The properties at Baddegama and Pillagoda supported not only Sarah and George Winter but their children, grand children, great grandchildren and great great grand children.

 

An article in the Observer reads:

 

A suburb of Gintota even today goes by the name of "Winter's Ferry" ("Binteragedara Talpota").  Besides the sugar cane plantations at Baddegama Mr George Winter bought up land at Gintota and Kalutara which he planted with that commodity.  Another suburb of Gintota is called "Ukwatte" (sugar cane garden) although there is not a single sugar cane to be seen about the place.  Mr George Winter also went in for indigo cultivation, getting out two experts from Calcutta for the purpose but this enterprise did not prove a success.  "Nilhena Kanda" (blue plantation mountain) Baddegama is all that is left to remind the present generation that indigo was once planted in Ceylon.  Another by-product in which Mr George Winter took an interest in was the cultivation of citronella but citronella oil came down in price from Rs 15 a bottle to Rs. 1 and the business was abandoned.

 

George's memorial at All Saints, Church, Galle (now the Dutch Reformed Church) reads:

 

"Sacred to the memory of George Winter Esq., of Baddegama near Galle who departed this life 21st January 1853, aged 55 years.  Also of Edward James Winter, second son of the above who died at Galle 12th June 1862, aged 31 years.  This tribute of affection is raised to the memory of those who dearly loved in life by those who are left to mourn their loss.  The Lord gave and the Lord hath taken way.  Blessed be the name of the Lord".


George's Will went to probate in the Galle District:

Be it known to all men that on the Fourteenth day of April in the year One Thousand Eight Hundred and Fifty Three, the Last Will and Testament of George Winter, deceased, a copy of which is hereunto annexed, was exhibited, read and proved before Court and administration, of all property and estate rights and credits of the said deceased was and is hereby committed to Sarah Winter, the executrix in the said Last Will and Testament named, she being first sworn faithfully to execute the said Will by paying the debts and legacies of the deceased as far as the property will extend and the law will bind and also to exhibit into this Court a true and perfect Inventory of the said property on or before the Fifteenth day of August and to file a true and just account of her executrixship on or before the Fourteenth day of October next.  Given under the seal of the District Court of Galle, this 19th day of July, 1853.  By order of Court Sec(retar)y.  True copy W. 18.  18.4.1853.  Last Will & Testament

 

Be it hereby made known that on this the Seventh day of January in the year of Our Lord One Thousand Eight Hundred and Fifty Three (1853) before me Trutland Frederick Morgan of Galle in the Island of Ceylon, Notary Public by lawful authority duly admitted and enrolled in the presence of the subscribing witnesses, personally came and appeared George Winter of Baddegama in the Gangaboda Patto of the Galle District at present residing in the Fort of Galle and the appearer being ill in bed but of sound and disposing mind, memory and understanding as appeared at the passing of these presents, declared his intention to make and execute his Last Will and Testament wherefore hereby revoking and annulling all Wills, codicils and other Testamentary acts heretofore made and passed by him, the said appearer hereby declared to nominate and appoint Sarah Winter, his wife and Sarah Anne Winter, wife of Jos. Deslandes, Susannah Caroline Winter, George Walter Winter, Amelia Winter, Edward James Winter, Lydia Septima Winter, Alfred Octavius Winter, Harriett Decima Winter, Henry Frank Winter and Charles Deslandes Church Winter, his children as heirs and heiresses of all the estate and effects which shall be left by him after his death whether movable or immovable or whether the same be in possession, reversion, remainder or expectancy nothing excepted, the said Sarah Winter to a half or just moiety thereof and his children to the remaining half after payment of all his just debts and funeral expenses.

 

The appearer declared that it is his desire that the Baddegama property and works should be kept entire as a provision for his family and that all spare machinery and out-lying lands and produce in hand be sold and that the proceeds applied towards the redemption of the mortgage to the Revd. James King Clarke of the sum of One Hundred Pounds due to John Joachim van der Spar Esquire who holds a mortgage on the Baddegama property and works situate at Meeddume and that all amounts of products realised after payment of necessary expenses and provisions for the family be paid over to him until the debt is liquidated and extinguished.

