articles, Great-grandfather B.F. lived near Amagon, Arkansas. He was discovered by his daughter. Mrs. Lillian Mitchell Priest went to investigate when she realized she had not seen her father out and about his property which she could see from her home across the road and field. Subsequently, an arrest was made.

I found one more article through the Arkansas History Commission about the initial arrest of Paul Nelson, Alvis Jackson, and Joe Priest. Below are the transcribed articles.

FORMER LOCAL MAN FOUND MURDERED

B. F. Mitchell Slain At His Home Near Amagon

ROBBERY BELIEVED MOTIVE

B. F. Mitchell, aged 78, well-to-do farmer and land owner, and a former resident of Tuckerman, was found murdered at his home three miles east of Amagon Thursday morning by his daughter, Mrs. Lillian Priest, who lives across the field from her father's home. Mr. Mitchell lived alone and when his daughter remembered that she had not seen her father around the place that morning she investigated and found him dead in bed. He had been beaten over the head and face and had been dead several hours when discovered.

It is believed that robbery was the motive of the crime, as it had been rumored in the community for some time that Mr. Mitchell kept a large sum of money in the house. The house had been ransacked but Mrs. Priest and other members of the family did not know if anything had been taken as they knew nothing of his keeping any money to speak of in the house. Tracks were found beneath a window through which it is believed the killer entered the house.

Sheriff Gray Albright took bloodhounds to the scene but a scent could not be picked up, as many people had gathered at the scene of the crime as soon as news of it had spread and the trail was obliterated.

A jury empaneled by Coroner Sam Rich returned a verdict to the effect that Mr. Mitchell "came to his death at unknown hands."

Funeral services for the murdered man were held at Dowell's Chapel Cemetery at Centerville Friday afternoon at 2:30 o'clock, in charge of Hafner & Patterson.

Surviving Mr. Mitchell is a daughter, Mrs. Lillian Priest of Amagon; four sons, Rev. Herbert Mitchell of St. Louis; Albert and Ben Mitchell of Amagon; and John Mitchell of Tuckerman; and his wife, Mrs. Cora Mitchell of Tuckerman, from who he had been separated several years, but was not divorced.

B. F. Mitchell

B. F. Mitchell, who was murdered at his home near Amagon the night of Mary 24, was born in Jackson Co., Tenn., Feb 22, 1859. At a very early age he was left to care for his other and four children, by the death of his father. His mother was a woman of high ideals and reared the family in a home where honesty and fair dealing were taught and practiced. They lived by the Golden Rule and the teachings of his early life were carried out always by Mr. Mitchell.

When 18 years of age he went with the family to Louisiana. There his mother, step-father, two sisters and a brother were stricken with fever and died. He was left with a 3-year-old half-brother and 4-year-old brother to care for. He brought the two children back to Tennessee and for two years supported them by day labor.

In 1871 he was married to Miss Rebecca Clark, the daughter of a Baptist minister. He and his wife reared their children in the same manner that they had been reared and he lived a quiet home life, was fond of his home and family and always provided well. His highest ambition was to rear his children to be honest, upright, useful and respected citizens.

No man can say truthfully that Mr. Mitchell ever harmed anyone. He was always willing and glad to help those in need. By hard work and good management, fair and honest dealings with his fellow men, he acquired some of this world's goods and the respect of all with whom he dealt.

Despite his 78 years he was still farming for "pleasure and pastime" as he would laughingly say to those who suggested that he was too old to work so hard. He had worked very hard all day Wednesday and was very tired when retired to take his hard-earned and much-needed rest. Some time during the night a thief entered his home, robbed him and then murdered him and left on clue as to his identity.

The entire community was shocked by the outrageous crime.

FUNERAL OF B. F. MITCHELL

Funeral services for B. F. Mitchell, who was murdered at his home near Amagon Wednesday night by unknown parties, was held this afternoon at 3:30 o'clock at Centerville and arrangements for the funeral were made by Hafner-Patterson Company.

