Notes for Abner Curtis McCLAIN

7/17/1911--"A tragedy occurred Sat. evening about 6:30 PM near the Tenn. and
Ky line east of Buena Vista on the Ky. side about 150 yards from the state
line in which Ed Workman was shot and killed by Ab McClain, a well known
young man of that section. McClain states that he did the killing in self
defence and from what has so far been learned from the eye witnesses his
version is upheld. McClain is free on $5,000 bond.

"5,6 3/5/1913--"Ab McClain, charged with murder, was granted a continuance until the June term The defendant is said to be seriously ill of pneumonia. McClain killed Ed
Workman in the south part of the county during the summer of 1911, and the
case has never come to trial.

"7,8 3/6/1913--"George Gargus, a young man of the south part of the county, charged with obstructing justice, was declared not guilty by a jury. He was indicted last year, being accused of threatening to kill or do bodily harm to Rob Hamlet if he did not leave
Mayfield and not testify in the case of Ab McClain, charged with murder.

"9,10 6/19/1913--"Abb McClain, charged with willful murder, is on trial in Circuit
Court, the case having been called Thursday morning and a trial entered
into. The defendant shot and killed his cousin, Ed Workman, in the south
part of the county in November, 1911. The tragedy occured at or near a
shack conducted then by Bauzzie Bennett, and the plea of McClain is
self-defense, and that Workman had made certain threats on his life. The
defendant is represented by Attorney Pete Seay. The prosecution is being
handled by Commonwealth's Attorney. R. L. Smith and Attorneys Hester & Hester.

"11,12 6/21/1913--"A hung jury was the result of the trial of Abb
McClain, of the south part of the county, charged with the murder of Ed
Workman, in November, 1911. The jury was given the case Thursday afternoon,
and after deliberating on it for twenty-four hours, was discharged following
their announcement that they could not reach an agreement.

"13,14 11/21/1913--"Evidence in the Abb McClain murder case was closed Friday
morning. The plea of McClain for killing Ed Workman at the liquor
"shack"conducted by Bauzie Bennett, was self defense. He claims that his
life was in danger by the attitude that Workman was in before the fatal
shots were fired.

"15,16 11/22/1913--"Abb McClain is a free man, the jury
which heard his case, in which he was tried for killing Ed Workman in the
south part of the county in July, 1911, having returned a verdict of "Not
Guilty" Saturday morning.



Abner married Audie H. WILLIAMS, daughter of Josiah Frances WILLIAMS and Elizabeth Hill ROBERTS. (Audie H. WILLIAMS was born on 29 Aug 1886 in Graves Co., KY. 2, died in 1980 and was buried in Evergreen Cemetery, Ft. Scott, KS..)

Abner also married Cammie DUBLIN. (Cammie DUBLIN died on 21 Feb 1906 in Fulton Co., KY. 3.)
