KNOW all MEN by these PRESESNTS, that we Susana Klauser widow and relict of Edward Klauser late of Rockland Township Yeoman decd and Jacob Klauser a son Peter Lies and Peter Scharadin friends and all of the County of Berks
are held and firmly bound unto the commonwealth of Pennsylvania, in the sum of two hundred pounds, lawful money of Pennsylvania, to be paid to the said commonwealth. - To which payment well and truly to be made, we bind ourselves, our heirs, executors and administrators, end every of them, jointly and severally, for and in the whole, firmly by these presents. Sealed with our seals, dated the ninth day of March Anno Domini 1812.

THE CONDITION of the above OBLIGATION is such, that if the above bounden Susana Klauser and Jacob Klauser administrators of all and singular goods, chattels, rights and credits of Edward Klauser deceased, do make or cause to be made, a true and perfect inventory of all and singular the goods, chattels, rights and credits which wer of the said deceased, within said county, which have or shall come to the hands, possession or knowledge of the said Susana and Jacob or into the hands, possession or knowledge of any other person or persons, for them and the same so made, do exhibit or cause to be exhibited into the Register's office at Reading, in and for the county of Berks, at or before the ninth day of April next; and the same goods, chattels, rights and credits, which were of the said deceased at the time of his death, or which at any time heretofore have come, or hereafter shall come to the hands, possession ande knowledge of the said Susana and Jacob or of any other person or persons, for them do will and truly administer according to law. And further do make or cause to be made, a true and just account, calculation or reckoning of said administration, at or before the ninth day of March in the year of our lord on thousand eight hundred and thirteen. And all the rest and residue which shall be found remaining upon the said administrators account, the same being first examined and allowed of by the orphan's-court of the county of Berks, shall deliver and pay unto suvh person and persons, as the said court by its decree or sentence shall limit and appoint. And if it shall hereafter appear that ny las will and testamend was made by the said deceased, and the executor or executors therein named do exhibit the same into the said Register's-office, making request to have it allowed and approved accordingly, if the said Susana and Jacob being thereunto required, to render and deliver up the said letters of administration; approbation of such testament being first had and made in the said office. Then the above obligation to be void and of no effect, or else to be and remain in full force and virtue.

On the 23d Day of March 1812 appeared Jacob Glauser one of the Administrators of the Estate of Edward Clauser decd. Who after he was duly sworn according to Law did declare and say that the within Inventory dot contain all the personal Estate of the D??? which has come to his Hands or knowledge (Susana Clauser the other Admor having Sworn thereto before Jacob Ruchstein Esq. as it appears.

To the Honorable the Judges of the Orphans Court of the County of Berks held at Reading in and for said County the 23rd day of May AD 1812.

The Petition of Jacob Klouser eldest son and Heir at Law of Edward Klouser late of the Township of Rockland in said County decd.

That your said Petitioner's said Father died Intestate about the 26th day of February last past leaving a Widow named Susanna and issue fifteen Children to with your Petitioner, George, Peter, Mary, Catherine, Daniel, Samuel, William, Abraham, Amos, Susanna, David, Rachel, Joseph, Solomon, and that the ten last named are yet in their minority. And that the said Intestate died Seized in his demesne as offer of and in a certain Messuage or Tenement and ??? of Law situate in Rockland Township of and adjoining Lands of David Kline [Klein], Jacob Haak, Melchoir Heist & others Containing about twenty seven acres (be the same more or less) with the appertenances. Your Petitioner therefore prays your honrs to award an Inquest to make partition of the premises aforesaid to divide among the widow Children and ???? of the said Intestate in Such manner and in just Proportions, as by the Law of this Commonwealth is directed if such partition can be made without prejudice to or spoiling the whole, but if such partition cannot be made thereof as aforesaid, then to value and appraise the same, and further to enquire and ascertain whether the said Real Estate with the appertenances will convenient accommodate more than one of the Children of the said Intestate and if is ??? Law in any of the said Children it will conveniently accommodate & Report of their proceedings to the next stated Orphans Court.

BERKS COUNTY, ss. The Commonwealth of Pennsylvania to the Sheriff of Berks County, Greeting:
Whereas Jacob Klouser eldest son of Edward Klouser late of the township of Rockland in said county deceased, preferred a petition to the Judges of the Orphans Court of the said county, setting forth that the petitioner's said father died Intestate about the twenty sixth day of February last past leaving a widow named Susanna & issue fifteen children to wit your petitioner, George, Peter, Mary, Catharine, Daniel, Samuel, William, Abraham, Amos, Susanna, David, Rachel, Joseph, & Solomon.
That the said Intestate at the time of his decease was seized in his demise as if fee of and in a certain messuage or tenement and tract of Land situate in Rockland Township aforesaid adjoining lands of David Kline Jacob Hawk Melchior Heist & others containing about twenty seven acres more or less with the appertenances.
with the appurtenances. And therefore praying the court to award an inquest to view the same and make partitions &c. which was accordingly awarded by the court. Therefore we command you that you forthwith summon an inquest of twelve good and lawful men of your baliwick and go to the said premises and then and there by their oahts and solemn affirmations make partitions thereof with the appurtenances to and among the widow and all thechildren of the said deceased, if the same can be done without prejudice to and spoiling of the whole. But if the same cannot be so parted and divided withou prejudice to and spoiling of the whole, that the said inquest do view and inquire whether the same will conveniently accommodate more than one of the said children.And if they so find that the then ascertain and report how many the same will as aforesaid accommodate, describing each purpart by metes and bound and returning a just valuation and appraisement thereof. But if the said inquest shall find that the premises aforesaid with the appurtenances cannot be parted and divided to and among the widow and all the children of the said deceased nor accommodate more than one of the said children without prejudice to and spoiling to the whole, that they then value and appreaise the same agreeable to law. That the estimate the widows part therein and in each purpart if divided. That due and legal notice of partition or valuation so made, you distinley and openly have, under your hand and seal and under the hands and seals of those by whom the same sahll be made before our Judges at Reading at our Orphans Court there to be holden the seventh day of August next. And have you then their this writ. Witness the honourable ROBERT PORTER, Esq. president of our said court at Reading, the twenty third day of May in the year of our Lord one thousand eight hundred and twelve.