 

The appearer further declared that after the payment of his debts and the estate became free, any of his children attaining the age of twenty one shall be at liberty to demand from the executrix, a division of his or their share of the property or the amount to be realised of the share by sale amongst the remaining shareholders, excepting the share due to his daughter Amelia which shall remain under the guidance and control of her mother Sarah Winter, the executrix and in case of her death, the share of the said Amelia to remain vested under the charge and control of such person as may be nominated by her mother.

 

The appearer declares to give and bequeath unto his old and faithful servant Mootoo Samy, the sum of ten shillings monthly to be regularly paid to him out of the proceeds of his estate and the said appearer declared to nominate and appoint the said Sarah Winter to be the sole executrix of his Will and administrix of his estate and effects hereby given and granting unto her all such powers, authority as are required or allowed in law and especially those of assumption, substitution and surrogation.

 

Lastly the appearer declared to reserve to himself the power from time to time and at all times hereafter to make such alterations in or additions to the Will as he shall think fit either by a separate act or at the foot hereof designing that all such alterations or additions so made under his own signature shall be held valid and effectual as if they had been inserted herein all which having been clearly and distinctly read over to the appearer by me the Notary, he declared that he fully understood the same and that it contained his Last Will and Testament desiring that it may have effect as such or as a codicil or otherwise in such manner as may be found to consist with law.  Thus done and passed at Galle the day, month and year aforesaid in the presence of the witnesses Adam de Zilwa and John Edward Armstrong both of Galle.

On the 8.1.1890 the "Observer" reported a visit to Ceylon of Mrs Winter senior:

 

"A special welcome is due to this lady who arrived by the "Khedive" on a visit to her family on the ancestral property at Baddegama, near Galle.  Mrs Winter is now in her 91st year and yet is well and active to a wonderful degrees.  Most of her life was spent in Ceylon although she has now been resident in England for a good many years.  We have a special interest in this lady for she is the widow of Mr George Winter who was deputed by his brother merchants in Colombo in 1834 to edit the first newspaper in Ceylon independent of the government.  We trust Mrs Winter may have a pleasant visit to the island at this time and we tender to her all New Year Good wishes.

 

Ceylon Observer 16.1.1890 - Arrival in Baddegama.  Mrs Winter the aged and respectable lady who spent so many years of her long life in this place, created no little excitement and enthusiasm amongst the natives, crowds gathered from all the villages round in front of her old home and on the banks of the river on which it is situated.  A commodious boat nicely fitted up and beautifully decorated was in waiting for her at Balkatota ferry where she was met by her own people of the sugar estate and hundreds of natives, their work people and others thronged the banks of the river and all eager to get a hold of the rope and though, for but a short distance, towed the boat up to the bungalow cheering as they went.  The older natives delighted in telling how her husband had done so much for the district and province, being the first to introduce and carry on sugar cane cultivation successfully by which so many of them now make their living.  Also the first to cultivate citronella grass and extract the oil now of one of the chief industries of the Southern Province and always extending.  The old lady stood the journey very well and cheerfully and gratefully took her hearty welcome home.

 

She died the next year on 7.1.1891 and the following obituary was printed in the "Observer"."

 

Death of Mrs Winter of Baddegama - a telegram from Galle reads: "Mrs Winter dead.  Burial at Galle at 10.30 tomorrow".  Mrs Winter. was one of the oldest European residents in Ceylon and her death removes one of the few remaining links with the days of old.  She was the widow of Mr George Winter the first editor of the "Colombo Observer" in 1834 and pioneer of sugar planting in Ceylon in 1826.  She returned to Ceylon a few years ago after a short absence and resided with her son at Baddegama.

 

Funeral of the late Mrs Winter of Baddegama - Galle, January 7th, 1891.  Born 1799.

