Sheriff Sale to William Wells
Estate of Robert & Mary [Polly Richardson] Palmer
18 June 1853

To the Judge of the District Court for the Eighth Judicial District of the state of Louisiana holding sessions in and for the Parish of Livingston.

The petition of Alexander S. Parker a resident of said Parish -- Represents that he is the administrator of the succession of Robert Palmer & Mary Richardson, his wife, both deceased, that there are some claims against said succession which he has no means of paying but by a sale of the property of the same, & that the only property inventoried or Known of as belonging to said deceased is a tract of Land described as follows, to wit:

A certain tract or parcel of land, situate lying & being in the Parish of Livingston in the State of Louisiana and forming the South west corner of the tract of land formerly owned by Spencer Tucker and bounded as follows, beginning at the South West corner of the aforesaid tract of land at a red oak tree 8 inches in diameter, thence North twenty two (four pole) chains to a pine tree, 6 in D, to Holly 2 in D. Thence East twenty nine chains, East six links a white oak tree 24 in D. S. 9 W 40 links a white oak tree 24 in D. Thence South twenty two chains N 35 W 40 links a red oak tree 15 in D. S 45 E. 35 links a red oak tree 15 in D. Thence west twenty nine chains to the beginning corner containing Sixty three 86/100 acres;

He asks for an order directing the sale of said land for cash provided its appraised value shall be bid, otherwise that it may be readvertised and sold on a credit of twelve months for whatever it will bring, and according to law, in order that the debts of said estate may be paid & the same settled up & for general relief in the premises.

The foregoing petition being considered, and the law and the evidence being in favour thereof, It is ordered, adjudged and decreed that the prayer thereof be granted and the property mentioned be sold according to law for cash if the amount of the appraisement is bid if not to be readvertised and sold according to law on a credit of twelve months the purchaser to give his note with good and approved legal security and a special mortgage on the property importing consession [sic] of judgement [sic] to secure the price and to draw interest at eight percent per anum after due. May 7th A.D. 1853

Eighth Judicial District Court

To the sheriff of the Parish of Livingston greeting --

We command you in the name of the state of Louisiana & of the Eighth Judicial District Court aforesaid, that after due and legal advertisement you sell for cash providence it will bring its appraised value the following described property, belonging to the succession of Robert Palmer & Mary Richardson his wife both deceased, viz.

A certain tract or parcel of land situate lying and being in the Parish of Livingston in the state of Louisiana and forming the South west corner of the tract of land formerly owned by Spencer Tucker and bounded as follows, beginning at the South West corner of the aforesaid tract of land at a red oak tree 8 inches in diameter thence North twenty two (four pole) chains to a pine tree 6 in D. Holly 2 in D, thence East twenty nine chains, East six links & white oak tree 24 in D., S 9 W 40 links a white oak tree 28 in D. Thence South twenty two chains N 35 [degrees] W. 40 links a red oak thence 15 in D. S. 45 E 35 links a red oak tree 15 in D. Thence west twenty nine chains to the beginning corner containing sixty three 80/100 acres.

But if the appraised value of the aforesaid land shall not be bid that then you readvertise & sell the same on a credit of twelve months for what ever it will bring and according to law, the purchaser being required to give his note with good and approved legal security; and a special mortgage on the property importing consession [sic] of Judgement [sic] to secure final payment & to draw interest at eight per cent per anum of the due till paid, and that you ... due return according to law of the ... verbal of said sale to the office of the Clerk of the aforesaid Court.

Witness the Hon N. Bayles, Judge of said court this the 9th day of May 1853 (signed)

(Endorsed) Recieved [sic] May the 9th 1853 and on the 10th same month and year advertised the within described land for sale on the 18th day of June 1853 at 12 o�clock in the town of Springfield, Parish aforesaid and on the above mentioned 18th day of June 1853 the time fixed for said sale I repaired to the Court house door in said Parish of Livingston, read the advertisement in a loud an audible voice proclaiming the terms of sale which was for cash when the amount for which said land had been appraised not being bid, I proclaimed no sale, and readvertised said land for sale on Saturday the 23rd day of July 1853 as directed by law, and on the 23rd July 1853 I repaired to the Court house door in the town of Springfield Parish of Livingston - aforesaid, and after complying with all the previous legal requisites, read the advertisement in a loud and audible voice proclaiming the terms of sale which was a credit for twelve months the purchaser to give a note with approved personal security and a mortgage retained on the property sold, purporting a confession of Judgement [sic] until final payment, and after receiving the various bids and offers adjudicated the aforesaid land described in the within order of sale to William Wells (he being the last & highest bidder) for the price & sum of Six dollars which amount he paid in cash in preference to giving his note, which amount I hereby acknowledge to have received in cash.
