Act of Mortgage
Rebecca [Richardson Durbin] Morrison to Minor Heirs
13 December 1856

Be it Known and remembered that this thirteenth day of december in the year of our Lord one thousand eight hundred and fifty Six and of the American Independence the eighty first.

Personally came and appeared Mrs. Rebecca Durbin widow of the late Wm. Durbin but now the wife of James Morrison, and herein duly authorized & assisted by the said Morrison before me the recorder of the Parish and State aforesaid

Who did declare to me recorder that she was justly indebted to the minor heirs Wm. J., George R., Harris and Deliah J. Durbin, being minors of Wm. Durbin deceased, for the amount of their Interest in their fathers estate. The interest of the said minors in their said Fathers Estate, having been adjudicated to the said Mrs. Rebecca Durbin by a family meeting held before me the undersigned recorder on the 7th day of October 1856.

And in order to secure the interest of the said minors in their fathers estate, the said Mrs. Rebecca Durbin does by these presents mortgage and Hypothecate [sic] and do by these presents mortgage and Hypothecate [sic] specially the following described Land to wit,

To the said minors in order to secure their said interest in their said Fathers estate, A section of land known as the Samuel Richardson tract of land, on the east side of the Ponchatoulas [sic] river, being the late residence of Wm. Durbin, containing six hundred and forty acres with the exception of eighty acres of Land which is taken off of the North west corner of the said section of Land the said eighty acres of land is not included in the land herein mortgaged, and the said Rebecca Durbin now residing on the Land herein mortgaged hereby obligates and binds herself not to sell or incumber[sic] the said land to the prejudice of said mortgage or the interest of said minors.

Thus done and passed at the Parish of Livingston on the day and date above written in the Presence of Charles Myers and B. B. Lockhart who hereto sign their named with said Parties and me said Recorder.

The mortgage resting hereon is cancelled except the special mortgage in favor of the minor D.G. Durbin, for $625 & Int, as stated in this act. This done by written authority.
