Records of the Bay of Quinte

Sidney Township held a meeting once a year to review and pass bylaws and elect public officials. The minutes are transcribed below.

Farmers were issued a "Stock mark" to identify their animals by clipping the ears in accordance with the mark issued. See the Stock Marks at the end of the Minute Book.


The original Minute Book resides in the land records department of the City of Quinte West in Trenton, Ontario. I had read about the book in a few older books but was not able to find it.. I'd like to thank Gerry Boyce, well known author in Belleville, for directing me to its location. The book measures 8 x 12 3/4 inches and is in a cloth & leather binding and has become frail. Digital images were taken of all the pages for transcription purposes. The City of Quinte West has given permission for this project and I'd like to thank Sandra Kelleher for her participation.

Page 1 is dated 1806 and it is clear that the book was purchased at that time and the minutes for the years 1790 to 1805 were copied from a previous document (starting at page 3) with the same handwriting and ink. The list of  those who purchased the book should be thought of as making this purchase in 1806, not 1790 as implied in a few older books.

May 15 Pursuant to an Act of the Legislation of the province of upper Canada in such case made and provided The first Annual Meeting of the Inhabitants of the Township of Sidney was held at the dwelling house of Aron Rose, in Sidney aforesaid on May the 15th 1790 ~ and from thence adjourned to the dwelling house of Stephen Gilbert Esquire in Sidney. and to be held of the first Tuesday of May ensuing ~

Regulations for fences - 1st That Fences shall be four feet six inches high and not exceed five inches open for the first three feet for the township of Sidney ~ and for the township of Thurlow not to exceed six inches open
 
Regulations for Hogs - 2nd Hogs to run at Liberty until they trespass through or over a lawful fence. Seed hogs to be confined from the first of May until the first of December ~

Seed hogs or Rams to be impounded till the owner pay 20 shillings. [Marginalia]
Resolved that the Laws and regulations be the same is in the year 1798 with the addition that if any persons or persons whomsoever, shall find seed hog or Ram, during the ensuing running at large on the Highways or Commons, they are hereby authorized and empowered to impound the same, the pound keeper to detain them until the Owner Shall pay the sum of Twenty shillings, the one half to the person or persons taking said Hog or Ram to the pound, the other half to the Collector to go to the public stock of the district –

Hogs running at large till they do do damage over or through a lawful fence – Seed hogs to be confined from the first of May to the first day of December, and Rams to be confined from the first day of September till the tenth day of December, any person or persons finding hog or ram, within the said limitted lines running at large on the highways or Commons to casterate them. II Concession Road Registeres
We whose names hereunto subscribed, being summoned according law, as Jurors, tp take into consideration whether it be necessary to alter the plan, for the road, which was left, by the direction of the Government between the first and second concession of the townships of Sidney and part of Thurlow, in the County of Hastings in the Midland district and Province of Upper Canada, to some other plan. Have unanimously agreed that for the benefit of the inhabitants and the public in general, that the said road should be removed, and to begin at a dug way on Lot number one or nearly, in the second concession of Sidney aforesaid, thnce at eight angles tp the west line of the township aforesaid  (nearly) and as straight direction as the lands will admit to the dwelling house of Andrew Lott thence to the cleared lands of John Row, thence to the dwelling house of Francis Van Di, Voirt (sic) thence to William Sharrards Junr‘s dwelling house thence as straight as the lands will admit to the rear of the dwelling house of Henry Smith, thence with an Easterly course and straight direction to the forty foot road between Lots No 30 and 31 thence south 16o East along said road to the front of said Second concession, thence North 74o East along the same to the township line between Sidney and Thurlow thence nearly at right across the lots and with as straight a line as the lands will admit of to Singletons River at or near Capt John W Meyers mill or bridge.
Therefore we the said jurors whose names are hereunto subscribed do Certify upon Oath, that to the best of our knowledge after mature deliberation, examination and other knowledge that it is necessary and expedient for the benefit of the inhabitants and public in general the said road be altered as aforesaid.

