William Roseberry Will of 1964
LAST WILL AND
TESTAMENT OF W. M. ROSEBERRY
I,
W. M. Roseberry, of Pulaski County, Virginia, being of sound and disposing mind
and memory, do hereby make, constitute, publish and declare this to be my last
will and testament, hereby revoking all former wills or testamentary
dispositions of any kind heretofore by me made.
FIRST: I direct that all my just debts and funeral
expenses be paid as soon after my death as practicable.
SECOND: I give, devise and bequeath to my daughter
Gladys Bratton four (4) acres of land fronting on the waters of Claytor Lake in
what is known as Dublin Hollow.
THIRD: I give, devise and bequeath to my son, Emory
Roseberry, seven (7) acres of land fronting on Virginia State Route #661,
surrounding the lot on which his residence is located.
FOURTH: I give, devise and bequeath to my son Clifton Roseberry seven (7)
acres of land adjoining the tract herein devised to Emory.
FIFTH: I give, devise and bequeath to my son,
Gerald Roseberry seven (7) acres of land laying between the four (4) acre tract
herein above devised to Gladys and the seven (7) acre tract hereinabove devised
to Clifton.
The
four (4) tracts of land above mentioned are each subject to a twenty foot wide
right-of-way extending from Virginia State Route #661 to the waters of Claytor
Lake at Dublin Hollow, following and adjacent to the property line of Mrs. H.
B. Roseberry.
SIXTH: I give, devise and bequeath to my son, Ellis
Roseberry the land surrounding his house on the west side of Route #661 and
extending westward to the waters of Claytor Lake.
SEVENTH: I give, devise and bequeath to my daughter,
Berlyn Roseberry, my dwelling house and all of the furniture therein with two
(2) acres of land surrounding the same.
EIGHTH: The rest of my land I give, devise and
bequeath to my daughter, Berlyn Roseberry, and my son, Gerald Roseberry,
equally and jointly, to share and share alike.
NINTH: If my money in bank is not sufficient to pay
my debts and funeral expenses then I direct that my livestock, or so much
thereof as my be necessary, be sold in order to discharge all valid
obligations. Any money remaining on
hand, or in bank, and all livestock not sold, together with all the rest, and
remainder of my estate, I give and bequeath to my daughter, Berlyn, and my son,
Gerald, equally, share and share alike.
TENTH: I nominate and appoint my son, Gerald
Roseberry, as the Executor of this my last will and testament and direct that
he act without surety on his bond as Executor aforesaid.
Attached hereto is
a rough sketch indicating the divisions of my real estate which I am sure all
of the children will understand.

I have hereunto set my hand and seal at Pulaski, Virginia, this____day of
