Peter Keister Will.
The
last will and testamoney of Peter Keister of Montgomery County & State of
Virginia in the name of God. I Peter
Keister considering the uncertainty of this mortal life & being of sound
mind and memory blessed be almighty God for the same do make and publish this my last will &
testament in manner and form following.
I give & bequeath unto my sixth son Henry Keister his heirs &
assigns the plantation I now reside on, lying and being in the County of
Montgomery & State of Virginia on the waters of Toms Creek, after my decest
and my beloved wife's Elizabeth Keister.
I further give and bequeath unto my sixth son Henry Keister all my land
lying in Rockingham County on Foutes branch.
I also give and bequeath unto my sixth son Henry Keister all my moveable
estate with the exception of a certain parcel of moveable property that belongs
to my too daughters Susanah Keister and Cathrine Keister that is to say too bedes
& beding, one beaurogh, one cherry press, one clock, one horse beast, too
milkes cowes & too tabels belonging to Susanah Keister & too bedes
& beding, one bearough, one corner cuberd, too tabels, one candelstand, too
milkes cowes, one bay mar belonging to Cathrine Keister. I further order that my son Henry Keister
payes to the resprectiv legatees in three years after myne and my beloved wife
Elizabeth Keister decest that is to say $75 to Elizabeth Price & too
hundred to Susanah Keister & one hundred dollars to Jacob Keister &
Seventy five Dollars to Sarahan Barger & fifty Dollars to Marrey Barger and
too hundred to Cathrine Keister & one hundred dollars to Peter Keister
& one hundred dollars to John P.
Keister and one hundred Dollars to David Keister, too hundred Dollars to Allan
Keister which said several legacies or sumes of money I will & order to be
paid to the said respective legatees within three years after ower decestes and
if my said son Henry Keister should fail to pay the sixteen sumes of money to
the legatees against the time mentioned I order that the plantation I now
reside on shall be sold & thes paymentes to be paid & I further order
my son Henry Keister shall be paid four hundred dollars with intrust from
February the ninth Eighteen hundred & thirty nine until paid out of the
land money. I further will and order
that my son Henry Keister shall have too hundred dollars out of the land money
provided the plantation is sold. I
further will & order my son Henry Keister shall & will furnish me Peter
Keister & my beloved wife Elizabeth Keister with good meat bread &
apparel during ower lives and lastly I give & bequeath unto my son Henry
Keister all the remainder of my goodes and chattels of what wer kind &
maure soever I give & bequeath the same to my said son Henry Keister whom I
hereby appoint executrix. I also
appoint my secent eldest son Peter Keister executrix of this my last will and
testament hereby revoking all former wills by me maid in witness whereof I have
hearunto set my hand and seal this 12 day of June 1839.

At a court held for
Montgomery County the 3rd day of February 1840.
This
last will and testament of Peter Keister deceased was presented in court &
proven by the oaths of George Knode & Thomas Holley two of the witnesses
thereto subscribed & ordered to be recorded. And on the motion of Henry Keister the executor therein named who
made oath & together with George P. Pepper, Peter Keister & Israel
Harless his securities entered into & acknowledged a bond in the penalty of
$5000 conditioned as the law directs. A
certificate is granted him for obtaining a probate of said will in due form.