Mr. Mitchell is survived by a daughter, Mrs. Lillian Priest of Amagon, and by four sons, Rev Herbert Mitchell of St. Louis, John, Albert and Ben Mitchell of Jackson county.

Interment was made in the Centerville cemetery.

The article has been "bound" in a journal at the Commission, and it partially hides a few of the words on the left of each line down the column, but enough of the words showed that I believe I have properly guessed them. For the paragraph at the end of the article, it was only half a column that was not copied and is not available on the microfilm.

"THREE ARRESTED IN MITCHELL MURDER CASE:

With the arrest of three men this week, Jackson county officers believe they are about to solve the mysterious murder of B. F. Mitchell, a recluse, who was killed in his home near Amagon on May 24th.

Paul Nelson of Harrisburg was arrested at that place Saturday on a minor charge on which he was fined ten dollars. Officers later made a search of his car and found several guns and $593 in his pocket. Sheriff Gray Albright went to Harrisburg and took the young man to Little Rock for questioning in an effort to link him with the murder of Mr. Mitchell.

Alvis Jackson, aged 40, and Joe Priest were arrested Tuesday and held in the county jail at Newport in connection with the killing. Jackson is a tenant on the Mitchell farm while Priest is a son-in-law of Mitchell. It is thought that the arrest of the pair resulted from the questioning of Nelson at Little Rock.

The Alvis Jackson arrested is not the Alvis Jackson who is a candidate for treasurer of Jackson County. The candidate's name is Alvis ? Jackson and he is not related to the Alvis Jackson arrested.

Nelson said the money found on him when arrested represented his earnings while in the army. He was discharged.....year enlist.....???? Mitchell....??? daughter, ??

SLAYER FAILS TO RECOVER PART OF LOOT.

Paul Nelson, 24, alleged self-confessed slayer of B. F. Mitchell, recluse living 15 miles east of Newport in Jackson county, near the Poinsett county line, lost in an attempt Friday to recover part of the $593.00 loot taken from him following his arrest in Harrisburg in a suit tried in chancery court before Chancellor J. F Gautney of Jonesboro at Harrisburg Friday.

Nelson was arrested at Harrisburg following finding a large quantity of shells and two shot guns and pistol in a car in which Nelson and two others were riding on August 20.

Mitchell was killed in May, robbery being the motive. Nelson admitted taking $800. Nelson was a neighbor of Mitchell.

Nelson claimed that all of the money he had in his possession at the time of his arrest besides $180 was his own money and sought to recover the remaining amount.

Judge Gautney held that by Nelson's own admission that he stole around $800 and even though he may have spent or disposed of this money, that the state had the power to recover the amount taken from the deceased and awarded the full amount held by the sheriff of Poinsett county to Mitchell's estate.

Judge F. M. Pickens represented the Mitchell estate and Sheriff Gray Albright at the Harrisburg hearing.

CRINT NELSON IN CUSTODY OF GA. OFFICERS

Sheriff Gray Albright has been advised by officers at Hiawassee, Ga., that they have taken into custody Crint Nelson, alias Crint Crotham, wanted the in the murder of B. F. Mitchell, aged farmer, recluse of Amagon, who was murdered in his home last May 31. Crint Nelson has been at liberty since his younger brother Paul, Joe Priest and Alvis Jackson, alias Henry Jackson, were taken into custody and placed in jail, charged with the murder of Mitchell. Crint Nelson was indicted with the trio when the grand jury met last September and a continued search has been made for him since that time. He is being held in jail at Haysville, N. C., a few miles from Hiawassee.

Nelson has refused to return to Jackson county voluntarily to answer the charge for which he is indicted and Sheriff Albright has asked Governor Futrell to issue requisition papers asking the governor of Georgia to order Nelson's return to Newport.

Paul Nelson was sentenced on Nov. 21 to die in the electric chair on Jan. 25, 1935, for the murder of Mitchell. Jo Priest is out of jail on bond pending trial and Jackson is being held until his case is called in the next session of circuit court.

