Francis Godbey Will of 1864

Will of Francis Godbey.

I, Francis Godbey, of the County of Pulaski and State of Virginia, considering the uncertainty of this frail and transitory life, do make, publish and declare this my last will and testament in manner and form following: That is to say:

Desiring to make a final disposition of all my property, real and personal, of which I am possessed,  I hereby give and bequeath (after all my funeral expenses shall have been paid together with my just debts if any) to my son Reason V. Godbey all of my property both real and personal with the understanding and request that my beloved wife, Rhoda, shall during her natural life hold and enjoy one third of all my property bequeathed above and at her death to become the property of my said son Reason V. Godbey.

The object of the testator in making this bequest to my said Son, Reason V. Godbey, is in consideration of the great trouble and expense already incurred in the maintenance of the testator and his beloved wife, Rhoda, and to forever release my son Reason V. Godbey from the payment of any sum, or sums of money that may hereafter be claimed by any of my children as due and coming to them by any former bequest of mine.

The foregoing bequest is subject to the rights of my beloved wife, Rhoda, as already mentioned and my will and desire is that my executor shall assign her dower in my land including the dwelling house.

I do hereby constitute and appoint my son, Reason V. Godbey, Executor of this my last will and testament hereby revoking all former wills by me at any time made.

In testimony whereof I have hereunto set my hand and affixed my seal this 18th day of April, 1864.
