Sumner County Court December Term, 1865
The Honb. County Court of Sumner County met according to adjournment at the
Court House in Gallatin on the first Monday in December, it being the 4th
day of said month, A. D., 1865, present the Honl. S. Heermans Judge, etc.
Ordered by the Court that James W. Haynes be appointed Administrator of all and singular the rights and credits, goods and chattels of the estate of James M. Swaney, deceased; and thereupon the said James W. Haynes and his securities J. L. Swaney and B. P. Swaney appeared in Open Court and entered into and acknowledged their bond to the State of Tennessee in the penal sum of Two Thousand dollars, conditioned as the law directs and said J. W. Haynes was duly qualified.
Ordered by the Court that John A. Barber be appointed Administrator of all and singular the goods and chattels, rights and credits of the estate of Gideon Stuart dec'd; and thereupon the said John A. Barber and his securities W. A. Payne and D. T. McKoin appeared in Open Court and entered into and acknowledged their bond to the State of Tennessee in the penalty of One Thousand dollars, conditioned as the law directs and said Barber was duly qualified.
An Inv. & Afc of Sale of the personal property of Richard E. Johnson dec'd was this day produced in Open Court by the Admr. W. C. Simpson, rec'd by the Court and ordered to be recorded.
An Inv. & Afc. of Sales of the personal property of C. P. Hallom dec'd was this day produced in Open Court by the Admr. J. A. Littleton, received by the Court and ordered to be recorded.
The last will and testament of Joseph Robb dec'd was this day produced in Open Court for probate, duly proved by the oaths of G. S. Gray and J. R. A. Tomkins, subscribing witnesses thereto and ordered to be recorded. Joseph M. Robb, one of the executors named in said will, the other executor named, Alfred Robb, being dead - appeared in Open Court and accepted the execution of the same and was duly qualified without being required to give

bond according to a provision in the will.
We, the undersigned Commissioners, appointed by the Sumner County Court
at the September Term having been duly qualified proceeded to assign to Mrs.
Maria Haynes, wife of F. G. Haynes, deceased, for her year's allowance the
following articles, to wit;
50 barrels corn, 50 bushels wheat, 2000 lbs of Pork, 100 lbs. coffee, 200
lbs sugar, 200 dollars in money, 500 lbs beef
All of which is respectfully submitted this 16th day of October 1865.

Martha Lane vs. T. R. Eubanks Admr of Bennett Lane dec'd et als
The Commissioners appointed at the last term of this Court to assign to the
plaintiff her dower in the estate of Bennett Lane dec'd returned the following
report viz;
Pursuant to an order from the County Court, the undersigned Commissioners,
after being duly sworn, have this day valued the estate of Bennett Lane deceased
and set apart as dower for the benefit of the widow, Martha Lane, the following
described lands namely; Beginning at a Hackberry by the bluff on a ravine
which cuts off what is called the island, running S. 34 poles to Cumberland
river, thence down the river to the mouth of Elliott's branch, thence up
the meanders of said branch to a Hackberry where a water gate is hung, thence
E 16 poles to the Turnpike, thence with the meanders of the pike to the northwest
corner of where the grass lot now is, thence S 72 1/2 degrees E 36 poles
to a stake thence South 70 poles to the bluff, thence with the bluff to the
beginning, containing by estimation 50 ares, 3 roods and 26 perches. That
being in our estimation one third in value of the whole estate. In
witness whereof we have set our names this Nov. 20th 1865.

