14 June 1716.        Recorded at the Request of Lewis Gomez the first Day of July anno Dom 1716. - THIS INDENTURE made this fourteenth day of June in the Second yeare of the Reigne of our Soveraigne Lord George by the Grace of God King of Great Brittain FFrance & Ireland Defender of the faith Anno Dom 1716./ Between Archibald Kennedy of the City of New York Gent. And Elizabeth his Wife of the one part and Lewis Gomez of the Same City, Merchant of the other part, WHEREAS our Most -- Gracious Soveraign Lord King George afordsaid by Letters Patent – under the Seal of the Province of New York bearing date the Eleventh Day of August in the yeare of Lord Christ one thousand Seven – Hundred & fifteen did grant Ratify and Confirm unto the Said Archibald Kennedy and to his heires and assignes for Ever, all that a Certain Tract or parcel of Lande Situate & Lying and being in the County of Ulster in the Province of New York Beginning at the South East Corner of the Land of Alexander Grigg and Company and runs West one hundred and fifty Chains thence South one hundred and Ten Chains to the Land of Francis Harrison Esqr and Company thence East one hundred and Seventy Chaines to Hudsons River thence as the River runs to the place where it first began Containing Twelve hundred Acres with its hereditiments and appurtenances Together with all and Singular woods underwoods trees Timber feeding pastures meadows marshes Swamps ponds pools waters water courses rivers rivoletts runs and Streams of water fishing fowling hunting hawkings mines minerals Standing growing Lying & being or to be had used and Enjoyed within the Limitts and bounds aforesaid and all other profits benefits Libertys priveledges hereditments & Appurtenances to the Same belonging or in any wise appertaining and all his Estate right title Intrest benefit Claim and Demand whatsoever of in or to the Same and the Reversion and Reversions remainder and Remainders and the yearely Rents and profits of the Same Epeopling and always Reserving out of the Said Grant unto our Said Lord the King his heires and Successors [page 180] FOR EVER all such firr Trees and pine trees of the Diametor of Twenty four Inches within Twelve Inches of the Ground or root as or Should be fit for Make Masts for his Royall Navy as also all the Such other Trees as were or Should be fit to make planks or knees for the use of his said Royal Navy only which then were Standing growing or being or which for Ever thereafter Should be Standing growing or being in and upon any of the Said Twelve hundred acres of Land with free Liberty and Lysence for any person and persons whomsoever by his Said Majesty his heirs and Successors or any of them to be there unto appointed under him or their Lgn manual with workmen horses wagons carts and Carriages and withen to to Enter and Come into and upon the said Land and Every part thereof and there to fell Down root up inside Saw rive have tabs Cart and Carry away the Land trees planks buds and Masts for the uses aforesaid and also Except all Silver and gold mines as by the Said Letters Patent or the Record of them Remaining in the Secretarys office of the Said Province (relation being thereunto had) may more fully and at Large appeare NOW THIS INDENTURE WITNESSETH that the Said Archibald Kennedy and Elizabeth his Wife Testfyed by hIs being a party and the EnSealing and Delivery of these presents for and in Consideration of the Sume of one hundred and Seventy five pounds Lawfull Money of New York to him the Said Archibald Kennedy in hand at and before the EnSealing and Delivery of these presents by the Said Lewis Gomez well and truly paid & Satissfyed the receipt whereof is hereby acknowledged and themselves therewith to be fully satisfied and thereof and therefrom and defend from Every part and parcel thereof he the Said Archibald Kennedy for himself his heires Executors and Administrators and Every of them doth freely Clearly and absolutely acquit Exonerate and Discharge the Said Lewis Gomez his heirs Executors Administrators and assigns and Every of them for Ever by these Presents have granted bargained Sold aliened Enfeoffed released and Confirmed and do by these presents for them and the heirs of the Said Archibald Kennedy Grant bargaine Sell alien Enfeeof & release and Confirm unto the Said Lewis Gomez his heires and assignes for Ever all that the aforesaid Certain tract or parcel of Land and promises within the Limitts and bounds abovesaid together with all and Singular its hereditaments priviledges profits and appurtenances thereunto belonging or in any wise appertaining and the Reversion and Reversions remainder [PAGE 181] AND REMAINDERS thereof and all that their Estate right title Interest dower property Claim and Demand of into or out of the Same or any part thereof TO HAVE AND TO HOLD the Said Certain Tract or parcel of Land and premises with its hereditaments and appurtenances within the Limitts and bounds as aforesaid unto the Said Lewis Gomez his heires and assifnes for Ever to the Sole and only proper use and behoofe of the Said Lewis Gomez his heires and assignes for Ever and the Said