Elbert E. Howell Will of 1964

 

I, E. E. HOWELL, being of sound and disposing mind, do hereby make, publish and declare this to be my Last Will and Testament, hereby revoking all wills by me at any time heretofore made.

FIRST: I desire all my just debts to be paid, if I should owe any debts at the time of my death.

SECOND: I give, devise and bequeath all of my property, real and personal, to my wife, Bertha Howell, for and during her natural life, and at the death of the said Bertha Howell to my daughter, Byra Howell, for and during her natural life, and at the death of the said Byra Howell I give, devise and bequeath my said property to my children, or their heirs, equally and ratably, in fee simple.

THIRD: I hereby nominate and appoint my said daughter, Byra Howell, Executrix of this my Last Will and Testament, and request that no surety be required on her bond.

Given under my hand and seal this 11 day of October, 1951.

The above signature of the testator was made, and the foregoing will was acknowledged by the said testator in the presence of us, two competent witnesses present at the same time; and we, the said witnesses, do hereunto subscribe the said will in the presence of the said testator and of each other, at the request of the said testator, this 11 day of October, 1951.

VIRGINIA: In the Clerk's Office of the Circuit Court of the City of Radford, the 3rd day of April, 1964

In re: Will of E. E. Howell, deceased

A paper writing bearing date the 11th day of October, 1951, purporting to be the will of E. E. Howell, deceased, was this day presented by Byra Howell, the executrix named therein, and offered for probate.

It appearing that E. E. Howell, resided in the City of Radford, Virginia, and that he died testate on March 24, 1964, Cornelia D. Campbell, one of the two subscribing witnesses to said paper writing, being first duly sworn, deposed and and said that she and Ted Dalton, the other subscribing witness to said paper writing, were present together at the same time and in the presence of E. E. Howell, when he, the testator, signed the said paper writing and acknowledged it to be his will and that they, at his request, in his presence and in the presence of each other, signed their names thereto as subscribing witnesses; and that the testator was at that time over twenty‑one years of age and capable of making a will.

Thereupon the said paper writing dated October 11, 1951, consisting of one typewritten page, is established and adjudged to be the last will and testa­ment of E. E. Howell, deceased, and is ordered to be recorded as such.

Thereupon, Byra Howell, the executrix named therein, appeared, made oath as the law directs, and entered into and acknowledged a bond as such executrix in the penalty of $1,500.00, payable and conditioned according to law, but without security, the will requesting that none be required.

And certificate is granted Byra Howell for obtaining a probate of the said Will of E. E. Howell, deceased, in due form.

It is ordered that John L. Whitehead, William A. Caldwell, Ralph W. Corn and A. R. Giesen, any three of whom may act, be, and they hereby are, appointed appraisers of the estate of E. E. Howell, deceased.

I, the undersigned, who this day qualified before the Clerk of the Circuit Court of the City of Radford as Executrix of the estate of E. E. Howell, deceased, late of the City of Radford, Virginia, on my oath do say that I have made diligent inquiry and that I believe the following to be a true and correct list together with the ages and the addresses of the heirs of my decedent E. E. Howell who died testate on March 24, 1964.
