31 March 1853Be it Known and remembered that on this thirty first day of March in the year of our Lord one thousand eight hundred and fifty three and in the year of the Independence of the United States of America, the Seventy Seventh.
Before me Gastin T. Raoul, recorder of said Parish, and duly authorised by law to exercise the powers of Notary Public therein, personally came and appeared Mr. Benjamin Manning, a citizen of the Parish of Livingston, state aforesaid, who did declare and say that for the consideration hereinafter expresses he does by these presents, grant, bargain, sell, convey, transfer, assign, and set over, with a full guarantee against all troubles debts, mortgages, claims, evictions, donations, alienations, or other incumbrances whatsoever unto Messrs. James Clark and William B. Benson of the City of New Orleans, herein represented by Mr. George Richardson who is here present accepting and purchasing for the said Clark & Benson, their heirs and assigns, and acknowledging delivery and possession thereof,
A certain tract or parcel of land situate, lying and being in said Parish of Livingston on the river Ponchatoulas being the west half of the North East quarter and the West half of the South east quarter of section No. twelve (12) in Township No. seven (7) south of Range No. seven (7) East containing One hundred and Sixty Six 79/100 acres, together with all the buildings, improvements, privileges, and appertenances to the same belonging or in anywise appertaining, vendor acquired said land from the Government of the United States, in part by location of military land warrant No. 19.948 and in part by purchase.To have and to hold said property unto the said purchaser, their heirs and assigns, to their proper use and behoof, forever; and the said vendor for himself his heirs & assigns said land to said purchasers their heirs and assigns, shall and will warrant and forever defend against the lawful claims of all persons whomsoever by these presents; the said vendor moreover, subrogating the said purchaser to all the rights and actions of warranty which he has or may have against his own vendor or the vendors of his vendor, hereby authorising the said purchaser to exercise the said rights and actions in the same manner as he might or could have done.
This sale is made for and in consideration of the sum of Three hundred and twelve dollars & fifty cents $312.50/100 cash in hand paid out of the presence of me, recorder, the receipt whereof is hereby fully acknowledged by said vendor and for which full discharge and acquittance is given.
Mortgage certificate shows the property herein conveyed to be free of any liens or incumbrances.
Thus done and passed at my office in the town of Springfield the day, month and year first above written in the presence of Alexr. S. Parker & C. V Lymwood, legal witnesses who have signed this act with the parties & me, recorder, vendor not knowing how to write made his ordinary mark hereto.
