Last
Will and Testament
I, MOODY T. KEISTER,
being of sound and disposing mind and memory, do hereby make, publish and
declare this to be my Last Will and Testament, hereby revoking all other wills
by me at any time made.
FIRST: I desire all my
just debts to be paid if I should owe any debts at the time of my death. And I
do give full power and authority to my Executor to sell and convey my real
estate for the purpose of paying my debts and without any liability on the
purchaser to see to the proper application of the purchase price.
SECOND: I give, devise
and bequeath to my beloved wife, CLISTIA P. KEISTER, the following designated
lots as shown on a map of the Radford Development Company's Map of Lots for the
City of Radford, Virginia, namely, all of Lots 21 and 22, Section 26.
THIRD: I do further give,
devise and bequeath to my said wife, Clistia P. Keister, my home and residence,
with all the household furniture and goods therein, together with the
following lots annexed thereto, namely, all of Lots 17, 18, 19 and 20, Section
26 as shown on a map of the Radford Development Company's Map of Lots for the
City of Radford, Virginia, to have and to hold the same for and during her
life, or so long as she remains my widow, and upon her death or remarriage,
whichever event occurs first, then upon that event, I direct my Executor
hereinafter named, to sell said property at public or private sale at such a time
and upon such terms as he shall deem proper, and distribute the proceeds
therefrom equally among my three children, namely, EDSEL TALMADGE KEISTER,
NELSON BRIEN KEISTER and MERLE THOMAS KEISTER. And I do give full power and
authority to my Executor to sell and convey this real estate at any time during
the lifetime of my said widow providing he is requested to do so, by my said
widow and my sons, Edsel Talmadge Keister and Merle Thomas Keister; my said
wife to have a life estate in the funds from the sale of said property, and at
her death or remarriage, the Executor is to distribute the proceeds therefrom among my three (3) children.

FOURTH: I hereby nominate
and appoint my son, EDSEL TALMADGE KEISTER, Executor of this my Last Will and
Testament, and with full power and authority to execute the same according to
its true and intended meaning, and having perfect confidence in his judgment
and integrity, I direct that the said Executor shall not give security.
Given under my hand this 15th
day of November, 1966.

The above signature of
the testator was made and the foregoing will was acknowledged to be his last
will and testament by the said testator in the presence of us, three competent
witnesses present at the same time, and we, the said witnesses, as attesting
witnesses hereunto subscribe the said will on the date last above written in
the presence of the said testator at the request of the said testator who was
then of sound mind and over the age of twenty‑one years.

IN THE CLERK'S OFFICE OF THE CIRCUIT COURT OF THE
CITY OF RADFORD THE 9th DAY OF SEPTEMBER, 1976
In re: Will of MOODY
TALMAGE KEISTER, Deceased
A paper writing bearing
date the 15th day of November, 1966, purporting to be the will of Moody Talmage
Keister, deceased, was this day presented by Edsel Talmage Keister, the
Executor named therein, and offered for probate.
It appearing that Moody
Talmage Keister resided in the City of Radford, Virginia, and that he died
August 31, 1976, Agnes Lawrence (now Dobbins), one of the subscribing witnesses
to said paper writing, being first duly sworn, deposed and said that she and
Shirley B. Simpson and Norma L. Hornbarger, the other subscribing witnesses to
said paper writing, were present together; at the same time and in the presence
of Moody Talmage Keister when, he, the testator, signed the said paper writing
and acknowledged it to be his will, and that they, at his request, in his
presence and in the presence of each
other, signed their names
thereto as subscribing witnesses.
Thereupon the said paper
writing dated November 15, 1966 consisting of one and one‑half
typewritten pages, is established and adjudged to be the last will and
testament of Moody Talmage Keister, deceased, and is ordered to be recorded as
such.
Thereupon Edsel Talmage
Keister, the Executor named therein asked permission to qualify as such,
whereupon, such permission being granted, he appeared, made oath as the law
directs, and entered into and acknowledged a bond as such Executor in the
penalty of $1,000.00, payable and conditioned according to law,
but without security, the will requesting that none
be required.
And certificate is
granted Edsel Talmage Keister for obtaining a
probate of the said will of Moody Talmage Keister, deceased, in due form.

this day qualified before the Clerk of the Circuit Court of the City of Radford
as Executor of the estate of Moody Talmage Keister, deceased, late of the City
of Radford, Virginia, on my oath do say that I have made diligent inquiry and
that I believe the following to be a true and correct list together with the
ages and the addresses of the heirs of my decedent Moody Talmage Keister who
died testate on August 31, 1976.
