Elizabeth Sutton Roseberry Will of 1973

 

I ELIZABETH C. ROSEBERRY, better known as Lizzie Roseberry, residing at 1104 Fifth Street, Radford, Virginia, being of sound and disposing mind, do hereby make, publish and declare this to be my last will and testament, hereby revoking any and all wills heretofore made by me.

            FIRST: I direct all my just debts be paid.

SECOND:  I hereby leave, bequeath and devise to my husband, Charles Wesley Roseberry, all my real and personal estate for life, and having full confidence in him, I authorize him to use so much of the corpus of my estate as he shall find necessary for his comfort and maintenance, and at his death, whatever remains undisposed of, if any, I desire shall be equally divided among my children, and the two children of my deceased son, Charlie Roseberry, to take his share per stirpes.

THIRD: I hereby declare that any portion of my estate that remains undisposed of, as hereinabove provided, that consists of any household articles or gifts made by any of my children, shall at my death be returned to such child making the same.

FOURTH:  I hereby nominate and appoint my said husband, Charles Wesley Roseberry, as Executor of this my last will and testament; and I direct that no security be required of my said husband as Executor.

Given under my hand this 31 day of March, 1964.

The above signature of the testatrix was made and the foregoing will was acknowledged to be her last will and testament by the said testatrix, in the presence of us, two competent witnesses, present at the same time; and we, the said witnesses, do hereunto subscribe the said will on the date last above written, in the presence of the testatrix and of each other, at the request of the said testatrix, who was then of sound mind and over the age of twenty‑one years.

In re: Will of Elizabeth C. Roseberry (better known as Lizzie Roseberry), deceased

A paper writing bearing date the 31st day of March, 1964, purporting to be the will of Elizabeth C. Roseberry (better known as Lizzie Roseberry), deceased, was this day presented and offered for probate.

It appearing that Elizabeth G. Roseberry (better known as Lizzie Roseberry) resided in the City of Radford. and that she died November 26, 1973, G. Garland Wilson, one of the subscribing witnesses to said paper writing, being first duly sworn, deposed and said that he and Joyce L. Poff, the other subscrib­ing witness to said paper writing, were present together at the same time and in the presence of Elizabeth C. Roseberry (better known as Lizzie Roseberry) when she, the testator, signed the said paper writing and acknowledged it to be her will, and that they, at her request, in her presence and in the presence of each other, signed their names thereto as subscribing witnesses; and that the testator was at that time over twenty‑one years of age and capable of making a will.

Thereupon the said paper writing dated March 31, 1964, consisting of one typewritten page, is established and adjudged to be the last will and testament of Elizabeth C. Roseberry (better known as Lizzie Roseberry), deceased, and is ordered to be recorded as such.
