Bartow County

Personally appeared, Patsy McCoy, who is a citizen of this county, well known to me to be reliable and of good repute, who being sworn on Oath says, I am about 80?  81? years old and have resided in this county over 50 years and was well acquainted with a woman in this family who lived, a long number of years near Allatoona, her name was Massie?  Massis? Overby and she was an Indian of at least half blood and was always acknowledged and recognized as a Cherokee.  She was the mother of one Wesley F. York and he was always recognized as her son.  She afterwards married Billy Goddard and continued to reside in this county until a few years ago when she went west and died.  I knew in person Wesley F. York and his family. I knew Nancy Perkins, John J. York, Eliza Dyar, Nettie Pence?, Jno?/Ino? maybe John Donald York, and Isaac York were all his children, were raised by him and derived their Cherokee Indian blood from him and his mother Massie/Massis Overby entitling them to citizenship in the Cherokee Nations.  Massey Overby’s name should appear on the census rolls taken and made of Cherokees East of the Mississippi River in 1835? and on rolls of 1851-52.

(Note:  One name is not clear at all.  It was Nettie or Hattie and Pence, I think; but the writing is very unclear.)

(Note:  There are many Indian names that could be Massey in a different form on the census rolls.  As to whether or not these people ever sent more information or tried again, I do not know.  If you would like to have the original application, it can be ordered from NARA.  It costs ten dollars, and you might be able to decipher more of the letters than I did, or you might receive some different copies.  NARA in Houston has these records.  I would be interested in corresponding with others who are working on this line.)

I Wesley York of said county and county do make this my last will and testament hereby revoking all others by me; heretofore made being now in sound mind I will my soul to God who gave it.  I will and bequeath and convey all  rights and titles in claims to Isaac M York,  twenty two acres of land including dwelling house that I now live in being one half of divided lot No. 1020,  being twenty first district second section of Bartow County with all the right numbers and apportions to said parcel of land in any wise belongings forever  in fee simple also the lot of land No.998,  being in twenty first district and second section said county be sold and my just debts and home debts be paid in full.  The remainder to be divided between my beloved children, Nancy E Perkins, John J York, Eliza J Dyer, Hettie H Pence, Wesley M York, said Isaac M York, receive any part of said last acre of land. I do also will that Isaac M York do take his mother Becky York and support and keep her so long as she lives and pay all expenses that may occur by sickness and also  in burial expenses after death in which he, Isaac M York shall receive the aforesaid compensation. Also I  since leave all stock, household and kitchen, furniture, farming and all other implements as they are for the use of making support of my beloved wife, Becky York so long as she lives.  At her death to be sold and equally divided between all the children before named.  Isaac M York getting his proportional part when sold and divided.

Acworth, Cobb County, Georgia Attorney for Petitioner

Gentlemen:  The undersigned your petitioner, Nancy Y. Perkins for and on behalf of herself and heirs, this day makes this application to you for the purpose of being placed on the revised roll of Cherokee Indians and of those entitled to share in the distribution of funds and allotments of land in Cherokee Nation, by virtue of their Cherokee blood, and I herewith submit the following facts.  I am the daughter of one Cherokee Indian woman of about one half blood who resided in this county when the Cherokees were removed to the Indian Territory about the year 1835-38.   Her name should appear on the Cherokee Census Rolls of 1835 & 1851& 1852.  (See affidavit attached.)  In support of said claim, and respectfully await the time when my application shall be heard and tried.

In the matter of Nancy Y. Perkins, et. al. Nation’s No. 873 for citizenship in the Cherokee Nation.

Your respondent, S. H. Mayes, Principal Chief of the Cherokee Nation, comes now and demurs the said application, and for the grounds thereof says:

   1st That this Commission has not jurisdiction over the parties or subject matter of this controversy, and no legal right, therefore to hear and determine the matter.

   2nd that the application does not state facts sufficient if true, to show that applicants are entitled to citizenship.