(Plot of Survey)
Eliza L. Kirby vs. L. B. Allison - Bastardy
This cause came on for hearing this day and the said L. B. Allison appearing
in Open Court and not denying the charges against him of being the reputed
father of a male bastard child, whereof the said Eliza L. Kirby who delivered
on the 8th day of October 1865. It is therefore ordered by the Court
that the said L. B. Allison enter into bond and security in the sum of five
hundred dollars, conditioned that said bastard child shall not become a pauper
or county charge on this or any other county of this State and that he pay
the sum of forty dollars for the first, thirty dollars for the second year
and twenty dollars for the third year to the County Commissioners of the
poor for the support of said bastard child and obey such orders as this court
may make in the premises. He therefore entered into and gave his bond
together with Geo. Chitwood & G. R. Perdue as his securities as above
ordered. It is further ordered that he pay all the costs in this case,
and that execution may issue at any time upon the order of this Court to
collect and enforce the payment and collection of the stated amounts in said
bond etc.
Mary C. Blackmore vs. George Blackmore et als
The Commissioners appointed at a previous

term of this Court to assign to the plaintiff her dower in the estate
of Dr. James A. Blackmore, deceased, returned into Court the following
report:
To the Honb. S. Heermans, Judge of the County Court of Sumner.
The undersigned Commissioners appointed at a previous term of the County
Court of Sumner County, to allot to Mrs. Mary C. Blackmore her dower out
of the real estate of the late Dr. James A. Blackmore, her husband, being
sworn, do assign to her the following land, lying in Sumner County, on the
Hartsville Turnpike bounded as follows: Beginning in the center of
the Gallatin & Hartsville turnpike, running North 1 1/2 degrees West
One hundred & fifty seven poles to a stake, thence North 88 1/2 degrees
East one hundred & thirty five poles to a stake, thence South 1 1/2 degrees
West seventy two poles to a stake, West five poles to a stake, thence South
1 1/2 degrees East Eighty five poles to a stake; Thence 88 1/2 degrees West
One hundred and thirty poles to the beginning, containing by actual survey
One hundred and thirty acres, and embracing the mansion house and other
buildings.
We also allot her forty acres anywhere on the South boundary of the ridge
tract for the purposes of timber and fuel, the precise point or locality
to be designated by the said Mary C. Blackmore, or her authorized agent and
then to be run out and accurately surveyed by metes and bounds and inserted
in this report by Wm Lovell, Special Surveyor.
These two tracts we consider one third in value of the entire real estate
of the said James A. Blackmore dec'd. Given under our hands & seals
this (left blank) day of Nov. 1865.

Be it remembered that the above cause coming on for hearing, at the present
term of the Court, was heard on this the 5th day of December, 1865, before
his Honor, S. Heermans, Judge of the County Court for Sumner County upon
the Petition, answers, interlocutory orders and the report of the Clerk and
the proof in the cause. And it appearing to the satisfaction of the
Court that Francis Clark departed this life intestate in the county of Sumner
in the month of June 1865, leaving the defendants, Sarah Clarke, his widow,
and Drissella Clarke and Nancy Clarke as his only distributees and heirs
at law, and that the petitioner, at the August Term 1865 of this Court, qualified
as his Administrator. That the intestate had no personal estate, but
was the owner in fee of the land mentioned in the pleadings, which composed
his entire estate - that in the same, which has not been allotted her - that
the ad-

ministrator has nothing with which to furnish the widow with her years
support nor to pay the indebtedness of the intestate and the expenses of
his administration, to enable him to do which, it is absolutely necessary
to sell the land mentioned in the pleadings. And it further appearing
to the Court that the defendant, Sarah Clark, does not wish her dower in
kind, but prefers that the whole tract be sold and she receive in lieu of
her dower its equivalent in value in money out of the proceeds of the sale.
It is therefore ordered, adjudged and decreed by the Court that the lands
mentioned in the pleadings be sold, one third cash and the balance upon a
credit of twelve and eighteen months in equal amounts, the purchaser giving
approved bond and security, and a lien retained upon the land until all the
purchase money is paid. Out of the proceeds of the sale the defendant,
Sarah Clarke, will receive whatever amount shall be ascertained to be equal
in value to her dower, and whatever sum shall be reported by the Commissioners
to purchase her year's support, the same to be paid over to her as the funds
are realized after paying the costs of this proceeding, the balance of the
proceeds to be paid over to the Petitioner to be used by him in the due course
of his administration. John L. Bugg, Clerk of this Court is appointed
Commissioner to make the sale in conformity with the provisions of this decree;
who after giving twenty days public notice of the time and place of sale,
will sell the land at public auction to the highest bidder, on the terms
above directed. The sale to take place upon the premises. He
will report to the next or some subsequent term of this Court, until when
all other matters are reserved.
Adeline Coram vs. H. J. Lockett et als
The Commissioners appointed at the last term of the Court to assign to the
plaintiff her dower in the estate of A. Coram deceased, returned into Court
the following report.
Pursuant to an order from the County Court the undersigned Commissioners
have this day after being duly sworn valued the real estate of Abjah Coram
dec'd and laid off as dower for the benefit of his widow Adeline Coram the
following lands viz: Beginning at a rock S. W. corner of land in the
Belotes' ferry road, running in the road N. 17 1/2 W 28 poles thence N 19
degrees W 18 poles & 8 links to a stake in the center of the road thence
East by the N. W. corner of the barn 104 poles 10 links to a