Inquisition indented and taken at Rockland Township in the County of Berks, the third Day of June in the Year of our Lord, One thousand eight hundred and twelve Before Daniel Kerper, Esq. High Sheriff of the County aforesaid, by Virtue of a Writ of Partition or Valuations, to him directed, and to this Inquistion annexed, by the Oaths of David Klein - Benjamin Klein - George Seifert - Henry Grim - John Haack - Jacob Dressler - Henry Stoudt - Anthony Heffner Jun - Abraham Kieffer - Anthony Heffner Sen - Jacob Seifert & Jacob Classer twelve free, honest and lawful Men of his Bailiwich, WHO, on their Oaths and Affirmation aforesaid, respectfully , do say, that they went to Messuage Tenements
Whereof Edward Klauser
in the said Writ named died seized and then and there did find that the same could not be parted and divided to and among the Perties in said Writ named, without Prejudice to, or spoiling the whole thereof: AND THEREFORE the Inquest aforesaid on their Oaths or Affirmation as aforesaid, have valued and appraised the same at the Sum of three Hundred and Ninety pounds.

IN TESTIMONY whereof, as wll the said Sheriff, as the Inquest aforesaid, have to this Inquest interchangeably set their Hands and Seals. Dated the Day and Year first above written.

I Daniel Kerper esquire high Sheriff of Berks County do hereby certify that by virtue of the within writ to me directed - I have took with me an Inquest of twelve honest and lawful men of my Bailiwick - and on the 3rd day of June 1812, went to the premises in the within writ mentioned - and on a careful examination by the said Inquest of the premises aforesaid - They upon their oaths and affirmations did find that the premises in the said writ mentioned could no be parted and divided to and among the parties in the said writ named without prejudice to and spoiling the whole - The Inquest aforesaid have therefore valued and appraised the same according to the directions of the within court - Appears by a Schedule herewith annexed.

Jacob Klouser son of Edward Clouser decd late of Berks county, yeoman, deceased, acknowledge myself to owe to the Commonwealth of Pennsylvania for the use of the other heirs of the said Edward Clouser deceased, the sum of eight hundred pounds of lawful money of Pennsylvania, to be levied on my goods and chattels, lands and tenements.

THE CONDITION OF THE ABOVE RECOGNIZANCE IS SUCH, that, whereas by an inquest awarded by the Orphans-Court of the said county, the real estate of the said Edward Clouser deceased was valued and appraised, which valuation or appraisement has been duly confirmed by the court.

NOW IF THE SAID Jacob Klouser or his certain heirs, executors or administrators shall pay to the heirs of the said deceased, their several shares and purparts in the said Valuation Mentioned then the above recognizance to be void, otherwise to be and remain in full force and virtue.

Jacob Clouser son of Edward Clouser decd. Jacob D. Breyfogel and Jacob Sweyer all of Berks County
are held and firmly bound unto George Clouser a son of Edward Clouser decd in the sum of Fifty two pounds
in gold or silver money, to be paid to the said George Clouser or his certain Attorney, Executors, Administrators and Assigns. To which payment well and truly to be made, we do bind ourselves, our Heirs, Executors and Administrators, and every of them, jointly and severally, for and in the whole, firmly by these presents. Sealed with our seals, dated the seventh day of August in the year of our Lord, one thousand eight hundred & twelve.

WHEREAS such proceedings were had this day and at diverse times before in the Orphans-Court of the said county of Berks, relating to the real estate of the said Edward Clouser deceased that an inquest awarded by the court, valued the said real estate at three hundred & ninety pounds in gold or silver money. And further, that the said Jacob D. Breyfogel & Jacob Sweyer were approved as sureties, to enter into bonds with the said Jacob Clouser for the payment of the shares and dividends of the younger children of the said deceased; upon sealing and delivery of which bonds, the said Jacob Clouser should hold and enjoy the real estate aforesaid, valued as aforesaid, to him, his Heirs and Assignes for ever, according to law, &c. as by the records of the said court appears, &c.

NOW the condition of this obligation is such, that if the above bounden
Jacob Clouser, Jacob D. Breyfogel & Jacob Sweyer or either of them, their or either of their Heirs, Executors or Administrators, or any of them, shall and do well and truly pay, or cause to be paid, unto the above named George Clouser or his certain Attorney, Executors, Administrators and Assigns, or any of them, the just and full sum of seventeen pounds six shillings & eight pence in one year from this date and the further sum of Eight pounds thirteen shillings & four pence immediately after the decease of the widow together with lawful Interest without fraud or further delay, then this obligation to be void and of no effect, otherwise to be and remain in full force and virtue.
