CULLOMPTON.

PETTY SESSIONS, Monday. - Before G. M. MARKER (in the chair), W. C. RAYER, and T. TURNER, Esqrs. - John DENNER was charged with, on the 8th September, at Cullompton, stealing a quantity of apples, value 6d., the property of William FLAY. - Defendant pleaded not guilty. - P.S. BRIGHT said on the day in question he was watching the Plymtree-road, when the son of the defendant came towards him with a basket (produced), and, on asking what it contained, he said potatoes, but witness, on opening the basket, saw some apples. He told him he must go back and see Mr. FLAY. Afterwards he met the defendant, and told him he had taken the basket from his son, who said his father had taken the apples it contained from two trees in Mr. FLAY's field. - The Bench considered the case proved, and fined the defendant 12s. 6d. including costs. - Clement PYLE was summoned for non-payment of ten weeks' wages at 1s. 11d. a-week. - Complainant's father, of Kentisbeare, said he was a labourer, living at Broadhembury, and he had, at Lady-day last, made an agreement with defendant that his son should work for him for 1s. 11d. a-week, the wages to be paid quarterly. Witness gave a week's notice to defendant, but he refused to take it, giving no reason, however, for his refusal. Defendant agreed that if he boy stayed with him till Michaelmas he would pay him his wages. His boy left defendant's service on the 3rd September, which was a week after he had given him notice. - The Bench made an order for the payment of the ten weeks' wages – 19s. 2d. - each party to pay his own costs. - James SULLY, labourer of Silverton (who did not appear), was charged with being drunk. - Fined 1s., including costs. - John KELLY, labourer, for being drunk, at Burlescombe, on the 11th September, was let off on payment of costs, 9s. - Thomas MOORE was charged with trespassing in pursuit of game on the 14th inst., on the land in the occupation of Mr. J. C. KNOWLMAN, of Woodhayne, Culmstock. - Defendant was fined £1, including costs. - Henry KELLAND, who did not appear, was summoned for allowing his pony to stray at Culmstock. - Fined 5s. and costs, 14s. - Henry HOWE was charged with committing a rape on Sarah ROOKLEY, of Blackborough, on the 14th inst. - Mr. PAYNE, of Tiverton, appeared for defendant. - The magistrates considered there was insufficient evidence to convict, and the case would therefore be dismissed, but complainant could summon defendant for a common assault.