 

The remains of the late Mrs George Winter, who expired at Baddegama yesterday at the advanced age of 92, were brought by boat to Galle for interment in the Church of England Cemetery close to the graves of her husband and son.  A hearse was in readiness at Mahamodara; and a half past ten this morning the coffin was transferred to its destination and conveyed to All Saints Church.  The funeral fixed for this forenoon was preceded by a short solemn service, the church bells tolling at intervals for an hour before the ceremony.  Precisely at half past ten the Revs. F. C. Salkeld and Balding met the coffin at the main entrance and preceded it up the aisle where it was placed on trestles at the foot of the church.  On the lid lay a cross and wreaths composed of the choicest blossoms, while large lilies filled every available space in lovely profusion.  The service was non-choral and by 11 am a procession was formed to the cemetery where the concluding portion of the Church of England service was gone through.

There was also a large gathering of respectable Sinhalese residents of Baddegama.  The deceased lady was widely known and universally esteemed by the residents of Galle and Baddegama at the latter place especially will her name be remembered as the principal representative of the firm of Messrs Winter & Sons, the pioneers of the sugar and citronella cultivation on the island, who have been associated with the planting enterprise in the south of upward of half a century.

 

Sarah's Will had several codicils possibly because some heir predeceased her.

In the matter of the Last Will and Testament and Codicils of Sarah Winter, deceased widow, of the late George Winter of Galle.,

 

Be it known to all men that on the 10th day of August 1892 the Last Will and Testament and Codicils of Sarah Winter, deceased, copies of which are hereunto annexed, were exhibited, riad and proved before this Court and administration of all property and estate rights and credits of the deceased was and is hereby committed to Edward Deslandes Bowman Esq., of Baddegama as the executor named in one of the said codicils names the said Edward Deslandes Bowman being first sworn faithfully to execute the said Will and codicils by paying the debts and legacies of the deceased testator as far as the property will extend and the law will bind and also to exhibit into this Court a true, full and perfect inventory of all the said property on or before the 31st day of March 1893 and to file a true and just account of your executorship on or before the Fifteenth day of December 1893.  Given under my hand and the seal of the Court this Twenty-first day of December 1892.

Last Will & Testament

 

I, Sarah Winter of 2, Merton Villas, Central Hill, Norwood in the County of Surrey, widow, of the late George Winter of Galle in the Island of Ceylon Esquire, hereby revoke all Wills and Testamentary dispositions heretofore made by me and declare this to be my Last Will.  I bequeath all my furniture and household effects in and about the house where I now reside, together with the lease of the same and all benefit to arise therefrom, to my daughter-in-law Harriett Isabella Winter, widow of my late son George Walter Winter, for her sole use and benefit and free from the control of any future husband.

 

I bequeath to my grand daughter Beatrice Winter my gold watch.

I bequeath my ruby ring of five stones to my grand daughter Jessie Underwood.

I bequeath my black enamelled diamond ring to my daughter Mrs Sarah Anne Deslandes.

I bequeath my ruby ring of three stones to my grand daughter Gertrude Winter.

I bequeath all my silver-edged dishes, spoons with the rest and forks to my grandson Walter Henry Trinnell Winter.

 

I devise and bequeath unto my grandson George Edward Winter of Baddegama, the second son of Alfred Octavius Winter, the lands known as the Bopa estate situated in the villages of Upatenaka and Bopa and in the district of Galle aforesaid.

 

I bequeath to my daughter the said Sarah Anne Deslandes one moiety of all share which I hold in the London & Provincial Bank of London at the time of my death and bequeath to my daughter Susannah Caroline Daly the remaining moiety of the shares which I may hold in the said London & Provincial Bank of London at the time of my death.

