Nancy Fortner Roseberry Will of 1952
LAST WILL AND TESTAMENT OF NANCY G.
ROSEBERRY
I,
Nancy G. Roseberry, of Pulaski, Virginia, being of sound and disposing mind and
memory, do hereby make, publish and declare this to be my last will and
testament, hereby revoking all wills, or codicils to wills by me at anytime
heretofore made.
FIRST: I direct that all my just debts be paid as
soon as possible after my death.
SECOND: I give, devise and bequeath all of my
property, both real and person, and howsoever evidenced or wheresoever situate,
to my husband, George M. Roseberry, during his lifetime, and at his death, the
real estate and so much of the personal property as has not been expended by my
husband, George M. Roseberry, during his lifetime, shall pass and descend
equally and jointly in fee simple to my two (2) stepchildren, Annabelle
Roseberry Bane and Charlie M. Roseberry, or to the survivor, if either of them
should predecease me; that is to say, should either of my said two (2)
stepchildren die before I do, then the entire remainder of my estate shall pass
to the surviving stepchild, after the death of my husband, George M. Roseberry.
THIRD: In the event my husband, George M.
Roseberry, should predecease me, then my entire estate, both real and personal,
and howsoever evidenced or wheresoever situate, I give, devise and bequeath
absolutely and in fee simple equally and jointly to my two (2) stepchildren,
Annabelle Roseberry Bane and Charlie M. Roseberry, or to the survivor, if
either of them should predecease me, that is to say, should either of my said
two (2) stepchildren die before I do, my entire estate shall pass to the
surviving stepchild.
FOURTH: I nominate and appoint Charlie M. Roseberry
as executor of this, my last will and testament.

The
above signature of the testatrix was made and the foregoing consisting of two
pages was acknowledged to be her last will and testament by said testatrix in
the presence of us, three competent witnesses, present at the same time; and
we, the said witnesses, do hereunto subscribe the said will on the date last
above witten in the presence of the said testatrix and of each other at the
request of the said testatrix who was then of sound mind and over the age of
twenty-one years.

VIRGINIA: IN THE OFFICE OF THE CLERK OF THE CIRCUIT
COURT OF PULASKI COUNTY, AUGUST 18th, 1966
It
appearing that Nancy G. Roseberry died on May 14, 1964, and at the time
thereof, she was a resident of Pulaski County, Virginia, and a paper writing signed
by the said Nancy G. Roseberry, dated July 29, 1952, and purporting to be her
true last will and testament, having this day been produced before the Clerk of
the Circuit Court of Pulaski County, Virginia, and proved according to law by
the oath of Eugene L. Nuckols, one of the subscribing witnesses thereto, who
was sworn and testified that the said Nancy G. Roseberry signed and
acknowledged said paper writing as and for her true last will and testament in
his presence and in the presence of John W. B. Deeds and Sarah G. Slaydon, the
other subscribing witnesses being present at the same time and in the presence
of each other, where upon it is ORDERED that the said paper writing be, and the
same hereby is, established, probated and admitted to record as and for the
true last will and testament of the said Nancy G. Roseberry, deceased.
On
motion of Annabelle Roseberry Bain, the beneficiary under said will, the
Executor named therein having died, the Clerk doth appoint Alan D. Groseclose,
Administrator, c. t. a. of the estate of the said Nancy G. Roseberry, deceased,
whereupon, the said Alan D. Groseclose, who made oath as the law directs and
together with A. Dow Owens, as his surety, entered into and acknowledged a bond
of the penalty of One Thousand ($1,000.00) Dollars, conditioned and payable
according to law, and certificate is granted the said Alan D. Groseclose for
obtaining probate of said will in due form and letters of administration are
granted unto him as Administrator, c. t. a. of the estate of the said Nancy G.
Roseberry, deceased.

and correct llist together with the ages and the addresses of the heirs of the
decedent Nancy G. Roseberry who died testate on May 14, 1964.