stake in the East boundary line, thence South 44 poles 10 links to the
Ash corner, thence West, 90 poles to the beginning (giving her the fence
on the north side of the lot) containing 26 acres 2 roods, 32 perches, which
we think is one third the value of the whole. This November 23rd
1865.

Elizabeth B. Roney, et als. vs. Isaac M. Short et als.
Be it remembered that the above cause coming on for hearing at the present
term of the Court, was heard on this the 5th day of December 1865 by his
Honor, S. Heermans, Judge of the County Court of Sumner upon the petitions
and the answers of the defendants. And it appearing to the satisfaction
of the Court that the petitioner, Perry Corkran is the owner of four ninths
of the eighty acres of land mentioned in the pleadings, and that the other
petitioners and the defendants, Thomas J., Joseph W.

Beverly L. C., Sarah B. and Fannie S. A. Austin by devise from their father
Samuel Austin are the owners in fee of the other five ninths of said land,
the widow already having had her dower allotted her, and the executor having
no necessity of resorting to the same for the payment of debts, the parties
in interest are entitled to partition of the same according to their respective
rights.
It is therefore ordered and decreed by the Court that said land be divided
as follows, to wit; Four ninths in quantity and value to the petitioner,
Perry Corkran, and the remaining five ninths equally to the petitioner Elizabeth
B. Roney and the defendants, Thomas J. Joseph W. Beverly L. C., Sarah B.
and Fannie S. A. Austin, that is one sixth of five ninths to each equally
in value the last five of whom are minors, whose interest will therefore
be laid off together or in one body, giving to the petitioner, Elizabeth
B. Roney one sixth of five ninths of the entire tract. Andrew McGlothlin,
Abram Bradley and Joseph McGlothlin are appointed Commissioners to make said
partition or division in conformity with this decree, in doing which they
will first be sworn and report to the next or some subsequent term of this
Court.
Court adjourned until tomorrow morning at 9 o'clock.

The Commissioners appointed at the last term of the Court to set apart to Mrs. Julia A. Barker, widow of Henry J. Barker dec'd one year's support for her and family returned into court their report which is confirmed and ordered to be recorded.

A. J. West vs. Mary E. West and Jas W. West
Be it remembered that the above cause coming on to be heard at the present
term of the Court was heard on this the 6th day of December 1865 before his
Honor, S. Heermans, Judge etc. upon the petition exhibits and pro confesso
taken in the cause, and it appearing to the satisfaction of the Court that
the petitioner A. J. West and the defendant, Mary E. West, by inheritance
from her father Daniel W. West are joint owners, as tenants in common of
the tract of land mentioned in the pleadings, containing about two hundred
and thirty acres in Dist. No. 13 as appears from the exhitbits on file -
that the parties are entitled to partition thereof equally in value according
to their respective rights.
It is therefore ordered and decreed that the said tract of land be equally
divided between the petitioners, A. J. West and the defendant Mary E. West
according to value and in such manner as shall be most promotive of the interest
of each party and that James A. Malone, G. M. Gillespie and B. N. Fleming
be appointed Commissioners to make said partition or division according to
the terms of this decree - they will first be sworn, and make their report
to the next of some subsequent term of the Court.

