In the name of God Amen I James Southall being sick of body but of a disposing mind & memory doth constitute and make this my last Will and Testament in manner & form following that is to say I desire my body to be committed to the earth & my soul to god who gave it & as to my worldly goods that it hath pleased God to bestow on me I desire to give in manner following. Item I desire all my Just debts to be paid. Item I lend unto my beloved wife the plantation whereon I now live dureing [sic] her natural life & the feather Bed & furniture whereon I now lie & also I lend unto my wife the rest of my Estate until there is sixty five pounds raised from said Estate for my son James Southall & also sixty five pounds for my son Jefse Southall which sums of money the rest of my sons have already received. Item I also lend unto my wife two negroes namely Will & Shell dureing [sic] her life after the above sums of money is paid also one youke [sic] of Work Steers & also work horse one Cow & Calf one head of Hogs & one sow & pigs Item my will and desire is that my son James Southall have one Feather bed & furniture one Cow & Calf & one ho[rse]. Item my will & desire is that my son Jefse Southall have one feather bed & furniture one Cow & calf & one hor[se]. Item I lend unto my daughter Ann Drake twenty five acres of Land which land I purchased of Archer Perkinson in Amelia during her life & at her death to be

be equally divided among all of her children. Item my will and desire is that after the above mentioned legacies are [rais]ed that a division take place equally among my children & that part of my Estate that shall fall to my daughter Ann Drake to be deposited in the hands of my Exors that shall be hereafter named to be given to her as they shall [can't read] [can't read] stand u[can't read] and if their [sic] should be any of her part remaining at her death my desire is that it be equally divided among her children. Item my will & desire is that my three grandchildren that is to say Elizabeth Crowder Rebecca Crowder & Mary Crowder have one equal childs part in the division of my Estate. Item my will & desire is that after my wifes death that my Land be sold [can't read] [can't read] [can't read] credit and the money ariseing [sic] from the sale thereof to be equally divided among my children that I had by my last wife & the rest of the Estate at her death to be equally divided among all of my children and last of all I constitute and appoint my two sons Daniel Southall & Henry H Southall to execute this my last Will and Testament. In witnefs whereof I have set my hand and afixed [sic] my seal this fifteenth day of August 1801

At a Court held for Amelia County the 2nd day of November 1801

This Last Will and Testament of James Southall decd was exhibited into Court and proved by the oaths of two of the witnefs thereto subscribed sworn to by Daniel Southall and Henry H. Southall the Exors therein named and was ordered to be recorded and on the motion of the said Executors who entered into and acknowledged bond together with John Southall George Kidd Herod T. Crowder & Robert Tanner their securities in the penalty of 5000 Dollars with a condition according to Law certificate is granted them for abtaining [sic] a probate thereof in due form
