John Carper Will of 1842

 

Carper Will.

In the name of God amen.  I John Carper of the County of Pulaski and State of Virginia am now weak in body  but sound in mind and memory do on this twenty eighth day of March one thousand eight hundred and forty two, do constitute this my last will and testament as follows, I first order that all my just depts be paid if any, and next my funeral expense; I first give and bequeath unto my two Sons that is Frederick Carper and Henry Carper one draw of my pension money that is forty eight dollars to be equilly devided between them-all the balance my estate I give and bequeath to my son John Carper all that I have now in my possession to manage or dispose of as he may see proper.  As for the balance of  my children I have given unto them all I intend them to get.  I now do appoint my son John Carper Executor of this my last will and testament, Signed and acknowledged by me the testator the year and date first above written in the presents of us.

Virginia:  At a Court held for the County of Pulaski the 10th day of July 1845.

John Carper against Elias S. Barger & George Rutter

On a motion for a probate of the last Will & Testament of Jno. Carper Dec'd

            This day came the parties by their attornies and thereupon Several witnesses were examined as well for the plaintiff as the Defendants, and the parties by their counsel fully heard, on consideration whereof the court is of opinion that the said will be admitted to record, the same having been proven by Richard Guthrie and Amos Spear subscribing witnesses thereto, and on the motion of John Carper the Executor therein named, who made oath thereto and together with Richard Guthrie his Security entered into & acknowledged a bond in the penalty of $600 conditioned as the law directs, certificate is granted him for obtaining a probate thereof in due form.