We the undersigned Commissioners appointed by the Court Court of Sumner
County Sept. Term 1865 to appropriate to Mrs. Elizabeth Jones, widow of Elisha
Jones dec'd one year's support of the effects that belong to the estate to
her as follows; 75 lbs coffee, 150 lbs sugar, 1 barrel salt, 10 lbs
soda, 4 lbs tea, 4 lbs pepper, 2 lbs Allspice, 1 lb ginger, all the bacon
on hand about 250 lbs, all the lard on hand, 8 choice pork hogs, 20 bushels
wheat, 50 barrels corn, 500 Bundles oats, 500 Bundles Fodder, 150 dollars
in money, all the molasses on hand.
All of which is submitted this 13th Sept 1865.

Ordered by the Court that Margaret Burk be appointed administratrix of all and singular the rights and credits, goods and chattels of the estate of Ulett Burk deceased; and thereupon the said Margaret Burk and her securities Michael Kenny appeared in Open Court and entered into and acknowledged their bond to the State of Tennessee in the penalty of One Hundred dollars, conditioned as the law directs and said Burk was duly qualified.
Ordered by the Court that J. W. Harris, M. J. Hassell and Timothy Walton be appointed Commissioners to set apart to the widow of J. L. Griffin

Ordered by the Court that Bruce P. Dye be appointed administrator of all and singular the goods and chattels rights and credits of the estate of Eli S. Perdue deceased, and thereupon the said Bruce P. Dye and his securities Giles R. Perdue and Geo. Whitwood appeared in Open Court and entered into and acknowledged their bond to the State of Tennessee in the penalty of Six thousand five hundred dollars, conditioned as the law directs and said B. P. Dye was duly qualfied.

The bill and petition of Wm. C. Simpson, Administrator of R. E. Johnson dec'd
filed in the County Court of Sumner against Mary Ann Johnson, Elizabeth Rippy
& husband, Wm. Rippy, Mary Heath & husband, Benjamin Heath and Robert
Johnson, Martha Johnson, Wm. A. Johnson, James Johnson and Jesse Johnson
minors without regular guardian defendants.
The Complt. would show your Honor that R. E. Johnson departed this life intestate
on the (left blank) day of 186(left blank) leaving the defendant, Mary Ann
Johnson, his widow and the other defendants as his only distributees and
heirs at law, that he took out letters of administration upon the estate

of the said R. E. Johnson at the (left blank) Term 1865 of the County Court of Sumner. The defendant, Mary Ann, has had her dower allotted, her years provisions allowed her and the articles exempt from execution set aside and the complainant has made sale of the remaining personal property, which amounts to only $13.15 as his amount of sales will show, to which reference is made. This embraces the entire personal assets in the hands of Complainant. So far complainant has ascertained the following outstanding debts against his intestate to wit;

The intestate is also indebted to Sarver & Fikes by judgment but the
amount is unknown to Complt. and he may be indebted to others, of which Complt
has no knowledge. Your Honor will see that the personal assets are
greatly insufficient to meet the liabilities of his intestate. The
deceased was possessed at the time of his death of a tract of land lying
in District No. 15 containing about One hundred and five acres, adjoining
the lands of James Escue, Thomas Rippy; A. S. Simpson and Westley Rippy;
sixty acres of which are covered by the widow's dower. Complt. avers
that it is absolutely necessary to sell the land for the payment of the debts
against his intestate's estate and as it is inferior in quality, it will
require the whole of it and the remainder in the widow's dower, and that
this may be done the bill is filed.
The premises considered, Complt. asks your Honor to make the persons named
in the caption defendants to this bill. Let subpoena to answer issue
etc. and appoint a guardian ad litem for the minors. Let them answer
all the material allegations of this bill, and upon the hearing

of the cause grant to Complt. an order for the sale of the land mentioned
in his bill that is the entire tract subject to the dower interest of the
widow and as a preliminary to this, if it be deemed necessary order such
reference to the Clerk as will ascertain the condition of the estate of the
intestate and grant him such other and different relief as the nature of
his case may require and as in duty bound he will ever pray etc.