Archibald Kennedy for himself his heires Executors and Administrators and Every of them doth Covenant promise & Grant to and with the Said Lewis Gomez his heires & assignes and Every of them that he the Said Archibald Kennedy and his heires Executors or administrators and Every of them the Same Same Bargained tract or parcel of Land and premises with it appurtenances hereby bargained and Sold or hereby Mean & mentioned and Intended to be bargained and Sold with its hereditaments & Appurtenances to him the Said Lewis Gomez his heires and assigns to his and their proper use and behoofe for Ever against him the Said Archibald Kennedy and his heires and against all manner of person and persons Lawfully Claiming or pretending to Claim any Estate title or Intrest by from or under him the Said Archibald Kennedy efin and to the above bargained premises or the hord in & hosaby meant mentioned and Intended to be bargained promises with the 26 Jun 1716.         Recorded for Jacob Gomez the Fifth day of November Anno Dom 1716. THIS INDENTURE made this twenty Sixth day of June in the Second year of the Reign of our Sovereign Lord George by the Grace of God King of Great Britain France and Ireland Defender of the Faith Etc Anno Dom. 1716 BETWEEN Archibald Kennedy of the City of New York Gent and Elizabeth his Wife of the one part and Jacob Gomez of the same city Merchant of the other part. WHEREAS our said most gracious Sovereign Lord King George by Letters Patent under the Great [crossed out] Seal of this province of New York bearing date the Eleventh Day of August in the year of our Lord Christ One Thousand Seven Hundred and fifteen Did Grant ratify and Confirm unto the Said Archibald Kennedy and to his Heirs and assigns for Ever All that a Certain Tract [page 199] and parcel of Land in the County of Ulster on the West Side of Hudsons River being part of the Reasumed Lands formerly granted to one Capt. John Evans beginning at the North East Corner of the Land of Alexander Griggs and Company and runs West seventy two Chains thence North One Hundred Thirty five chains to the Line of William Bonds Land Thence South Sixty one Degrees Easterly one hundred and two Chains to the River and thence as the River Runs to the place where it begun containing EIGHT HUNDRED ACRES, Together with all and Singular Woods underwoods Trees Timber Feedings Pastures Meadows Marshes Swamps ponds pools Water Water courses River Rivolets Runs and Streams of water Fishing Fowling Hunting Hawking Mines Minerals Standing Growing Lying and being or to be had used and enjoyed within the Limits and Beounds aforesaid and all other profits Benefits Liberties priviledges Hereditaments and appurtenances to the Same belonging or in any wit appertaining and all that his Estate Right Title Interest benefit Claim and Demand whatsoever of in or to the Saame and the Reversion and Revertions Remainder and Remainders and the yearly Rents and profits of the Same Excepting and always Reserving out of the said Grant unto his sd Majestie his heirs and Successors for ever all such Fir trees and pine trees of the diameter of twenty four Inches within twelve Inches of the ground or root as are or shall be fit to make Mast for his Royal navy and also all Such other trees as are or shall be fit to make planks or knees for the use of the Said Royal navy only which then were Standing growing or being or which for Ever Thereafter Should be Standing growing or being in and upon any of the said Eight Hundred Acres of Land with free liberty and lycence for any person and persons whomsoever by his said majestie his Heirs and Successors or any of them to be thereunto appointed under his or their Signetures with workmen Horses Waggons Carts and Carriages and without to Enter & Come into and upon the said Land and Every part thereof and there to fell cut down root up then Saw shieve Have take Cart and Carry away the Same trees and planks knees and mast for the use aforesaid and also Except all Silver and Gold mines as in and by the Said Letters patent or the Record of them Remaining in the Secretarys of the Said province of New York Relation being thereunto had may more fully and at Large appear NOW THIS INDENTURE WITNESSETH That the said Archibald Kennedy and Elizabeth his wife Testifyed by her being a Party to and the Ensealing and Delivery of these presents for and in consideration of the Sum of Seventy Five pounds Lawfull money of New York to him the said Archibald Kennedy had at and before the Ensealing and Delivery of these present by the said Jacob Gomez well and truly paid and Satisfied the Receipt whereof is hereby acknowledge and themselves Herewith to be fully Satisfied and Hereof and thence from and of and from every part and parcel thereof He the said Archibald Kennedy for himself his Heirs Executors and admin'ors and Every of them doth hereby Clearly and absolutely acquit Exonerate and Discharge the said Jacob Gomez his Heirs Executors Admin'ors & assigns and every of them fore Ever by these presents HAVE granted Bargained Sold Aliened Enfeoffed assured and Confirmed and by these presents Do for them and their