Zachariah Spinks to Jesse Darling
14 May 1834Be it remembered, that on this the fourteenth day of May in the year of our lord one thousand Eight hundred and thirty four, Thomas Kennedy Parish Judge, and Ex officio Judge of the Court of Probate, for the parish of Livingston and state aforesaid, did proceed to sell at probate sale after due advertisements, according to law, and agreeable to the authorisation of a family meeting had in the matter of the succession of Zachariah Spinks, deceased, a certain tract of Land belonging to the succession of Zachariah Spinks, deceased, containing One hundred acres, and situate on the West side of the river Tangipahoa joining the lands of James Durban below, and the lands of Mr. Haiford above, and on the terms required on by said family meeting, and after proclaiming the terms of sale and crying the said tract of land to the highest bidder, Mr. Jesse Darling of the Parish of St. Tamany said State became the purchaser, he being the last and the highest bidder for the sum of One hundred and five dollars, paid agreeable to the terms of said sale.
Now therefore Know all men by these presents that I Thos. Kennedy Parish Judge and Exofficio Judge of the Court of Probates for the said State & Parish .
For and in consideration of the sum of One hundred and five Dollars cash in hand paid by the purchaser the receipt whereof is hereby acknowledged before the signing and delivery of these presents do bargain and sell, and by these presents do hereby grant, bargain, sell, convey, assign, set over and deliver unto Mr. Jesse Darling of the Parish of St. Tamany & State aforesaid (he being here present and accepting this sale and acknowledging delivery for he same) a certain tract of land belonging to the succession of Zachariah Spinks dec�d, containing One hundred acres situate on the West side of the River Tangipahoa and bounded below on said river by the lands of James Durban, and above on said river by lands of W. H Haiford, East by the said river Tangipahoa, westardly [sic] by public land.
To have and to hold unto the said Jesse Darling, his heirs, executors, administrators and assigns, the above described tract of land with all the privileges, appertenances, herdiments? & rights thereunto belonging or in any wise appertaining to her and their proper use and behoof, forever, hereby bargaining, granting an conforming unto the said purchaser his heirs and assigns, all the rights, titles, Interest an Claim of the said Zachariah Spinks his heirs and assigns in and to the above described premises warranting and defending against the Claims of the said Zachariah Spinks his heirs and assigns forever.
Signed and acknowledged in presence of Mr. George Richardson and Patrick McCarty, witnesses who have hereunto signed their names as such with the parties and me, the said Judge the day and date first above written.