This cause came on for hearing this day, before Judge Heermans, upon the
report of the Commissioners which is as follows, viz;

have this day pursuant to an order from the County Court October Term,
valued the real estate of Henry B. Vaughan dec'd and set apart a dower for
the benefit of the widow Mary A. Vaughan, the property herein described,
viz, the dwelling house and lots fronting Main Street in the town of Gallatin
and formerly occupied a family residence, together with the farm known as
the Brown farm containing by estimation seventy five acres, which parcels
of land we consider worth one third of the whole estate. In witness
whereof we have hereunto affixed our hands and seals the 10th of November
1865.

Commissioners to lay off the dower the widow of A. G. Douglass dec'd which

James M. Griffin et als vs. John T. Stogan
This cause was this day heard before Judge Heermans upon the report of the
Clerk which is as follows viz;
Pursuant to decretal order of the County Court of Sumner County rendered
at the November Term 1865, in the case of James M. Griffin et als vs. John
T. Stogan, I sold at public auction, on the premises, on the 12th day of
Dec. 1865 after thirty days notice, a tract of One hundred and eight acres
of land belonging to the estate of Mrs. Hannah Jackson dec'd & lying
in the 18th Civil District of said county. Said land was purchased
by J. N. Lee he being the highest bidder therefore, for Three hundred and
fifty five dollars ($355.00). Twenty five dollars were paid me on the
day of Sale and I took his note payable twelve months after date for the
remainder, Three hundred & thirty dollars ($330.00) Wm. Jackson and A.
H. Guthrie being his securities.
All of which is respectfully submitted to the Court this 13th day of Dec.
1865.

Jesse Jackson et als Ex Parte
Be it remembered that this cause came on for hearing before Judge Heermans
upon the report of the Clerk, which is as follows viz:
Pursuant to a decree of the County Court of Sumner County rendered
at the November Term 1865 in the case of Jesse Jackson et als Ex Parte.
I sold at public auction to the highest bidder the tract of land belonging
to the estate of John Jackson dec'd and lying in the 10th Civil District
of said county. James Shoecraft purchased the land at Six dollars &
seventy cents ($6.70) per acre. The Deed and Grant for said land call
for seventy five acres which at $6.70 per acre make Five Hundred & two
dollars & fifty cents ($502.50). I received Twenty five dollars
($25.00) cash and took his note for the remainder Four hundred & seventy
seven dollars & fifty cents ($477.50) payable in twelve months.
All of which is respectfully submitted this 18th December 1865.

Tuesday morning Decr. 26th 1865
John C. Lovell et als vs. J. T. Buntin et als
In this case it appearing to the Court that Mary F. Lovell one of the
Complainants is one of the heirs and distributees of Thomas Buntin dec'd
and that at the sale of the land sold under the decree of this County in
this case the Huffman tract of land lying in Robertson County, Tennessee,
containing Five hundred and three acres was bid off by the Complainant, J
C. Lovell at the price of $14.56 per acre for the use and benefit of the
said Mary F. Lovell, and that at the September Term, 1865, of this Court
a decree was pronounced confirming said sale and it appearing to the Court
that through mistake or inadvertence the decree vested the title of said
land in the said J. C. Lovell instead of his wife Mary F. It is therefore
ordered, adjudged and decreed by the Court upon the application of the said
Mary F. Lovell, the said John C. Lovell assenting to the same, that the title
of the said 503 acres of land be vested in the said Mary F. Lovell and her
heirs free from the debts and liabilities of her husband John C. Lovell and
that that portion of the decree of Sept., 1865, vesting the title in the
said John C. Lovell, be annulled and for nothing held.
Two orphan negro children viz, Sarah aged nine years and Luke aged six, were this day apprenticed to J. C. Lovell, who gave bond according to law, with George Love as his security.
