Charles Early Roseberry Will of 1978

 

I, CHARLES EARLY ROSEBERRY, being of sound and disposing mind and memory, do hereby make, publish and declare this to be my last will and testament hereby revoking all other wills and codicils by me at any time made. My will is as follows:

FIRST: I direct that all my just debts shall be paid as soon after my decease as conveniently may be.

SECOND: I direct that my funeral expenses shall be paid from Continental Assurance Company Group Life Policy No. G‑374 in the sum of $1,500.00 as soon after my decease as con­veniently may be.

THIRD: I do hereby give, devise and bequeath unto my wife, Beatrice Thornton Roseberry, all of my estate and property of whatever kind, nature and description, real, personal and mixed, and wheresoever situated, to be hers absolutely and in fee simple should she survive me. In the event that my said wife predeceases me, or in the event that my said wife and I should die or be killed in or as a result of one accident or common calamity: I hereby devise and bequeath all of my property, real, personal and mixed unto my children, Ruth Roseberry Bain, Pauline Roseberry Smart and Joyce D. W. Smith, equally, share and share alike.

 FOURTH: I do hereby nominate and appoint Cecil Edward Bain and Ruth Bain, Executors of‑this my last will and testament and having full faith in their integrity, I direct that they be allowed to qualify without surety.

IN WITNESS WHEREOF, I hereunto subscribe my name and affix my seal to this my last will and testament in Radford, Virginia, this the 29th day of 1974.

The above signature of the testator was made, and the foregoing will acknowledged by the said testator in the presence Of us, three competent witnesses, present at the same time; and we the said witnesses, do hereunto subscribe the said will in the presence of the said testator and of each other, at the request of the testator, he being then of sound mind and over the age of twenty‑one years.

VIRGINIA: In the Clerk's Office of the Circuit Court of the City of Radford the 13th day of September, 1978

In re: Will of CHARLES EARLY ROSEBBERRY

A paper writing bearing date November 29, 1974, purporting to be the will of Charles Early Roseberry, deceased, was on September 11, 1978, presented by Beatrice Thornton Roseberry, widow of the decedent, and offered for probate.

It appearing that Charles Early Roseberry resided in the City of Radford, Virginia, and that he died August 17, 1978, Virgil Franklin, one of the subscribing witnesses to said paper writing, being first duly sworn, deposed and said that he and Debra Y. Altizer and Randolph D. Eley, Jr., the other subscribing witnesses to said paper writing, were present together at the same time and in the presence of Charles Early Roseberry, when he, the testator, signed the said paper writing and acknowledged it to be his will, and that they, at his request, in his presence and in the presence of each other, signed their names thereto as subscribing witnesses.

Thereupon the said paper writing dated November 29, 1974, consisting of two typewritten pages, is established and adjudged to be the last will and testament of Charles Early Roseberry, deceased, and is ordered to be recorded as such, however, no personal representative is appointed insomuch as the said will be recorded only to effect the transfer of real property hereunder.
