Charles Wesley Roseberry Will of 1984

 

LAST WILL AND TESTAMENT

 

I, CHARLES WESLEY ROSEBERRY, of Radford, Virginia, being of sound and disposing mind and memory, do hereby make, publish and declare this to be my Last Will and Testament, hereby revoking all wills and codicils made by me at any time heretofore.  My will is as follows:

FIRST: I direct that all my just debts and funeral expenses be paid as soon after my decease as conveniently may be.

SECOND: All the rest, residue and remainder of my property, real, personal and mixed, of whatever nature and kind and wheresoever situated, I hereby give, devise and bequeath to the following persons in the following proportions: 1/5 share to Margaret Lawton; 1/5 share to James C. Roseberry; 1/5 share to Mary Ellen Richardson; 1/5 share to be divided equally bet­ween Resa Roseberry, Gregory Roseberry and Betty Lindsoe; 1/15 share to Allyne Roseberry; and 2/15 to be divided equally bet­ween Donnie Roseberry, Byron Roseberry and Mychelle Roseberry.

THIRD: I hereby nominate and appoint the said Margaret Lawton and James C. Roseberry to be Executors of this my Last Will and Testament and direct that no security or surety be required of them while acting in their capacity as Executors.

IN WITNESS WHEREOF, I hereunto subscribe my name and affix my seal to this my Last Will and Testament, in the City of Radford, Virginia, on this 6th day of July, 1976.

The above signature of the testator was made and the foregoing Will was acknowledged to be his Last Will and Testament by the said testator, in the presence of us, three competent witnesses, present at the same time; and we, the said witnesses, do hereunto subscribe the said will on the date last above writ­ten in the presence of the said testator and of each other, at the request of the said testator, he being then of sound mind and over the age of twenty‑one years.

VIRGINIA: In the Clerk's Office of the Circuit Court of the City of Radford the 23rd day of February, 1984

In re: Will of CHARLES WESLEY ROSEBERRY, Deceased

A paper writing bearing date July 6, 1976, purporting to be the will of Charles Wesley Roseberry, deceased, was this day presented by Margaret Lawton and James C. Roseberry, the Executors named therein, and offered for probate.

It appearing that Charles Wesley Roseberry resided in the City of Radford and that he died February 20, 1984, Diana M. Clark, one of the subscribing witnesses to the paper writing dated July 6, 1976, being first duly sworn, deposed and said that she and R. H. Bryant and Jimmie V. Jenkins, the other subscribing witnesses to said paper writing, were present together at the same time and in the presence of Charles Wesley Roseberry when he, the testator, signed the said paper writing and acknowledged it to be his will, and that they, at his request, in his presence and in the presence of each other, signed their names thereto as subscribing witnesses; and that the testator was at that time over twenty‑one years of age and capable of making a will.

Thereupon the said paper writing dated July 6, 1976 consisting of one and one‑third typewritten pages, is established, and adjudged to be the last will and testament of Charles Wesley Roseberry, deceased, and is ordered to be recorded as such.

Thereupon Margaret Lawton and James C. Roseberry who were named as Executors in the Will asked permission to qualify as such, whereupon, such permission being granted, they appeared, made oath as the law directs, and entered into and acknowledged a bond as such Executors in the penalty of $41,000.00, payable and conditioned according to law, but without security, the will requesting that none be required.

And certificate is granted Margaret Lawton and James C. Roseberry for obtaining a probate of the said will of Charles Wesley Roseberry, deceased, in due form.
