John Mitchell's Will

In the name of God Amen.  I John Mitchel of the State of North Carolina in the County of Bertie, being sick and weak in body but of perfect mind and memory thanks be to almighty God, therefore calling to mind the mortality of my body and knowing it is appointed for all men once to die do make and ordain this my last Will and Testament, that is to say principally and first of all I give and recommend my soul into the hands of almighty God that gave it and my body I recommend to the earth to be buried at the discretion of my executors, nothing doubting but at the General Resurrection I shall receive the same again by the mighty power of God, and as touching such worldly estate where with it hath pleased God to bless me in this life I give the same in the following manner and form

First my Will and Desire is that my new pattent land and as much of the old as with the new shall make two hundred acres all which I have not given to William Barradaill Wood may be sold to the highes bidder for as much as fifty dollars to be paid in ready money and what it will sell for more to be twelve months credit and all the money arising or coming for that land be paid away and given as followeth

Item  I give unto my loving wife Sarah Mitchell all the ready money mention to wit fifty dollars which is to be raised by the sale of the two hundred acres of land that is left to be sold to her her heirs and assigns forever.

Item  I give unto my daughter Judah Thomas five pounds to be raised and levied out of the sd land that is left to be sold.

Item  I give unto my daughter Sarah Hopkins five pounds to b paid her by the money arising by the sale of the above land that is to be sold.

Item  my will and desire is that all the money that may arise from the sale of the land that is left to be sold except what is before given may be equally divided between my five daughters Elizabeth Tart Susanna Holloman Penolipe Hoggard Anna Harrison and Mary Mezels to them their heirs and assigns forever.

Item  I lend unto my loving wife Sarah my plantation and land on Bed Bud which I bough at publick landue while the said land is paid for and after it is paid for I lend the said land to George Cowand and his wife during their lives and after their decease I give the said land and plantation to my grand son Alsey Cowand to him his heirs and assigns forever.

N.B. if this land that is mentioned lent to my wife and George Cowand and his wife and then given to Alsey Cowand is not paid for in twelve months from the date hereof I desire as much of it shall be sold as will pay for it and the remainder part to stand fas as above mentioned.

Item  I lend unto my daughter Winifred Cowand one feather bed and furniture one chest two pewter basons two pewter dishes and three pewter plates during her life and after her decease I give the same to Pheba Cowand forever.

Item  I lend unto my loving wife Sarah during her natural life all the remainder part of my estate not heretofore mentioned, and after her decease I give the same to be equally divided amongst my seven daughters Elizabeth Tart Susanna Holliman Penolipe Hoggard Ann Harrison Mary Meazels Winifred Cowand and Pheba Barradaill Wood to them their heirs and assigns forever.

Item  I give unto my son Matthew Mitchell five shillings to him his heirs and assigns forever.

Lastly I appoint ordain and make my loving wife Sarah and William Barradaill Wood executors of this my last will and testiment and I do here by utterly disallow revoke and disannul all other former will or wills by me and confirming this to be my last will and testament in witness whereof I have hereunto set my hand and seal this third day of November in the year of our Lord one thousand seven hundred and ninetyfive signed sealed published pronounced and delivered or declared by the said John Mitchell senior as his last will and testament in the presence of us.