Hogs to run at large till they do damage the owners thereof to pay the same and yoke the with a Crotch [sp? check] yoke Six Inches above and four inches below the necks. Pigs to be Confined till three Months old. Rams to be confined from the first day of September to the Tenth day of November any person finding either Ram or seed

W. James McNabb, Sollomon Hazleton and Asa Turner Esquires Commissioners of Roads having Taken into Consideration the petition of the Inhabitants of  Sidney and Thurlow for a public Road to be laid out from the second Concession of Sidney back of David Marshalls to the front Road in Thurlow on the Hill near the dwelling house of the aforesaid James McNabb Esquire, have Laid out the same as follows and do order the same to be recorded Viz –
 
Beginning at the North Easterly Corner of Lott  Number thirty four in The First Concession thence South Sixteen degrees East along the same to near the North Westerly Corner of David Marshalls dwelling house thence Easterly and in a Straight direction to a Bridge known generally [sic] by the name of Gander Ars? Bridge thence Nearly East thirty five Chains fifty links thence North eighty Six degrees East Eleven Chains, thence Nearly North – Eighty degrees East thirty Chains more or less to the North East Corner of Phillip Zwicks improvements. Thence Nearly Easterly Twelve Chains more or less to a Green pine Tree standing in the South East Corner of Stephen Gilberts West field north of the public Road. Thence Easterly into the public Road thence into the Public Road, the aforesaid Road in all plans to be thirty feet wide

1839 – By Laws for The Township of Sidney Resolved That all Horned Chattles Shall be allowed To Run at Large on The Commons or Streets during The year 1839 with the Exception of on[?sp]  monts[?sp] Viz from The first of March to The first of May
 
if any Chattles found Running on The Commons or Streets Contrary To Law made and provided in Such Cases The owner Shall forfeit and pay Sum[?sp] from half penny per head

By Laws for the Township of Sidney 1840
Resolved that horned Chattles Shall be allowed to run on the Commons or Streets during the year of 1840 with the Exceptions of two monts Viz from the first of March to the first of May if found running at large on the Commons or Streets these 2 months the owner shall forfeit and pay seven pence half penny per head
 
Horses under the Same Restrictions as horned chattles and horses that are known to be breechy are restrained from running at Large on the Commons and Streets during the year
 
If any farm animals contrary to laws made at the township meeting the owner shall forfeit and pay 5 Shilling per head
 
Sheep are allowed to run at large until they do damage then they are to be dealt with the same as any other anamal Trespassing Contrary to Law
 
Swine may run at large till they do damage then the owner to pay damages and yoke his hogs with a crached yoke six inches above the neck and 4 inches below the neck

1        be it enacted that Lawful fenc shall be 4 ½ feet in heighth 6 Inches between Joints 2 feet up from the Ground from that above from 6 to 9 Inches
2        be it enacted that all horned Cattle Known to be breechy Shall not be allowed to runn at Large on the Commons if running Contrary to this Clause the owner Shall forfeit and pay 5/ per head - - -
3        be it Enacted that horses of no Kind Shall bepermited to at Large and the Commons and highways Shall be under the Same penalties as Cattle
4        hogs free Commances till they do Damage the owner must pay the Damages and take Care of his hogs C[B]ower hogs to be Kept Confined during the year of 1848 if found running at Large the owner Shall forfeit and pay 5/ a head
5        Sheep not allowed to runn at Large on the roads or Commons if found running at Large on roads or Commons the owner Shall – forfit and pay /7 ½ per head –

9  [erasure]  8         Resolved that no Cattle or horses Sheep nor Swine Shall be allowed to runn at Large about the Village of Frankford during the year of 1848 if any Cattle or [erasure] horses Sheep or Swine running Contrary to this resolution the own Shall forfit and pay 5/ per head and the penaltys to be paid to the pathmaster and – Laid out by him on the Streets of the Said Village – all annimals trespassing or running Contrary to those – resolutions Shall beompaende[?d] and if they are not re[t]urned with in ten days by paying penaltys and damages and fees to pound Keeper Shall Sell to the hiest bider –
9th  Be it enacted that any person or persons harbering Keeping or feeding any Cattle horses Sheep or Swine Coming to or on his hers or thers premises Remaining for any longer period than Eight days – Shall not be entitled to any Compasian for So doing unless he She or they Shall within the Said period of eight days transmit to the Township Clerk – of the Township a notice in writing of Such Cattle horses Sheep or Swine describing the Collar and any per[?]u-lar Mark that might be on the Same and also any pound Keeper having in his custody any animals above Mentioned for trespass or otherwise and the owner Not Known Shall also Send a notice in writing to the Township Clerk of the Same – describing the Said animals within the period of eight days and Shall for his trouble in So doing receive from the owner thereof the Sum of 1/3 and Shall for his neglect in Sending Said notice forfit the pound and fees he might otherwise be entitled to recieve for the Same

The inhabitants to their annual town meeting to appoint a Suficient number of pound keepers
Pound keepers to be sworn into office before a justice of the peace within seven days of his appointment
In case of his refusal to act the councilors of the Respective Townships may appoint others who after being sworn in Shall act as pound keepers
