James Morgan & wife [Levina Durbin]
to George Richardson
07 September 1836Be it known and remembered that on this seventh day of September in the year of our Lord one thousand Eight hundred and thirty six, before me Thomas Kennedy Parish Judge in and for the said Parish of Livingston, and duly authorized by law to exercise the powers of Notary Public therein.
Personally came and appeared Mr. James Morgan of the said Parish of Livingston who declared that for and in consideration of the sum of Eight hundred and two dollars and fifty cents cash in hand paid down, the receipt whereof is hereby acknowledge [sic], he does grant, Bargain and sell, Convey, assign, set over and deliver with a full Guarantee against all troubles of any Nature whatsoever, unto George Richardson of the Parish of Livingston of said State, his heirs and assigns present and accepting for himself & his heirs, a certain tract or parcel of land situated in the said parish of Livingston on the West side of the River Tangipahoa, To Wit:
The East half of the West half, and the East half of Section No. fourteen and lots no. three and four of section No. Thirteen and Township No five South, of Range No. Seven East, containing Six hundred and forty-two 10/100 of acres, agreeable to the plat of the survey of public lands in the land office at St. Helena Courthouse, one half of the above described parcels of land being the North half of said land divided by a line East & West so as to Equally divide said lands Agreeable to a rough sketch hereunto annexed giving to the said Richardson three hundred and Twenty one 5/100 acres on the North of said lands as the amount of his purchase.
To have and to hold unto the said purchaser the above described North half of said tract and parcels of land, containing three hundred and twenty one 5/100 acres to him, his heirs, and assigns forever, and the said vendor for himself and his heirs does Bind himself that he will warrant and defend unto the said purchaser his heirs and assigns the above described land against the Claims of all persons whomsoever.
Then to these presents personally came and intervening Mrs. Levina Durbin, wife of the said James Morgan, and by her said husband duly authorized and assisted to the full extent and validity hereof.
Who declared that she is well informed and aware that by the laws of this state she has a general Mortgage on the property herein sold as well as on all other property of her said husband for the restitution of her dotal property.
Brought by her in Marriage or subsequently acquiring either by succession or donation, and has been alienated by her said husband, for the restitution of her parephernal property of which her said Husband has had the administration or enjoyment and has been alienated by him for debts which she has contracted and for which she has made herself liable jointly with her said Husband, and for mutual presents.
But wishing to give the said purchasers a perfect title to the property herein sold she declared that she does by these presents Renounce all Claims, and relinquish all the right titles, Claims, liens, priveledges, and mortgages of any nature whatsoever, she has on the above described land in favour of the said purchaser, Binding herself, her heirs and assigns, that she will at all times ratify and confirm unto the said purchase the above described sale of land, and this relinquishment she does now make.
By the Certificate of the Register of Mortgages for this parish and of this date, it appears that the property herein sold is free of any mortgage or lien registered in this office in the Name of the present vendor or his anticedent vendor.
Thus done and passed in the parish of Livingston in presence of Hiram Stephens and Uriah Stephens.
Witnesses of lawful age and domociliated [sic] in this parish who have signed their names with the said appearers, and me the said Judge, and Notary this day and date first above written.
Mistress Morgan and also James Morgan not knowing how to write their Names have made their ordinary mark.
