BOATRIGHT Bedford County VA, Deed Book 11, Page 386 Thomas Holt & Wm Adams to William Boatwright 7-27-1801 Courtesy Imogene Bennett THIS INDENTURE made this 27th day of July One Thousand Eight Hundred One between Thomas Holt & Wm Adams both of the County of Bedford, of the one part, and William Boatwright of the County aforesaid, the other part, Witnesseth that the said Thomas Holt & William Adams for and in consideration of the sum of thirty pounds current money of Virginia to them in hand paid the receipt whereof they the said Thomas Holt & William Adams doth hereby acknowledge hath bargained & sold do by these presents Bar-gain Sell alien(?) of and Confirm unto him the said William Botewright his heirs and assigns forever one certain tract or parcel of land containing twelve acres be the same more or less situate in Bedford County and lying on the West side of Lick Run/a North branch of Otter River and bounded as followeth to wit, Beginning at said Boatwrights Corner thence White Oak thence new lines N 26E 46 poles to pointers N ? SE 49 poles to a small white oak S 67E 40 poles to pointers on said Boatwrights line thence along his lines N 83W 38 poles to a stump N 56W three (?) poles to a red oak & thence S 60W 81 poles to the first Station together with all and every of the appurtenances to have and to hold the above mentioned land and its appurtenances unto him the said Wm Boatwright his heirs & assigns forever as an estate in fee simple and they the said Thomas Holt & William Adams doth further covenant that they will forever Warrant and Defend the said land and its appurtenances from themselves their heirs and from all other persons whatsoever unto him the said Wm Boatwright his heirs and assigns forever. Thos Holt (Seal) his Wm X Adams mark Note: William Adams m Bedford Co 11-23-1801 Lucy Dearin, dau Jamimah; Samuel Adams m Bedford Co 11-27-1800 Patsy Wade dau Isaac Wade the bro of Joshua Wade who m Anna Boatwright. ---------------------------------- D-1 BOATRIGHT Deed William Boatright and Mary his wife to Robert Austin Bedford County Deed Bk 11, Pg 656/657, 10-25-1802 BEDFORD COUNTY: The Commonwealth of Virginia to Authur Mosely & James Callaway, Gentlemen of the County aforesaid, Greetings: Whereas William Boatright and Mary his wife by their certain Indenture of bargain & sale bearing the date the 25th day of October 1802 have sold and conveyed to Robert Austin thirty seven acres of land be the same more or less with the appurtenances lying & being in the County aforesaid on Lick Run Creek and whereas the said Mary can not conveniently travel to our Court of our said County of Bedford to make acknowledgment of the said conveyance, we command you or any two or more of you that you do personally go to the said Mary & review her acknowledgment of the same privately and apart from the said Wm Boatright her husband whether she be willing that the said Indenture be recorded in our said Court and whether she doth the same freely & voluntarily without the persuasions or threats of her husband and when you have examined her as aforesaid that you distinctly & plainly send and certify us thereof in our own said County Court under your hands and seals returning also the said Indenture & this Writ. D-5 BOATRIGHT Deed, Thomas and Francis Patterson to William Boatright Dated 2-17-1803, Recorded 2-28-1803, Elbert Co GA Deed Bk H (1802-1803), Pgs 128a, 129. GA Archives Retrieval/Refile Info 81/21 This Indenture made this Seventeenth day of February Eighteen hundred & Three between Thomas Patterson and Fanny his wife of the State of South Carolina, Abeville County of the one part and William Boatwright of the State of Georgia and Elbert County of the other part. Witnesseth that for and in the consideration sum of three hundred dollars to me in hand paid at and before the Sealing and delivery of these presents the receipt whereof is hereby acknowledged fully satisfied have sold bargained, promised, released, conveyed and confirmed unto the said William Boatwright all that tract or parcel of land lying in Elbert County, formerly Wilkes, containing three hundred acres more or less beginning at a B.O.+3 running S 69 1/2 W to a Spanish O.+-3, thence to Picket Shiflets line, thence along said line to the corner from thence to the beginning, being a part of a tract or parcel of land sold to the sd Thomas Patterson by Ezekia Baley (Bailey) and deeded to him the Nineteenth day of July One Thousand Seven Hundred and Ninety Four, which said tract or parcel of land with all & singular the rights, title, profits, Interests, hereditments belonging to the said premises to have and to hold until the real proper use and behoof of the said William Boatwright, his heirs and assigns, and the said Thomas Patterson and Fanny his wife, do engage for ourselves, our heirs and assigns at all times, well and truly, to warrant and defend the rights, title and claims of said land free from the claim or challenge of any person or persons unto the said William Boatwright, his heirs and assigns, in fee simple forever. Bailey, Jas Bailey : : Jno Cunningham, J.P. : Ezekiah Bailey (Seal) Regisd 28th Feb 1800 D-6 BOATRIGHT LAST WILL AND TESTAMENT OF WILLIAM BOATRIGHT Bk 1, Pg 185; Document shows Bk 1, Pg 143, Pickens Dist SOUTH CAROLINA : October the twenty-seventh, the year of our PICKENS DISTRICT : Lord eighteen hundred and fifty. The last will and testament of William Boatright of the State and District aforesaid - in the first place I desire to be decently buried and that all my just debts should be paid, in the next place I give and bequeath to my son Abner Boatright a certain portion of my land during my wife Elizabeth Boatright lifetime that is all the lower part from a cross fence including the house I now live