Roseberry Will of 1951
LAST WILL AND
TESTAMENT OF HOUSTON ROSEBERRY
I, HOUSTON ROSEBERRY, of Pulaski County, Virginia,
being of sound and disposing mind and memory, do hereby make, constitute,
publish and declare this to be my last will and testament, hereby revoking all
former wills or testamentary dispositions of any kind heretofore by me made.
FIRST: I direct that all my just debts and funeral
expenses be paid as soon after my death as practicable.
SECOND: I give, devise, and bequeath all of my
entire estate both real and personal, and wherever situate, absolutely and in
fee simple, to my beloved wife, Ada Roseberry, to the express exclusion of all
children now born or hereafter to be born to me.
THIRD: I nominate and appoint my wife, Ada
Roseberry, as the Executrix of this my last will and testament and direct that
no surety be required on her bond as Executrix aforesaid.
Given under my hand and seal this 23rd
day of July, 1951.

The
above signature of the testator was made and the foregoing will, consisting of
one page was acknowledged to be his last will and testament by the said
testator, in the presence of us, two competent witnesses, present at the same
time; and we, the said witnesses, do hereby unto subscribe the said will on the
date last above written, in the presence of the said testator and of each
other, at the request of the said testator, who was then of sound mind and over
the age of twenty-one years.

It
appearing that Houston Barclay Roseberry died on April 29, 1953, and that the
said Houston Barclay Roseberry at the time of his death was a resident of the
County of Pulaski, Virginia; and a paper writing signed by the said Houston
Barclay Roseberry bearing date on the 23rd day of July, 1951, was this day
produced before the Clerk of the Circuit Court of Pulaski County, Virginia, for
probate, and Nannie Roseberry, one of the subscribing witnesses thereto was
sworn and testified that the said testator signed and acknowledged said paper
writing to be his last will and testament in her presence and in the presence
of Myra Roseberry, the other subscribing witness thereto, they being together
at the same time and in the presence of the testator; whereupon, said paper
writing is ordered to be recorded as and for the true last will and testament
of the said Houston Barclay Roseberry, deceased.
On
motion of Ada Roseberry, the executrix named in said will, who made oath as the
law directs and entered into and acknowledged a bond in the penalty of One
Thousand ($1000.00) Dollars, conditioned any payable according to law, but
without surety, said will directing that no surety on said bond be required,
certification is granted the said Ada Roseberry for obtaining letters of
administration on the estate of Houston Barclay Roseberry, deceased.

the undersigned, who this day qualified before the Clerk of the Circuit Court
of the County of Pulaski as Executrix of the estate of HOUSTON BARCLAY
ROSEBERRY, deceased, late of the County of Pulaski, Virginia, on my oath do say
that I have made diligent inquiry and that I believe the following to be a true
and correct list together with the ages and the addresses of the heirs of my
decedent HOUSTON BARCLAY ROSEBERRY who died testate on April 29, 1953.
