Copyright Information

For further reading on Copyright Law, check out the Library of Congress Web site at: http://lcweb.loc.gov/copyright/circs/circ1.html

Original works created for genealogy, are equally protected under United States Federal Copyright Law, as well as other published material from other artists. However, genealogical facts, such as names, dates, and places are not copyrightable. No one owns these facts. The original display, organization, arangement, and compilation is protected under Federal Copyright Law though.

Many genealogists do not use "just the facts", as they also incorporate family stories, histories, information and the like. This 'information' is copyrightable.

In 1978 a Federal Law was passed and now creators of original works do not have to display the copyright symbol, ©, or the words, "Copyright by", in order to be protected. If the work is published, in any way, including published in the internet, it is still covered under Federal Copyright Law.

Just a few of the non-copyrightable items:
"Titles, names, short phrases, and slogans; familiar symbols or designs; mere variations of typographic ornamentation, lettering, or coloring; mere listings of ingredients or contents" Library of Congress Web site   http://lcweb.loc.gov/copyright/circs/circ1.html

What is the duration of a copyright?
"A work that is created (fixed in tangible form for the first time) on or after January 1, 1978, is automatically protected from the moment of its creation and is ordinarily given a term enduring for the author's life plus an additional 70 years after the author's death. In the case of "a joint work prepared by two or more authors who did not work for hire," the term lasts for 70 years after the last surviving author's death. For works made for hire, and for anonymous and pseudonymous works (unless the author's identity is revealed in Copyright Office records), the duration of copyright will be 95 years from publication or 120 years from creation, whichever is shorter."
