1, 1862. Major Higgins served in all the important operations of the
Regiment, and was one of the most popular officers in the command.
Jovial and good-natured, yet justly strict when necessary, he possessed
the confidence, good-will and esteem of the men in no ordinary degree.
He was mustered out with the Regiment.

Tennessee. To Captain James B. Fry. Assistant Adjutant General, Department of the Ohio. Letter tendering the
unconditional and immediate resignation of his commission as Captain in the 24th Regiment, Ohio
Volunteer Infantry; and stating that he was requesting a discharge from the service because his honor and
military character had been assailed by promoting an officer of lower rank to a position in the field of
the regiment, because the circumstances of his family absolutely required his presence at home, his children
being left without protection, and because his system was so bilious that he was assured the climate of the
coming Spring would wholly unfit him for duty.

-COLONEL DAVID J. HIGGINS-
David Jordan Higgins was born September 18, 1817, at Otisfield, Oxford County, Maine. He married his first
wife, Cynthia L. Weeks, at Dover, Maine, on December 20, 1843. David and Cynthia raised three children,
Wilbur F. Higgins (born January 12, 1843 and died at Leavenworth, Kansas, March 10, 1881),
Emma Jane
Higgins (Spencer) (born January 12, 1845 or [January 16, 1846 as reported July 4, 1898]), and
Ella F.
Higgins Clark (born October 2, 1851 [or June, 1851, as reported July 4, 1898]).
Although forty-three years old, David J. Higgins enlisted for three years service at New Salem,
Columbiana County, Ohio, on May 6, 1861. He was mustered in as the Captain of Company C, 24th Ohio
Volunteer Infantry Regiment on June 3, 1861, at Camp Chase, Columbus, Ohio. He was 6 feet tall, with a
light complexion, blue eyes, and dark hair.
At the Battle of Cheat Mountain, (West) Virginia, on September 13, 1861, Captain Higgins demonstrated some
tactical ability. At the head of a reinforced company of soldiers, he emerged from Cheat Mountain Fort,
attacked and drove off part of a Confederate Brigade assigned to take and hold the road from Cheat Mountain
Summit to Cheat Mountain Pass, (West) Virginia.
Higgins' age began to catch up with him after the 24th O.V.I.'s transfer to Middle Tennessee. First,
rheumatism struck him hard in the Spring of 1862, near Nashville. An undated medical record noted that
Captain Higgins was suffering from sub-acute Rheumatism of two months standing. In September, 1862,
Higgins contracted a disease of the liver and chronic Nephritis, in consequence
of which he was granted leave from active field duty in the Army of the Ohio's
Special Order Number 159, dated September 30, 1862. His new assignment detailed him to lighter duty as
commander of Park Hospital Barracks, Louisville, Kentucky.
After the death of the 24th O.V.I.'s senior officers during the Battle of Stones River, Higgins was
promoted to colonel and recalled from Louisville to command the 24th Ohio Infantry Regiment on January 14,
1863. The brigade commander, Colonel William Grose, discovered that Higgins was still physically unfit for
active field duty, so Grose obtained light duty for Higgins. The Department of the Cumberland's
Special Order Number 137, dated May 20, 1863, reassigned Higgins as commander of the Convalescent Camp at
Murfreesboro, Tennessee. A second medical certificate, filed June 2, 1863, diagnosed Colonel Higgins to be
suffering from sub-acute Lumbar Myelitis, and the medical officer
opioned that Higgins was unfit for duty.
Still, with the shortage of experienced field officers during the Chickamauga Campaign, Higgins was recalled
yet again. In September, he was again in command of the 24th O.V.I. as it marched over Lookout Mountain
into Georgia. At the Battle of Chickamauga, his rheumatism again acted up to the point where he could
barely move. Consequently, he turned over command of his regiment to Major Thomas McClure on the morning of
September 20, 1863. When the 24th Ohio broke apart during the Army of the Cumberland's withdrawal from
the battlefield on the evening of September 20, 1863, an enraged Colonel Grose confronted the problem at the
brigade's campsite near Chattanooga. Grose obtained permission to dismiss Major McClure and Colonel
Higgins for cowardice.
When he received this notification of his dismissal, Higgins asked each of his company commanders if they
thought he was a coward. Every officer agreed that he was not a coward, but was physically unfit for service
due to his rheumatism. A military court of inquiry accepted the regimental officer's signed statement
that Higgins' maladies were the real reasons why he had turned over his command to McClure, and the
military court reversed the act of dismissal for cowardice. However, Higgins could only find one
honorable way out of the service, and he resigned his commission due to disability on October 23, 1863.
Although Colonel Grose did not agree with the court's findings, he hastily endorsed Higgins' resignation.
The resignation was accepted under Department of the Cumberland Special Order Number 283, dated October 23,
1863. Higgins immediately made his way home.
Returning to his Columbiana County, Ohio, home following his resignation in early November, 1863,
Higgins found that the newspapers had already reported his dismissal due to cowardice. With his reputation
suffering in the community due to the uncorrected newspaper reports, David J. Higgins and his family
decided to move to Minnesota. They arrived at Brooklyn Center, Hennepin County, Minnesota, on or about
November 20, 1863. There, David J. Higgins got a new start, and he took up his former profession as
minister of the gospel.
His wife, Cynthia Weeks Higgins, died on July 12, 1876 [or June 1877, according to another affidavit July 7,
1898], at Atwater, Kandiyohi County, Minnesota. Higgins, now a widower, himself married a minister's
widow, Esther Anne (Doughty) Havens, on December 25, 1877 (or November 23, 1878 as stated in July 4, 1898)
at Menomonie, Dunn County, Wisconsin. Reverend Edward Doughty performed the ceremony.
Now, nearly seventy-five years old, David J. Higgins applied for, and received a pension August 7, 1890 at
Brooklyn Center, Hennepin County, Minnesota. His rank was only listed as that of a captain due to his
resignation. Higgins moved to Minneapolis, Minnesota, by July, 1898, and took up residence at 2935 Aldrich
Avenue.
Esther, his second wife, died at Chattanooga, Tennessee, on August 10, 1902. Shortly, thereafter,
David Higgins moved to 915 Maple Street, Pasadena, California. By March 18, 1915, he was again working on
the pension bureau's records.
David J. Higgins died February 2, 1917, at Pasadena, California, and is interred at Mountain View Cemetery,
Altadena, Los Angeles County, California.

