Richard Burnop Will of 1878

 

R. Burnop Will. 

I, Richard Burnop, considering the uncertainty of life and the certainty of death, but of sound and disposing mind do make and ordain this my last will and testament hereby revoking all former wills by me at any time made.

I direct that all my just debts be paid by my Executors and of the sale of my personal property and the debts due me, and if the money of the sale of property mentioned above be insufficient, then my Executors are directed to sell so much of my realty as will meet all deficiency.

I give and devise to my beloved wife Margaret Burnop all of my real estate lying and being in the County of Carroll and state of Virginia and further give and devise to my beloved wife Margaret Burnop two milch cows of the stock of cows on hand and now on the farm where I reside.  I appoint my son R. Thompson Burnop Executor of this my last will and testament, I hereby direct that he shall not be obliged to give bond on his qualification.  In testimony whereof I have to this my last will consisting of one half sheet of foolscap paper set my hand and seal and subscribed my name to the proceeding, this 24th day of September Eighteen hundred and seventy eight,

Virginia:  At a Court held for Smyth County 21st April 1879

     The within last will and testament of Richard Burnop, deceased, was presented in Court, partly proven by James Clark one of the subscribing witnesses thereto and Continues for further proof.  And at a Court heard for said County on the 16th day of June 1879, the within last will and testament of Richard Burnop, deceased, was again presented in Court and fully proven by the oath of R. D. Hufferd, subscribing witness thereto and ordered to be recorded.

     The foregoing copy of the last will and testament of Richard Burnop, deceased, was this day presented in Court, and being properly authenticated, was ordered to be recorded.
