Calvin Roseberry Will of 1970

 

LAST WILL AND TESTAMENT OF CALVIN A. ROSEBERRY, SR.

I, Calvin A. Roseberry, Sr. of Pulaski, Virginia, being of sound and disposing mind and memory, do hereby make, publish and declare this to be my Last Will and Testament, hereby revoking all wills by me at anytime heretofore made.

FIRST:  I desire that all of my just debts be paid.

SECOND:  I hereby appoint my son, James Julius Roseberry and Adair Hall, Executors of this my will and I direct my executors hereby named, or either of them if both do not survive me, to sell at public or private sale all of my real estate and personal property wherever located upon such terms as they may deem feasible and practicable as soon after my death as practicable and after using so much of the proceeds of sale as required to pay the debts of my estate, distribute the remaining proceeds to my heirs according to the statute of descent and distribution.

Given under my hand this 7th day of May, 1970.

The above signature of the testator was made, and the foregoing will was acknowledged by the said testator, in the presence of us, two (2) competent witnesses, present at the same time, and we, the said witnesses, do hereunto subscribe the said will in the presence of the said testator and of each other at the  request of the said testator, this 7th day of May, 1970.

VIRGINIA:  IN THE CLERK'S OFFICE OF THE CIRCUIT COURT OF PULASKI COUNTY, MAY 21, 1970.

It appearing to the Clerk of the Circuit Court that Calvin A. Roseberry, Sr. of Pulaski, Virginia died on May 19, 1970, and a paper writing signed by the said Calvin A. Roseberry, Sr. dated May 7, 1970, and purporting to be the Last Will and Testament of the said Calvin A. Roseberry, Sr. having this day been produced before the Clerk of the Circuit Court, and proved according to law by the oaths of Betty P. Scott and Mildred A. Keller, the subscribing witnesses thereto, who said that the said Calvin A. Roseberry, Sr. signed and acknowledged said paper writing as and for his Last Will and Testament in his presence thereto, being present at the same time and in the presence of each other; whereupon it is ordered that the said paper writing be and the same hereby is, established, probated and admitted to record as and for the true last will and testament of the said Calvin A. Roseberry, Sr., deceased.

On motion of James J. Roseberry, one of the Executors named in the will, the Clerk doth appoint James J. Roseberry and T. Adair Hall as Co-executors of the Estate of Calvin A. Roseberry, Sr. and they have made oath as the law directs and entered into and acknowledged a a bond in the amount of Eight Thousand Dollars, ($8,000.00) conditioned and payable according to law, with Grace R. Hall as surety, and certificate is granted the said James J. Roseberry and T. Adair Hall, Co-executors for obtaining probate of said will in due form and letter of administration unto them as Co-executors as aforesaid.
