Walter Roseberry Will of 1962
LAST
WILL AND TESTAMENT OF WALTER J. ROSEBERRY.
I, Walter J. Roseberry, of Pulaski County, Virginia, being of sound mind
and disposing memory, do hereby make, publish and declare this, my last Will
and Testatment, and by the signing hereof, revoke any other Wills or papers of
a testamentary character which might have heretofore been made by me.
FIRST:
I direct that my body be decently buried.
SECOND:
I direct that all of my just debts be paid as soon as practical after my death.
THIRD: I give, devise and bequeath all of my real
property wheresoever situate to my wife, Mary J. Roseberry, for the term of her
natural life, together with the absolute right to dispose of the same during
her lifetime, but if the said Mary J. Roseberry does not dispose of all of my
real property during her lifetime, then at her death I give, devise and
bequeath the remainder thereof to my son, Richard L. Roseberry.
FOURTH: All the rest, residue and remainder of my
estate I give and bequeath unto my wife, Mary J. Roseberry.
FIFTH: I hereby nominate, constitute and appoint my
son, Richard L. Roseberry, to be the Executor of this my Last Will and
Testament and direct that no surety be required on his bond in this capacity.

VIRGINIA: IN THE OFFICE OF THE CLERK OF THE CIRCUIT
COURT OF PULASKI COUNTY, MAY 19, 1964
It
appearing that Walter J. Roseberry died on April 7, 1964, and at the time
thereof, he was a resident of Pulaski County, Virginia, and a paper writing
signed by the said Walter J. Roseberry, dated June 21, 1962, and purporting to
be his true last will and testament, having this day been produced before the
Clerk of the Circuit Court of Pulaski County, Virginia, and proved according to
law by the oath of Naomi R. Stewart, one of the subscribing witnesses thereto,
who was and testified that the said Walter J. Roseberry signed and acknowledged
said paper writing as and for his true last will and testament in her presence
and in the presence of Philip M. Sadler and C. Charlene Frost, the other subscribing
witnesses thereto, the said Walter J. Roseberry and all three (3) of said
subscribing witnesses being present at the same time and in the presence of
each other; whereupon, it is ORDERED that the said paper writing be, and the
same hereby is, established, probated and admitted to record as and for the
true last will and testament of the said Walter J. Roseberry, deceased.
On
motion of Richard L. Roseberry, the Executor named in said will who made oath
as the law directis and entered into and acknowledged a bond in the penalty of
Two Thousand ($2,000.00) Dollars, conditioned and payable according to law, but
without surety, said will directing that no surety be required, and certificate
is granted the said Richard L. Roseberry for obtaining probate of said will in
due form and letters of administration are granted unto him as Executor
aforesaid.

with the ages and addresses of the heirs of my decedent Walter J. Roseberry who
died testate on April 7, 1964.