CRINT NELSON IS RETURNED HERE BY SHERIFF ALBRIGHT

From Friday's Daily.

Sheriff Gray Albright returned last night from Raleigh, N. C. where he presented requisition papers to the governor of that state for the removal to Arkansas of Crint Nelson, who was arrested in Hiawassee, Ga., about two weeks ago and placed in the Waynesboro, N. C., jail.

Nelson is under indictment here for the murder of B. F. Mitchell, who was killed in a brutal manner at his home near Amagon on May 27. (note- previous articles state May 24). Paul Nelson, brother of Crint, was convicted of first degree murder here last month and has been sentenced to be electrocuted for his part in the Mitchell slaying. Crint Nelson is being held in the city jail temporarily.

(By United Press) Tucker Prison Farm., Ark., Sept. 28.

Two white youths, just past the age of maturity, paid with their lives today for brutal slayings in which both allegedly "ganged" with others to rob their victims.

The two youths, Paul Nelson, 22, and Bill Barnes, 21, were electrocuted in the drab, but deadly, home-made electric chair which has claimed nearly 80 victims, shortly after dawn today.

Nelson, first to be strapped in the chair, protested his innocence to the last, in broken spirits, he prayed with two ministers shortly before he was placed in the chair at 6:33 A.M.

He was pronounced dead at 6:39 a. m.

Barnes, cool and calm, was strapped into the chair at 6:53 protesting he had not been given a fair trial. He was pronounced dead at 6:59 A.M.

Nelson, a married man, was charged as the principal in the slaying of B. F. Mitchell, 78-year-old farmer, as he was sleeping alone in his home near Amagon, Ark., on the night of May 28, 1934. (NOTE: again a different date...kmp)

Barnes, whose father, Frank Barnes was electrocuted for the same crime, was charged with aiding his father and brother, Archie, in the slaying of C. A. Martin, Jr., 18-year-old Blytheville taxi driver, on a lonely country road July 12, 1934.

"I am innocent," Nelson pleaded, as he prayed with the Rev. C. W. Holmes, Pine Bluff, and the Rev. R. R. Simpson. "God, I hope you will welcome me into heaven."

"Please have pity on those who put me here. Bless my wife and sisters. I am coming to you in the right spirit. Please make this an easy death," Nelson prayed.

Turning to Prison Supt., Tom Coghill, he said, "Captain, you are a good man, I hope we meet again."

Coghill had a little trouble in adjusting the head cap on Nelson.

The two ministers also prayed with Barnes.

"I did not get a fair trial," the youth protested. "The judge said if I plead guilty, I would not get over 21 years. God bless all of you officials," he said.

The Rev. Holmes made a last dispute plea to Governor J. M. Futrell in behalf of Barnes in a telephone call at 5:30 a. m. He ...ed the governor either to alter ..... time or ....... the (next line missing).

Paul Nelson, aged 21 was sentenced to die in the electric chair at Tucker Farm, between the hours of sunrise and sunset January 25, 1935. Judge B. Marcus Bone overruled a motion of the defense for a new trial as also the motion to arrest judgment. Appeal bond was denied.

Nelson was convicted in circuit court here November 7, on a charge of first degree murder in connection with the death of B. F. Mitchell, 78, farmer-recluse of near Amagon, who was found beaten to death in his bed the morning of May 27.

Nelson was later arrested on a minor charge at Harrisburg and when officers there found a sum of money on his person and several fire arms in his car, they became suspicious and notified Sheriff A. G. Albright of Jackson county. Albright brought Nelson to Newport and later took him to Little Rock, where he was questioned by Sheriff Albright and Chief of Detectives James Pitcock. Nelson is reported to have made a statement in which he allegedly admitted taking part in the crime and named as his accomplice Joe Priest, son-in-law of the slain man. Henry Jackson, alias Alvis Jackson, a share-cropper on the Mitchell farm, and his brother, Trent Nelson.