in and orchard. Thirdly, I desire my son Abner to rent out all the land above the said cross fence and the said rent go to the support of my wife during her life, and if anything be left over for him to make sale of it and give the proceeds to his mother. I also desire my son Abner to repair and make comfortable the house that George Towery now occupies for the use of my wife Elizabeth. All my household furniture I give to my wife to dispose of as she thinks proper and at her death all the above mentioned land must be sold and also all the property that she is possessed of and equally divided amongst all my children, Viz - Nancy Moss, Ruthy, Sherly, Abner Boatright, Charity Ellard, Anny Clinton, Drusilla Davidson, Mary Crow, William Boatright, Francis Towery, Elizabeth Quinn, Sarah Vandiver. I do also appoint and request Abner Boatright, Marcus T. Trimmier to execute this my last will and testament given under my hand this 27th day of October 1850. In the presence of His F.H. Hall Wm. X Boatright. John Weaver Mark M.T. Trimmier SOUTH CAROLINA : PICKENS DISTRICT : PERSONALLY appeared before me W.D. Steele, Ordinary Pickens District, John Weaver and made oath that he was present & did see William Boatright sign the within (by marking his mark) as his last will and testament. That F.H. D-7 BOATRIGHT William Boatright War 1812 Pension Records Milledgeville, 3rd March 1814. William Boatright, a private in my Company, under command of Lieut. Col. Saml Groves, has served six months and fourteen days in the service of the United States faithfully and he is hereby honourably Discharged from said service. Charles Carter, Capt. Saml Groves, Lt. Col. ------------------- A slip of paper otherwise not described stating as follows: 9821 War 1812 INVALID No. 9821 William Boatright Pri Georgia Mil April 24th 16 (1816) Vol 1, Page 38 [Arrangement of 1870] -------------------------- State of Georgia : : Habersham County : SS. On this 9th day of April 1850 Personally appeared this day before me William Boatright a resident of the State of South Carolina and Pickins District, aged Seventy Six (76) years, who being first duly Sworn according to law, doth on his oath make the following declaration in order to obtain the benefit of the Act of Congress passed December 23, 1817, that he was a private in the company of Capt Charles Carter, under Major Benjamin Cleveland, and Lieut. Col Samuel Grover in Genl Floyd's campaign and from forced march in the Creek Nation, between the dates August 24th 1813 and March 3rd 1814, he was so injured in his hips and legs as to be unable to perform military duty, he also further declares that he was from Elbert County, State of Georgia, and was in the Service of his Country and in line of his duty D-8 BOATRIGHT when he received this injury, that no surgeon of the Army resides within thirty miles of him, that he relinquishes every claim to a pension whatever or an annuity, except the present, and he declares that his name is not on the pension role of any agency in any State, and that the paymaster who last paid him was by the name of Hosey, & he served six months and upward. Sworn to and subscribed before me the day and year above written. His William X Boatright Mark Thomas B. Wheeler, J.I.C. I hereby certify that declarent is unable from bodily affliction to appear in open court to make his declaration. Thomas B. Wheeler, J.I.C. State of Georgia : : Habersham County : I, Benjamin Cleveland, Major under the command of Lieutenant Col Samuel Groves, in Genl Floyd's campaign, do certify that William Boatright of Elbert County, State of Georgia, served six months and upward in the company of Capt Charles Carter in the Army of the United States in the War of 1812, against Great Britain, commencing on the 24th day of August 1813, and ending on the 3rd day of March 1814, and from forced march between those dates in the Creek Nation received an injury in his hips and legs which totally disabled him from performing military duty, and continues to constitute him an entire invalid, being unable to walk. I also further certify that he is unable from said affliction to attend in open court to make his declaration and was honorably discharged at the end of his service. Benjamin Cleveland, Major I hereby certify that the above named deposing officer may be relied on for truth and honesty. Thomas B. Wheeler, J.I.C. D-9 BOATRIGHT State of Georgia : : Habersham County : April 9th 1850. It is hereby certified that William Boatright a private in the company of Capt Charles Carter in Genl Floyd's campaign in the Army of the United States is rendered incapable of performing the duty of a soldier by reason of an injury inflicted while he was actually in the service aforesaid and in the line of his duty, viz by satisfactory evidence and accurate examination, it appears that between the dates of the 24th of August 1813 and the 3rd of March 1814, from forced march in the Creek Nation, he received an overstrain in his hips and legs and he is thereby not only incapacitated for military duty, but in the opinion of the undersigned, is totally disabled from obtaining his substance from manual labor. Hughes Clarkesville, Georgia 24 April 1876 Book F, Vol 8, page 41 --------------------------- Clarksville, Georgia April 10th 1850. Sir: In consequence of William Boatright's extreme inability to travel the distance to the Court in his own county, he has made his declaration on the Georgia side, out of his own County and State, but I hope if it is presumable by the department that he is justly entitled to a stipend, that it will be allowed him payable at the Charleston, South Carolina agency the same as if his declaration had been made in the County in which he resides. The Rolls afford no evidence of