Adjourned Sine Die


There was a happy ending to a dispute between two farmers which was to have come before his Honour Judge CLEMENTS for decision at Canterbury County Court on Tuesday. The case was that in which Charles E. MURCH, of Ellenden Farm, Whitstable, represented by Mr. L. S. FLETCHER, (instructed by Messrs. MOWLL and MOWLL), sought an injunction to restrain Arthur E. GILES, of Well Court Farm, Blean, and his servants, from trespassing on his property and damaging his land at Arbele Farm, Blean, etc. Defendant was represented by Mr. B. W. WADDY (instructed by Mr. H. W. S. HOMEWOOD).

Apparently the dispute was in regard to the use of a bridle path by defendant's vehicles. Defendant claimed that the path was a right-of-way and plaintiff that it was not. When the bridle path was blocked, defendant was alleged to have made a diversion with his vehicles.

When counsel appeared in Court, however, they informed the Judge that they were arranging a settlement and asked that the case should be adjourned sine die with leave for either party to restore it tot he list. To this his Honour agreed.