Judge Bone withdrew the purported statement from consideration by the jury at the trial. However, Nelson made a similar statement to the one made in Little Rock to Mrs. Joe Priest, daughter of the victim, shortly after his return from Little Rock, which was allowed to be introduced as evidence.

The jury deliberated a short time over two hours, and returned a verdict finding the defendant guilty as charged in the indictment, a verdict that automatically carries the death penalty in first degree murder cases.

Nelson is the first person to receive the death penalty in this county in over 17 years, according to court attaches. It is also the first time that any person has been sentenced to death from this judicial district under the administration of Judge Bone or Prosecuting Attorney Roy Richardson.

Joe Priest, son-in-law of Mitchell, was allowed $1000.00 bond on motion of his attorney.

Andy Thorp, farmer, who has been held in the county jail here charged with being an accessory both before and after the fact to the alleged murder of Mrs. Buford Nelson, 21-year-old Pope county school teacher, who was drowned in White River a short distance from Olyphant near the Thorp home, during October, was allowed a $1000.00 bond on motion of his attorney.

Circuit court was adjourned.

Little is known about Great-grandmother Rebecca Paralee Clark Mitchell. From the small bits I have heard, she was a hard working woman and tried to raise her children in her Christian faith with like values. Like so many women from her era, having as many children as she did took its toll on her health and she died when her youngest surviving child was six years old. Rebecca had eleven living children at the time she died. Two of her children had died in infancy. The total number of children born to Rebecca and B. F. was thirteen.

Most often called Paralee, she was born on a Thursday in the state of Tennessee.

In the 1920 Federal Census, Arkansas, Jackson Co., Byrd Twp, West Div., Roll T625_66, Image 682, Lillian is living with brother Oscar. She is 31 years of age and no employment is listed. She probably kept house for Oscar who was a carpenter.

Lillian was the one to discover her father's body on 24 May 1934. She lived "across" the road from her father's farm. It was her habit to look across and observe her father about his property. On the morning mentioned, Lillian had not seen her father all morning so went to check on him. It was then she made her gruesome discovery.

We can try to imagine her horror to learn that her husband Joe was implicated in the murder. Those of our generation have no journals, letters, etc., to know the details other than the facts that Lillian did divorce Joe and remarry. It was said that Joe did not serve time in prison, but no one knows exactly what did become of the charges against him, and there have been no records found about him other than the one newspaper article saying he was involved.

Notes for JOE A. PRIEST:

Joe Priest was one of the ones indicted in the murder of his father-in-law, B. F. Mitchell (Benjamin Franklin Mitchell) in 1934. In one of the newspaper clippings covering the arrest of another suspect, it was stated that Joe Priest, son-in-law to the murder victim was out on $1000.00 bond from the motion of his attorney. Nothing more was heard from or about Joe Priest, and it is unknown as to the outcome of Joe Priest's trials. Lillian divorced Joe and later remarried.

OSCAR MITCHELL KILLED IN AUTO ACCIDENT.

Oscar Mitchell, aged 37, of Amagon was fatally injured Sunday night about eight o'clock at Newport when struck by a Central Transportation bus driven by Clarence Williams.

The Mitchell car was crosswise the highway following an accident with another car and it was said that Mitchell walked around his car into the path of the bus as it was passing. the driver of the bus said that he did not see the car crosswise the road in time to stop and when Mitchell stepped from behind the car in front of the bus he drove into the ditch in an effort to avoid hitting him. The front wheels of the bus passed over his chest and he died shortly after being taken to the Newport sanitarium.

Williams and a passenger, Elmer Rutledge, who was riding on the driver's seat with Williams, were arrested. A coroner's jury Monday afternoon released Williams, the verdict being that "Oscar Mitchell came to his death on the 26th day of April, 1931, by being run over by the Central Arkansas bus driven by Clarence Williams, accident unavoidable." Williams was re-arrested Tuesday on a warrant sworn to by Prosecuting Attorney Sam Bains charging voluntary manslaughter. Williams waived examination in the justice court of Geo. L. Robinson and his bond was fixed at $1000. Rutledge was fined in mayor's court on a charge of being drunk.

