The last will and testament of Joseph R. Coffin, Newport, Herkimer, NY, 1872

In the name of God, Amen. I, Joseph R. Coffin of the town of Newport, Herkimer County,NY, being of sound mind and memory, do make, ordain, and publish and declare this to be my last will and testament, that is to say:

First, After all of my lawful debts are paid and discharged, I give, devise, and bequeath to my nephews and nieces the children of my brothers and sisters as follows:

  • Edward J., Isaac L., John, Catherine and Emily, children of my brother Edward Coffin,
  • Orville and Matilda, children of my sister Lucy Daniels,
  • Thomas, Ione, and Eladsit, children of my sister Phoebe Bowen,
  • Helen, daughter of my brother Alexander Coffin,
  • Bryant, John, Phoebe, Florence, Ida, Roxy, and Matilda, children of my sister Catherine Waterman,
  • Morris and Clifford, children of my sister Roxy Dewey,
  • Preston, son of my sister Emily Doxtader,

twenty-one nieces and nephews (being all my nephews and nieces except Susan, daughter of my sister Lucy Daniels, who is not included in this bequest considering that I have already given her something of worldly goods), to each of them the sum of one hundred dollars, out of my personal property of which I shall die siezed and possessed

Second,I give and bequeath unto my dear mother Matilda Coffin the sum of $60 a year as long as she shall live, and the right to live at my homestead with my wife Sally Coffin when she desires so to do; and it is my desire that my said mother shall, so long as she desires, have a home with my said wife Sally Coffin. I hereby make this bequest to my mother a lien and charge upon my real estate of which I shall die siezed and possessed.

Third, I give and bequeath unto my beloved wife Sally Coffin all the household furniture, pictures, and household utensils, etc., which shall be in my house in the town Newport at the time of my death.

Fourth, I further give and bequeath to my beloved wife Sally Coffin all the rest and residue of my personal property remaining after the payment of my debts and the legacies herein bequeathed, of which I shall die possessed during her lifetime or until she shall again marry, she to have the use of the same so long as she remains my widow; and in case she shall marry again, and if she shall not remarry, then upon her decease the said property shall go to my brothers and sisters or their representatives to be divided into seven equal shares, one share to each of my said brothers and sisters, or to the next of kin of those who may not then be living.

Fifth, I give, devise, and bequeath unto my beloved wife Sally Coffin all my real estate of which I shall die siezed and possessed during her life or so long as she shall remain my widow, she to have, hold, and use the same so long as she shall remain unmarried, and if she shall not remarry during her life, provided my said wife shall afford to my mother Matilda Coffin a good and comfortablehome in which to live, and shall also pay unto my said mother the yearly sum of $60 out of the proceeds of my said real estate, and in case my wife shall remarry, or in case she shall not again marry then upon her decease, my said real estate shall be divided among my brothers and sisters and the heirs of such as shall not then be living equally, that is to say the said real estate shall be divided into seven, and one share shall go to each brother and sister then living, and one share to the heirs of each brother and sister which shall then be deceased. This bequest is made to my said wife Sally in lieu of dower.

Likewise, I make, constitute, and appoint my beloved wife Sally Coffin to be exectrix of this my last will and testament, hereby revoking all former wills by me made.

In witness whereof I have hereunto subscribed by name and affixed my seal the third day of April in the year of our Lord one thousand eight hundred and seventy-two.