 

I devise and bequeath all my half shares and interest in the said Baddegama Estate or any of the profits arising therefrom unto and to the use of my daughter Harriett Decima Underwood, the wife of William Elphinstone Underwood of Manantoddy, Madras, India and Daniel Blyth of Galle in the said Island of Ceylon, Esquire, their heirs, executors or administrators respectively according to the nature and tenure thereof upon trust that the said Harriett Decima Underwood and Daniel Blyth or the survivor and survivor of them and the executrix or administrator of such survivor (which said several persons and either the trustees or trustee for the time being, of this my Will and hereinafter referred to as the said trustees or trustee, shall hold the trust premises upon the trusts following (that is to say) in the event of the income accruing from the share of the profits arising therefrom the Baddegama Estate to which my son Harry Frank Winter is already entitled under his father's Will not amounting to the sum of One Hundred Pounds per annum, then with a view of securing to him an income of not less than One Hundred Pounds per annum for his support and maintenance, I direct my said trustees to pay to my son in each and every year in which the income accruing from his share of the said profits shall not amount to the said sum of One Hundred Pounds, such a sum as will with the income derivable under his said father's Will, amount to the said sum of One Hundred Pounds subject to the payment of such sum to my said son, I direct my trustees to pay out of the income of the said trust premises and any money of which I shall be possessed at the time of my death after payment thereof of my funeral and testamentary expenses and debts, the following legacies, that is to say:

 

A sum of Five Hundred Rupees to my grand niece Lillie Taylor, the wife of Frederick Taylor of No.1, Moss Stall Crescent, Finchley, the sum of One Thousand Rupees to my grand niece Nelly Davies and the sum of One Thousand Rupees to my grand daughter Anne Hopfengartner and I direct that in the event of the said Sarah Anne Deslandes dying before my said son then that the same be paid to such persons as shall undertake and be responsible for the support and maintenance of my said son and that the receipt of the said Sarah Anne Deslandes or of the person who may undertake to become responsible as aforesaid for the support and maintenance of my said son shall be sufficient discharge to my trustees and the person or persons paying the same and subject to the payment of the said annuity to my said son or a satisfactory provision being made from the payment of the same and my funeral and testamentary expenses and debts and the legacies hereinafter bequeathed, I devise and bequeath all my interest and share in the Baddegama estate and the rest and residue of my property not herein or by a codicil hereto specifically devised or bequeathed to the persons following (that is to say);

 

One sixth part to my daughter Sarah Anne Deslandes and one sixth part for my daughter Susannah Caroline Daly, one sixth part to my daughter-in-law Harriett Isabel Winter, widow of my late son George Walter Winter, one sixth part to the children of my deceased daughter Lydia Septima Bowman in equal shares, one sixth part to my two grand children Evelyn Gertrude Winter and Sarah Cresse Winter, daughters of my late son Alfred Octavius Winter as joint tenants and one sixth part to my said daughter Harriett Decima Underwood and I hereby direct that the devise or bequest to females shall be for their respective absolute use and benefit and free from the control and engagements of any present or future husband and that if at the time of my death any of the persons to whom I have devised and bequeathed my part of my estate shall not have attained the age of twenty one years or it should be thought desirable to sell the said property then and in such case, the shares so bequeathed to such persons shall be vested in the trustees of this my Will to give receipts for the purchase money thereof and such trustees shall stand possessed of such moneys upon trust to invest the said money in the names or name or under the legal control of the said trustees or trustee in or upon any of the public stocks or funds or Government securities of the United Kingdom or India or any Colony or Dependancy of the United Kingdom upon freehold, copyhold, leasehold or chattel, real securities in England or Wales or in or upon the shares, stock or securities of any Company or corporations whether commercial, municipal, local or otherwise, carrying on business or constituted for any purpose in the United Kingdom or India or any Colony or Dependency of the United Kingdom and may vary the said stock funds, shares and securities at their or his discretion or the income of the moneys and investments for the time being representing the same to and for the maintenance and education of the persons or person who will be entitled to the respective shares or share on their respective persons person attaining the respective ages of twenty one years then upon trust for such respective persons or person respectively.