Company D, 191st
Regiment Ohio Volunteer Infantry.
This company was organized in February, 1865, to serve one year. The
regiment left Columbus, Ohio on the day of its organization, under
orders to proceed to Winchester, Va., and report to Major-General
Hancock. The regiment was assigned to the Second Brigade. Second
Division, Army of the Shenandoah. Its only duty was garrison duty in the
valley, marching as far south as Winchester, where it remained until
August 27. 1865, when it was mustered out in accordance with orders from
the War Department The following are the casualties: George E. Anderson,
died March 13, 1865, at Columbus, Ohio; Francis Higgins, died
April 4, 1865, at Cumberland, Md.; William L. Higgins, died March
22, 1865, at Harper's Ferry, W. Va.; Jesse W. Monroe, died February 18,
1863, at Camp Chase, Ohio; Marion M. Patton, died April 3, 1865, at
Harper's Ferry, W. Va.; William Thoroman, died April 6, 1865, at
Harper's Ferry, W. Va.

George Washington Higgins
George Washington Higgins was born in Port William, Clinton County, Ohio on August 6,1834 and
died September 27,1915 in Villisca, Iowa. His parents were William and
Elizabeth Moorman Higgins. At the age
of 12 years he was left an orphan and lived with his grandmother Catherine Moorman until his marriage.
On September 2,1858 he was married to Harriet Helen Powers, the daughter of
William Powers and Mary Emily
Higgins. They were second cousins. To this union were born nine children, seven sons and two daughters. They
were Thomas William, Lewis Henry who married Martha Lodema Willett,
Asa Benson who married Elizabell
Mackey, Charles Alexander who married Mary Nancy Beery,
George Harvey, Lilly Belle who married George
Neely, James Oscar who married Ella Gerhart, Edwin Sherman and
Mabel Clare who married Joseph Elvin
Beavers.
In 1861, while living in Adams County, Ohio, Mr. Higgins enlisted as a soldier in the Civil War and
served three years and five months in company D, 11th Ohio Cavalry under Colonel Collins and Captain Van
Winkle. He served with the soldiers who built Fort Collins, Colorado. At the close of war he moved with
his family, in 1872, to North Henderson, Mercer County, Illinois. In the fall of 1880 they moved to
Villisca, Montgomery County, Iowa.

