Rebecca Morrison to Elijah Settoon
09 May 1857Be it known, that this day before me, Purnell F. Starns, recorder of mortgages and Ex officio a Notary Public, in and for the Parish of Livingston, State of Louisiana, aforesaid, duly commissioned and sworn, and in the presence of witnesses herein after named and undersigned, personally came and appeared, Mrs. Rebecca Durbin, wife of James Morrison and duly authorized and assisted herein, both being Citizens of said Parish & State who did declare and say that, for the considerations herein after expressed, she does by these presents, grant, bargain, sell, convey, transfer, assign, and set over with a full guarantee against all troubles debts, mortgages, claims, evictions, donations, alienations, or other incumbrances whatsoever, unto Mr. Elijah Settoon also a citizen of the same Parish & State accepting and for purchasing for himself his heirs and assigns, and acknowledging delivery and possession thereof, the following described property - to wit:
A certain piece of land lying and being in this Parish on the East side of the river Ponchatoulas being in the North west corner of the section of land known as the Samuel Richardson tract of land the Wm. Durbin tract and now the property of the vendor Mrs. Rebecca Morrison widow of Wm. Durbin bounded on the west by said River, and north by Lands of E. McFarland on the East and South by Lands of the vendor.
To have and to hold, the said Land unto the said purchaser his heirs and assigns, to their proper use and behoof forever. And the said vendor for herself and her heirs and assigns the said Land unto the said purchaser his heirs and assigns, shall and will warrant and forever defend against the lawful claims of all persons whomsoever, by these presents; hereby subrogating the said purchaser to all the right and actions of warranty which she has against her own vendor, or against all preceding vendors, with full power and authority to exercise to same according to law.
This sale is made for and in consideration of the sum of Four hundred dollars cash in hand paid by the Purchaser and a full discharge granted for the same.
The Certificate from the Recorder of Mortgages of the Parish of Livingston, State of Louisiana, as required by Article 3328 of the Civil Code of the State of Louisiana is waived by the Purchaser. Thus done and passed at the Parish aforesaid in presence of Emile F. Grass and Charles Myers witnesses of lawful age, domiciliated in this Parish, who hereunto sign their names, together with the said parties, and me, the said Notary on this Ninth day of May in the year of our Lord one thousand and eight hundred and fifty Seven, Mr. Elijah Settoon not knowing how to sign his name makes his mark thus X.
