ELMORE County

This is the will of Michael Pevy, who died in 1871 in Elmore county Alabama. He was a son of Abraham and Lydia Peavy of Butler county Alabama.

The Last Will and testament of Michael Pevy--submitted by Jeffery Jehu Pevy The State of Alabama {September the 8th 1869} Elmore county I Michael Pevy of the State and county above named , being of a sound mind and memory but somewhat advanced in age and not knowing how long health or life may continue and calling to mind that it is appointed unto all men once to die , I therefore deem it right and just that I should make a disposition of what insipty and worldly goods that a kind provider has blessed me with I do therefore make this my last will and testament hereby making all others made before this time null and void.

I direct that my body be buried in a decent and christian like manner suitable to my circumstances in life. I will and direct that all my debts be paid as soon after my death as circumstances will admit. I will and direct that my wife A.W. Pevy shall have one cow and calf and I will that my wife have one bed and bedstead with the clothing belonging to one bed and all that she has made since the year 1868, and it is my will that my daughter Melissa O.Pevy have one bed and stead and clothing belonging thereto, and all that she has made since the year 1868. As all my other children Walter F. Pevy, Julian Ann Ingram, A.Jackson Pevy, Lida Jane Holley, Amanda Catherine Jordan and Missouria l. Gunnell have all had that amount previous to this times and I will and direct that after my wife A.W.Pevy and daughter Melissa O. Pevy each have out of my property one cow and calf bed and bed stead with clothing belonging thereto as before directed. I will that all my property be sold to the highest bidder and the money that may be paid for the property be equally divided between my wife A.W.Pevy and my children Walter F.Pevy , Julia Ann Ingram , A.Jackson Pevy , Lida Jae Holley , Amanda Catherine Jordan , Missouria L. Gunnell and Melissa O. Pevy.

And lastly I will that Elon Holley and Calvin Jordan be and hereby appointed as executers to. Your petitioner WILLIAM D. PEEVEY represents that he is the administrator of ROBERT W. PEEVEY deceased, who was in his life- time administrator of DIAL PEEVEY, by virtue of which he is now administrator of said DIAL PEEVEY.

Your petitioner further represents that the following described tract of land belonged to the estate of said DIAL PEEVEY, dec'd, and that it cannot be equitably divided between he heirs of said DIAL PEEVEY,dec'd, without a sale. To wit, the north west part F???ctional Section 15 Township Range 2 east situated in that part of Madison County called "old madison" containing 42,000 acres. Your petitioner further states that it may be necessary to sell said land for the payment of debts.

Your petitioner further represents that the following is a list of the heirs of said DIAL PEEVEY, dec'd.

Your petitioner, WILLIAM D. JOHNSON, shows to your honor that he is the son of MASTIN JOHNSON, who interm married on the blank day of bland in the year blank with one ELIZABETH PEEVY, the daughter of DIAL PEEVY, formerly of Madison Couny. That in the year blank the said DIAL PEEVY removed to the State of Arkansas, and there died intestate, leaving a large property in that state, consisting of land and negroes and other property-that the said DIAL PEEVY also left considerable property in this state consisting of land and notes and other property-that WADE PEEVY, administered on said DIAL PEEVY'S estate in this County-that said WADE PEEVY died in the year blank and now one ROBERT W. PEEVY has attempted to administer on said DIAL PEEVY'S estate-your petition further shows to your Honor, that his mother ELIZABETH JOHNSON, formerly ELIZABETH PEEVY and daughter of said DIAL PEEVY, died in the state of Mississippi leaving your petitioner, the ???? of her said marriage, with the said MASTIN JOHNSON-Your petitioner further shows that he is an heir of the estate of said DIAL PEEVY, in sight of his mother ELIZABETH JOHNSON, formerly ELIZABETH PEEVY and daughter of the said DIAL PEEVY. Your petitioner further shows that he has not received anything from the estate of his grandfather DIAL PEEVY either in the state of Arkansas or this State and that he is entitled in sight of his mother to his equal distribution of said estate, with the other heirs. your petitioner does not know who is the administrator of said DIAL PEEVY'S estate in Arkansas but is informed and believes it to be true that said property in the state of Arkansas has been divided out, and your petitioner's rights neglected-Inconsideration of the premises and that justice may be done, your petitioner prays this Honorable Court to force the said ROBERT W. PEEVY to complete his bond and to appear on a citation, which is here asked and to show cause, why said pettioner distributive should not be given unto him, and how he has settled said and on failure of his giving bond to remove him, and appoint some other person in his stead, to have said estate finally settled, and distribution thereof made according to law.