Other occupants of the Mitchell car were Myrtle Green and Elsie Barham, Newport girls and an unidentified man. Elsie Barham was fined $10 and the costs following the accident on a charge of being drunk. The other woman was released.

Mr. Mitchell was unmarried and well known here, having spent a large part of his life near Tuckerman. He made his home with his sister, Mrs. Lillian Priest at Amagon.

He is survived by his father, B. M. (Note: this should be B. F.) Mitchell, of Amagon; four brothers, Herbert of Jonesboro, Benjamin of McCrory, Albert and John of Amagon, and one sister, Mrs. Lillian Priest of Amagon.

Funeral services were conducted Tuesday afternoon by Rev. T. C. Hart, pastor of the Baptist church of Tuckerman. Burial was in the family cemetery near Kenyon. Members of the American Legion served as pallbearers. (US Navy marker)

The copy of the clipping does not have a date or name the newspaper. However, researcher and cousin James Tims found most obituaries in archives at the library in Jackson Co., Arkansas, for the now defunct "Tuckerman Record," of Tuckerman, Jackson Co., Arkansas.

CHARLES J. MITCHELL DEAD.

1919

Charles J. Mitchell, who was injured in an automobile wreck at Tuckerman Wednesday, died at St. Vincent's Infirmary at one o'clock Friday. The body was taken to Tuckerman on No. 34 this morning, where burial will take place Sunday morning. It will be remembered that in attempting to cross the railroad in a car at Tuckerman, ahead of a passenger train, the deceased was struck by the oncoming train, which resulted in his death.

Mr. Mitchell is survived by his wife, four daughters; his father, B. F. Mitchell; five brothers, Oscar and Albert H. of Tuckerman, Herbert of Jonesboro, Ben of Pennington and John, who is in the U. S. Navy aboard the U.S.S. Imperator, also by two sisters, Lillian and Daisy of Tuckerman. The body was sent to Tuckerman by P. H. Ruebel & Co., for interment.

Other clues show Ben's name as Benjamin M. Mitchell, to include two census images.

From the obituary below, given the dates, we are left with a bit of a puzzle.

Daughter Mary is not listed on the 1930 census. Yet by the 1930 census, Ben is listed as a widow, and the children in the household are one son, and two daughters; son Aubrey, daughters Mabel and Bertha.

Just when was Mary born? Was she a newborn and therefore not enumerated because she was being cared for somewhere else?

Another point; The son, Aubrey, is not listed as a surviving child in the obituary. We can probably assume Aubrey pre-deceased his father, but that would have to be proven.

BEN O. MITCHELL

Ben O. Mitchell, aged 60, died at a Little Rock hospital Sunday morning. He is survived by three brothers. John Mitchell of Memphis, Albert Mitchell of Newport, and Herbert Mitchell of Little Rock, and three daughters, Mabel, Mary, and Bertha Mitchell.

Funeral services were held at Newport Monday. Burial was in the Balch cemetery.

Arrangements were in charge of the Newport Funeral Home.

I received a photocopy of this news clipping, but it had no date. Since that time, I have found an online transcription of abstractions for deaths from "Tuckerman Record." it lists that Ben O. Mltchell's was printed 21 July 1944. This data agrees with the information provided to me by Elsie Hinchcliff Mitchell, his sister-in-law and wife of Herbert Mitchell....KMP

JOHN MITCHELL

John Mitchell, aged 63, owner and operator of the Mitchell Tourist Court at Newport, died in a Newport hospital at noon Friday. He was a veteran of World War I and was a member of the American Legion, the Tuckerman Masonic Lodge, and the Baptist Church. He had been in poor health the past few years.

A native of Charlotte, Independence County, he attended public school at Cave City and State Teacher's College, Conway. For a number of years he taught school in Independence and Jackson counties and was also a singing school conductor.