Respondent not waiving his aforesaid demurrer, but insisting upon the??? for answer to aid application, says that Macy Overby through whom the petitioners claim to derive their right to citizenship in the Cherokee Nation since the removal of said Nation, went to the Indian territory as at present located and ???

and her name does not appear on any of the authenticated rolls of said Nation: that neither her nor any of her ancestors now reside or ever have resided in the Cherokee Nation and Indian Territory as citizens thereof. Having fully answered, your respondent asks to be hence dismissed.

Isaac brought his family to Floyd County, Georgia and they spent their first night camped in a field off (what is now the intersection of the Cunningham Road and Cave Springs Road.) They came in a covered wagon. Isaac moved this way to get work at the Rock Run Works. He worked there for sometime before he became a farmer. His last home was a farm and house off the Cunningham Road.

Gentlemen:  The undersigned, your petitioner, for and on behalf of herself and heirs make this application to you for the purpose of being placed on revised roll of Cherokee Indians and of those entitled to share in the distribution of funds and allotments of land in Cherokee Nation, by virtue of their Cherokee blood, and I herewith submit the following facts,    I am the daughter of Nancy Y.  Perkins, who was a Nancy York and she was the daughter of one Wesley York who was the son of one Indian woman who was one half breed Cherokee and Named Massie?  Massis? Overby. She lived in Bartow County, near Allatoona, a long number of years before the Indians were removed to the Territory, and her name should be found on Census rolls of 1835 and others.   (See affidavits attached.)

In support of said claim, and respectfully await the time when her application shall be heard and tried.

Survivors include five daughters, Georgia Martin and husband Ben of Garland, Nina Rhoades, Betty Hutchings and husband Mac, Elizabeth Basham and husband Billy, Mary Walker and husband James, all of Paris; seven grandchildren, Mia Lollar, Paul Fields, Jacquelyn Dulaney, Harold Martin, Brent Basham, Christi Alsup, Jennifer Walker and seven great-grandchildren. She was preceded in death by her husband, Harold, a daughter, Paula Fields and a brother and sister. Pallbearers will be Harold Martin, Paul Fields, Brent Basham, Justin Lollar, Terry Lollar, Terry Dulaney and Ben Alsup. Mrs. Mary Coalson, age 84, of Dayton Ohio, formerly of Rockmart, died Sunday, June 7, 1998 in Dayton. Mrs. Coalson was born October 28, 1913 in Polk County. She was a retired Sears Roebuck, and Co. employee as well as a member of the Order of the Eastern Star and former member of Tucker Baptist church. She was preceded in death by her husband, Herbert Ray Coalson. Survivors include two sons, Michael Coalson of Beavercreek, Ohio and Timothy Coalson of Albuquerque, New Mexico; a brother, Lloyd York of Dallas, Ga.; a sister Virginia Osborne of Smyrna; three grandchildren; and two great grandchildren. Funeral services were held Friday, June 12, at 11 a.m. from Rose Hill Cemetery with the Rev. David Taylor officiating. Freeman Harris Funeral Home was in charge of the arrangements.

Mr. Harvey Jackson York, age 65, of Cedartown, passed away Wednesday, November 17, 1999 at a local hospital. Mr. York was born Sept. 28, 1934 in Borden Springs, Ala., and was an Army veteran. He was a member of Southside Baptist Church and a retired clerk for the Georgia School for the Deaf. He was preceded in death by parents, Georgia Haney York and Arthur York. Survivors include wife, Joan Venable York of Cedartown, daughter, Debra York Hutto; sisters, Eugenia Lorrens of Cedartown, Vesta Carroll of Buchanan, Mildred Edwards, of Carrolton, Marilyn Parham of Hapeville; brother, Robert York of Holyoke, Mass.; four grandchildren and three great grandchildren. Funeral services were conducted Saturday, Nov. 20, at 2 p.m., from the chapel of the Gammage Funeral Home with Dr. James Guy and Rev. Roger Whorten officiating.