his having sustained any injury while in the service. Jno S. This Indenture : made the thirtyeth of December To : in the year of Our Lord One : Thousand Seven Hundred and Thos Wade : Seventy Three Between John : Bootwright of Craven County in : the Province of South Carolina, Granted the 31st October 1769 : Planter, of the one part, and 200 Acres Dated 30th of December 1773: Thos Wade Esqr of Anson County in the Province of No Carolina, of the other part. WITNESSETH that the said John Bootwright for and in consideration of the sum of fifty pounds lawful & grant money of the Province of South Carolina to him the said John Bootwright in hand paid at and before the Sealing and Delivery of these presents the receipt and payment whereof is hereby acknowledged by him the said John Bootwright for which he hath Bargained, Sold, Aliened, Engrossed and Confirmed and by these presents doth bargain & sell alien engross convey and confirm to the said Thos Wade Esqr his heirs Exors Admors and assigns forever all that parcel or tract of land situate in Craven County in the Province aforesaid on both sides of Buffalo Creek & hath such shape form and marks as the plat to the original grant doth represent reference thereunto being had well more fully and at large appear beginning at a White Oak Corner and runs North 44 chains and seventy two links to a pine then West 44 chains & 72 links to a Pine thence South 44 chains and Seventy two links to a pine thence East 44 chains & 72 links to the beginning Two Hundred acres of land which tract D-15 BOATRIGHT of land was granted to the said Bootwright by his Majestys Letters Patent bearing date ye 31st day of October in the year of Our Lord One Thousand Seven Hundred and Sixty Nine. To have & to hold the parcel or tract of land containing two hundred acres hereby granted and sold and all and singular the premises with their & every of their appurtenances unto the said Thos Wade Esqr his heirs Exors Admors and assigns forever and the said John Botwright his heirs Exors and Admors doth covenant and agree to and with the said Thos Wade his heirs Exors and Admors and assigns that he the said John Botwright is lawfully seized and possessed of a good and Indefeasible Estate in and to the aforesaid two hundred acres of land intended to be hereby granted and sold and that he the said John Botwright hath full power to bargain & sell ye said parcel of land containing two hundred acres unto the said Thomas his heirs Exors Admors & Assigns according to the intent and meaning of these presents and that the said Thomas Wade his heirs Exors Admors and Assigns may from time to time and at all times hereafter have hold use occupy possess and enjoy the said land and premises hereby granted and sold without any bit hindrance molestation or denial of or from him the said John Bootwright his heirs Exors Admors or Assigns & from every other person or persons whatsoever claiming by him or under him or them or any of them and lastly that the said John Bootwright for himself his heirs Exors Admors & assigns shall & will Warrant & forever defend the said granted premises unto the said Thos Wade his heirs Exors admors and assigns against the lawful claim of any person or persons claiming the same. This indenture made the 15th day of August in the year of Our Lord One Thousand Seven Hundred & Seventy Six between Thomas Boatwright (Sen.) of the County of Craven in the Province of South Carolina, Planter, of the one part and William Boatwright, son of the said Thomas Boatwright, of the County and Province afd of the other part - WITNESSETH that the said Thomas Boatwright, as well, for, and in consideration of the natural love and affection which he beareth unto his sd son Wm Boatwright, as also of the sum of five pounds current money, of the aforesaid Province, to him in hand paid by the sd Wm Boatwright, he the sd Thomas Boatwright, hath given, granted and confirmed, & by these presents doth give grant & confirm unto the sd Wm Boatwright_______ all that stock of horses & mares having br the name of _______ Boatwright now running at large in the af _____________ branded, with a figure of six as also all my meat cattle marked with a swallow fork & a nick in the left ear, the right ear, whole. One feather bed & furniture, as well also all & singular my household furniture in what place or places so ever the same, shall be found, as well in his own possession and custody, as in the custody or possession of any other person or persons what so ever, as they now are, or which at any time here after during the life of the sd Thomas Boatwright may be ___________reased. To have & to hold all and singular, the said horses meat cattle & all other, the premises afsd unto the said Wm Boatwright his Executors, Administrators & Assigns for ever, provided always, and upon condition that the said Wm Boatwright, his Executors, Adm. & Assigns, do & shall permit & suffer him the sd Thomas Boatwright to have hold, use, occupy, possess, and enjoy the sd horses meat cattle and all & singular the premises within granted for and during so long time as the sd Thomas Boatwright and Margaret his wife, shall happen to live and the sd Thomas Boatwright for himself, his Executors and Administrators, doth covenant and agree to & with sd William Boatwright his Executors and Administrators, by & under the conditions afsd not otherwise, shall & may peaceably & quietly, have, hold, and enjoy all & singular the horses meat cattle & premises afsd in manner afsd without any molestation hindrance or interruption, by any person or persons what so ever, claiming under him or by his act means or procurement, IN WITNESS whereof I the sd Thomas Boatwright, have here unto put my hand and seal the day & year first within written.