He operated his farm and mercantile business at Kenyon until 1942 when he moved to Memphis, where he served as probation officer in the Memphis Juvenile Court. He sold his farm and mercantile business in 1952 and moved to Newport and purchased the tourist court which he operated until his death.

Survivors include his wife, Bertie Mitchell; a son, Dr. Hays Mitchell of Memphis; one daughter, Mrs. Kenneth Cole, of Memphis; one brother, Albert Mitchell of Balch; and three grandchildren.

Funeral services were held at the First Baptist Church of Newport by the pastor, the Rev. C. F. Wilkins, Sunday afternoon, May 15, at 2 o'clock, with Kirkpatrick Lodge No. 192 F& AM, of Tuckerman in charge of the grave side services. Burial was in Dowell's Chapel Cemetery at Kenyon by Jackson's Newport Funeral Home.

Pallbearers were Joe Dean, Dolph Doss, Angus McDaniel, Joseph Williams, Noble Jarvis and Gene Jarvis.



Note: John served in U. S. Navy aboard the U.S.S. Imperator in W WI. This "Classic" Liner was one of three that were Hamburg-America's version of the White Star Line's Olympic class liners. It had an interesting history, and Uncle John served on this historical liner. It was manned with US Navy troops from May of 1919 until August 1920.

ALBERT MITCHELL ANNOUNCES FOR TAX ASSESSOR.

Albert Mitchell of the Balch Community has authorized the Record to make formal announcement of his candidacy for the office of Tax Assessor of Jackson County, subject to the will of the voters in the Democratic Primary Election August 14.

Mr. Mitchell was born in Independence County and came with his parents to Jackson County when a small child and attended his first school in this county. He has spent all of his life in this county with the exception of the time he served in the U.S. Navy during World War I. He is a member of the Baptist Church where he teaches a Bible class and is song director. He is a member of the American Legion of which he has served as vice commander. Mr. Mitchell received his education in Jackson County schools and business training at Springfield, Missouri. Business College. Herbert Mitchell was an evangelical minister until a stroke forced him to settle in one place. He bought a house in Little Rock, Arkansas, for him and his wife, Elsie Marie Hinchcliff Mitchell, in 1946.

One of my very few memories of Grandfather Mitchell was at the age of three, sitting on one knee while a cousin sat on the other. We were both announcing to the other that "He is my grandpa." which provoked a response from the other..."No, he is my grandpa!" He was reassuring each of us that he was grandfather to both of us. Grandfather died the following winter.

Notes for ELSIE MARIE HINCHCLIFF:

Grandmother, Elsie Marie Hinchcliff Mitchell outlived her husband, both her children, and all of her siblings. Her twin sister, Eltha, died in 1925.

Elsie remained at 1020 Adams, Little Rock, Arkansas, after Herbert's death of a massive stroke in 1947. It was at this home that Elsie raised a granddaughter who lost both parents, nursed her own mother in her final year, nursed a brother who was fighting cancer, and even babysat for her great-grandchildren.

Grandmother and I kept in touch mostly by letters while I followed my military husband in his career.

She stayed in her own home until her health forced her to live with her sister Bessie "Irene" Hinchcliff Childress in Jonesboro, Arkansas, and ultimately in a nursing home in Little Rock, Arkansas, where she lived at the time of her death.

Grandmother Mitchell was the personification of resilience and tenacity. In the years since her death, I have come to view her as a person of strength - a survivor.

TALMADGE JUDSON TIMS

Talmadge Judson Tims, age 77, of Augusta died April 11, 1996 at his home. Mr. Tims was a WWII Army Veteran. He was a member of the First Baptist Church of Augusta.

He is survived by his wife, Hazel Tims; four sons, A.J.Tims of Gregory, Larry Tims of Newport, Eddie Tims of Newport, James Tims of Lockburg; three daughters, Jean Beshirs of Jonesboro, Gail Smith and Tamma Smith of Augusta; one sister, Daisy Ormsby of Tuckerman, twenty-two grandchildren and twenty-five great-grandchildren.
