Sarah Hutchinson to W. Nicol
04 April 1837Be it Know [sic] that on this fourth day of April in the year of our Lord one Thousand Eight hundred and thirty seven, Before me Thomas Kennedy, Parish Judge and Ex officio Notary Public in and for the said Parish, Personally came and appeared Mistress Sarah Gainey, wife of Peter Hutchinson, and by said Husband, duly authorized and assisted in the execution of this act, who declared That for and in consideration of the sum of one hundred dollars to be paid on the first day of June next, for which the purchaser has given his promisary Note for the sum, she does by these presents grant, bargain, sell and convey to Walter Nicol, of said Parish, present and accepting on her claim, and interest in, and to her portion of a certain tract of land situated on the east branch of the yellow water creek in this Parish, and belonging to six heirs of us, inherited from our father, being the sixth part of our father�s half of said tract of land amounting to fifty three acres more or less.
The [fifty]three acres is situated is bounded [sic] South by the Heirs of Norton, and on all other sides by vacant lands.
To have and to hold, the above described portion of Land of fifty three acres, more or less, and all the interest and claims of the said vendor in and to the undivided half of the above described section of land.
The said vendor warranting and defending to the said purchaser or the right and title in and to the said undivided Sixth part of the half section of land against all claims whatever.
By examinaion of the records of mortgages of this Parish of this date, it appears that the property herein sold is free of any mortgage recorded in this office in the Name of the present vendor or any other persons.
Thus done and passed in my office in presence of John McCarroll and George Richardson, competent witnesses who have signed the same with the said appears and me, the said Judge and Notary, this day and date first above written.
Mistress Sarah Hutchinson not being able to write her name has made her ordinary mark.
It is further understood and agreed on by the contracting parties that the said Vendor does not warrant the above described land any further that from her and her heirs, and does not warrant any particular Boundaries on the land.
