John King, Wythe Co., VA Will of 1802

 

 

I, John King of the County of Wythe in the State of Virginia do hereby make my last will & Testament in manner and form following that is to say

1st.  I desire that all the perishable part of my Estate be immediately sold after my decease & out of the money arising therefrom all my Just debts and funeral Expences be Justly paid & discharged.

2nd.  After the payment of my Just debts and funeral Expences I give & bequeath to my wife Savinah one third part of my Estate Real and personal & to have the priviledge to one half of the dwelling house at either appartment that she may think proper to choose & also one half the use and benefit of the fruit trees on the plantation whereon I now live during her the said Savinah natural live.

3rd.  I give to my son William King all my plantation & Tract of Land whereon I now live to have Occupy & possess the same whole & enters after at the decease of my wife & also twenty five acres of Land Adjoining thereto part of which Includes Grubs Old Mill dam & it is my will and order that out of the money arising from the sale of my personal Estate that John King, Peter Kinsor (constitute & appoint to be my Executors of this my last will & Testament) do pay to each of my daughters Elisabeth, Nancy, Ann, Barbara & Katharine the sum of two hundred & sixty six Dollars & seventy cents & it is my will that my Executors sell my survey of Land Containing one hundred acres lying on Stoshies Run & distribute the price thereof in common with my other money & property as hereafter directed.  That is to say that my Executors after the payment of the above mentioned sum to each of my Daughters do collect all the surplus of my personal Estate and make an equal Distribution thereof amongst all children male & female & it is my will and Order that William King my youngest son at any time within the space of three years after he shall arrive at the age of twenty one years shall pay into the hands of my Executors the sum of one hundred and sixty six dollars & two thirds of a dollar in consideration of and for the plantation & tract of Land above bequeathed to him which sum of Fifty pounds my Executors is hereby authorised & required to distribute equally among my heirs male & female.  And where I have kept a regular account of all the money & property by me given to any of my Children heretofore & it being my intention to keep an account of any money or property that I may hereafter during my life give to any on my heirs & it being my will & most earnest desire to do equal justice to all my children alike, I therefore will & Require my Executors to pay due regard to my accounts that may appear against any of my heirs in such manner that they may be oblidged to give Credit to my estate for the amount of such accounts & this to be understood that it is my will & intention that the eighty pounds above bequeathed to each of my Daughters and the Lands heretofore coveyed to each of my sons be considered equal & that the surplus of my Estate be so Distributed as to make all my heirs as nearly equal as possible or as the circumstances of my estate will admit and it is my further will & order that notwithstanding Any thing heretofore expressed my wife Savinah shall have her bed and furniture and all the pewter now belonging to the Kitchen or Table Furniture during her life & at her decease to be disposed of as she may think proper which last mentioned property my executors is hereby required and Enjoined not to bring forward to be appraised or sold but it is to be understood that the one third part above devised to her shall at her the said Savinah death descend & equally distributed among my heirs male & female & I do hereby make null and void all & every other or former wills and declare this to be my last will & Testament in witness I have hereunto set my hand & seal this 7th day of November 1802.

This last will and Testament of John King Deceased was produced in Court and proved to be the act and deed of the said John King deceased by the oaths of William Ward & Isaac Grub subscribing witnesses thereto & Ordered to be Recorded.