HIGGINS & CO., marble works, Bloomington. It is often
supposed that good work in the marble and monument business cannot
be obtained anywhere except in a few of our larger cities This is a
mistake, as is evinced by the superior talent exhibited and work
produced by Messrs. Higgins & Co., since their establishment in
Bloomington ; these gentlemen commenced business in 1876, and have
turned out some of the finest work in Bloomington ; they are now
furnishing one of the finest monuments for the Bloomington Cemetery;
its weight will be thirteen tons, and this will be the finest piece
of work in the cemetery; this firm employs more hands than any other
establishment of its kind in Bloomington; the firm is Mr. J. P.
Jung, a native of Illinois, who came to Bloomington in 1869. and
has had many years' experience in the marble business and Mr. H.
J. Higgins, a native of Ohio, who enlisted in the late war in
Co. D. 59th Ohio V. I.. and participated in the battles of Stone
River, Mission Ridge. Perryville. Chickasaw Mountain, Lookout
Mountain. Dallas, Kennesaw Mountain, Atlanta, etc.: with the
exception of three months' sickness, Mr. Higgins was always at his
post; after being mustered out as Sergeant, he reenlisted, in 1865,
in Co. E, 192d Ohio V. I., as 1st Lieutenant; here he was detailed
as Provost Marshal: also Judge Advocate Court Martial two months ;
after the close of the war, he returned to Ohio. In 1868, he came to
Illinois, where he has been engaged in the marble business ever
since. All persons dealing with them may be assured of the most
honorable treatment and the most skillful workmanship.

Angeline Higgins (nee lattin) applied for a widows pension on July 8,
1865. Jehiel (Hiel) Higgins and Angeline Lattin were married March 7,
1858 at Trumbull County, Ohio, by Lucius Ball, Justice of the Peace.
Jehiel Higgins was a Private in Company "C" 125th Ohio Infantry. Jehiel
Higgins enrolled for service on December 5, 1863 at Greene County, Ohio.
He was mustered in for 3 years service on December 16, 1863. He was
killed in the battle of Franklin Tennessee on November 30, 1864. After
action report notes he was shot in the head with a musket ball and died
instantly. No further record this source.

Sarah Ann Higgins, (nee Randels) a resident of Millville, Butler County,
Ohio, widow of James W. Higgins, who was a Private in Company "D" 35th
Ohio Infantry filed for a pension on May 8, 1865. James had enrolled for
duty at Hamilton, Ohio on August 9, 1861. He had enlisted August 20,
1861 originally in Company "B" 35th Ohio Infantry. He later transferred
to Company "D" on September 10, 1861. He was taken prisoner at
Chickamauga on September 19, 1863 and died at the prison at
Andersonville, Georgia on August 19, 1864 of Chronic Diarrhea. She
states in her application that she and James were married May 2, 1857 by
James Hill, Justice of the Peace. No children were born in this
marriage. Sarah Higgins died March 14, 1886.

Mary Higgins was a resident of Union, Logan County, Ohio at the
time of applying for her pension. She states she was born in Union
Township, in Logan County, Ohio May 30,1835. She died January 21,1917.
She applied for the pension on March 14,1863, she was then 28 years old.
Her husband James M. Higgins died at Jefferson Barracks Hospital,
Missouri on February 15 1863 of Chronic Diarrhea. She states in her
application that she and James were married March 17,1858 in Logan
County, Ohio. She and James had a son named John L. Higgins, who
was born December 10,1861.

Mr. Geddes, from the Committee on War Claims, submitted the following
REPORT:
[To accompany bill H.
R. 3411.]
The Committee on War Claims, to whom has referred the bill (H. R. 3411)
for the relief of John M. Higgins, report as follows:
That the bill authorizes and directs the accounting officers of the
Treasury Department to audit and pay to John M. Higgins, late a
lieutenant of Company A, Thirty-third Regiment of Ohio Volunteer
Infantry, his accounts against the government the same as if he had
never been court-martialed and dismissed the service, but had been
honorably discharged there from.
It appears from the proof submitted that this officer was mustered into
service as second lieutenant, Company A, Thirty-third Ohio Volunteers,
August 27, 1861, and is reported promoted to first lieutenant, same
company and regiment. May 9,1862; that he was tried by general court
martial and sentenced to be dismissed the service for absence without
leave, with loss of all pay and allowances, which sentence was
promulgated in General Orders No. 86, April 20, 1862, Department of the
Cumberland; that application was made to the War Department in 1871 for
such relief as could be granted in the case, and, thereupon, By
direction of the President, the disability resulting from the dismissal
was removed January 26, 1871.
The removal of the disability consequent upon the sentence did not
operate to restore to Lieutenant Higgins the pay forfeited by the
dismissal, but simply declared him qualified to re-enter the service in
the future.
It is submitted that the nature of the offense and the severity of the
sentence are such as appeal, certainly after this lapse of time, to the
sense of justice in any impartial tribunal.
Your committee, therefore, in view of the foregoing statement of facts,
report in favor of the passage of the bill.
