Harriett Leviski vs Alexander Leviski Final Decree

Be it remembered that this cause came on for final hearing before the Honb'le
Tho's Maney Judge & on the 21st day of June 1843 upon the pleadings and
proof in the cause it thereon appeared to the Court that the Complainants
Bill was filed on the 3rd of Aug 1841 and process had regularly issued against
Defendant and returned not found and Publication was regularly made against
said Defendant in the Gallatin Union a paper published in Gallatin against
the Defendant for him to appear plead answer or demur to Complainants Bill
or the same would be taken for confess against him and he having failed to
appear and plead answer or demur the Complainants Bill was taken for confessed
against him and set down for hearing exparte It further apeared to the court
by the Testimony of credible witnesses that the Complainant and Defendant
married in April 1837 in the County of Sumner State of Tennessee that they
lived together about three months when the Defendant without any cause
maliciously deserted and abandoned the Complainant and has remained absent
for more than

the space of two years previous to the filing of this Bill without making
any provision for the support and maintanance of Complainant. It further
appears by proof that the Complainant Harriett has maintained and well deserves
the reputation of an industrous and virtuous woman
It is therefore Decreed by the Court that the Bonds of matrimony subsisting
between the Complainant Harriett and the Defendant Alexander be and the same
is hereby dissolved and the Complainant Harriett be restored to the rights
of feme sole. It is further Decreed by the Court that the Complainant Harriett
recover of the Defendant Alexander Leviski the sum of four thousand Dollars
and the costs of this suit and that Execution issue. It is further ordered
that Complainant in the first instance pay the costs of this
cause.