Heirs of the Archibald Kennedy Grant Bargain Sell Alien Enfeofe assure and Confirm unto the said Jacob Gomez his heirs and assigns for Ever all that the above said Tract and parcel of Land and premises with Hereditaments and appurtenances within the Limits and Bounds above mentioned and Described and the Reversion and Reversions Remainder [page 181] AND REMAINDERS thereof and all that their Estate Right Title Interest use Dower property Claim or Demand of into or out of the Same or of into or on of any part thereof TO HAVE and TO HOLD the said Certain Tract and parcel of Land and premises aforesd with the Hereditaments and appurtenances thereunto belonging or appertaining unto the said Jacob Gomez his Heirs and assigns for Ever to the Sole and only proper use benefit and behoof of him the said Jacob Gomez his heirs and assignes for Ever and the said Archibald Kennedy for himself his heirs Executors and administrators and every of them Doth covenant promise and grant to and with the said Jacob Gomez his Heirs and assigns and every of them that he the said Archibald Kennedy and his Heirs Exc'ors or administrators and every of them the Same Bargained [page 201] TRACT or parcel of Land herein and hereby Bargained & Sold or herein or hereby meant mentioned and intended to be Bargained and Sold with it, Hereditaments and appurtenances to him the said Jacob Gomez his heirs and assigns to his and their proper use & behoof for Ever against him the said Archibald Kennedy and his Heirs and against all manner of person persons Lawfully Claiming & pretending to Claim any Estate Title or Interest by from or under him the said Archibald Kennedy of in and to the above Bargained premises or the having and hereby meant mentioned or intended to be Bargained premises with the Hereditaments & appurtenances thereunto belonging or in any ways appertaining Shall and will warrant and for ever defend by these presents IN THIS INDENTURE made the thirteenth Day of November in the sixth year of the reigne of our Soveraige Lord George by the grace of God King of great Brittain France & Ireland defender of ye faith & annogue Domini 1719 BETWEEN George Emott of the City of New York gent & Mary his wife late Mary Talham of the one part & Daniel Gomez of the Ciity aforesaid merchant & Christopher Fell of the same City of the other part WHEREAS her late Majesty Queen Anne (of glorious memory) by her Letters Patent under the seal of the Province of new York bearing date the tenth day of Jul in the thirteenth [page 352] YEAR of her Reign did give grant ratifie & Confirm unto Francis Harrison the said Mary party to these presents then Mary Tallman Thomas Braine James Graham & John Haskoll a certain tract of Land in the County of Ulster in the Province of new York on the west side of Hudsons river being part of Land formerly granted to Capt John Evans now vacated & reassumed beginning at the north east Corner of Andrew Folks land by Hudsons & runs thence with the line of ye said Andrew Folks land north sixty eight Degrees West one hundred ninety & eight Chains thence north nineteen degrees East two hundred & twenty Chains thence east two hundred & fifty Chains to Hudsons river & thence Down the said river as it runs Southerly to the place where first it began containing in the whole five thousand six hundred acres English measujre bounded southerly by Andrew Folks land & the nine German Familys westerly & northerly by land unsurveyed & easterly by Hudsons river aforesaid in which bounds Containd three hundred Acres of Land layd out for Teller the germond Joyner & three hundred Acres of land laid out for Peter Johnston together with all & singular Woods underwoods trees timber seedings pastures meadows marshes swamps ponds pools water water courses rivers rivolets runs & streams of water Fishing fowlijng hawking hunting mines minerals standing growing lying & being or to be had used & enjoyed within the Limits & bounds aforesaid & all other profits benefits priviledges libertys hereditaments & appurtenances to the same belonging or in any ways appertaining (excep'ted & always reserved out of the then premises) grant unto her the said late Majestie her heirs & successors forever all such fir trees & pi8netrees of the Diameter of twenty four Inches within twelve inches from ye root or ground [ page 353] or SHALL be fit to make masts for the royal navy & also all such other trees as are or shall be fit to make planks or knees for the use of the said royall navy only which then were standing growing or being or which thereafter forever should at any time be standing growing or being in & upon any of the said tract of Land with free liberty & lycence for any person or persons whatsoever by her said late majestie her heirs & successors or any of them to be thereunto appointed under her or their sign manual with work men horses wagons Carts & Carriages & without to enter& come into & upon the said Land & there to fell cut down root up hiew saw rive split have take cart & carry away the same planks masts & knees for the uses aforesaid & also excepted all gold & silver mines & excepting also there out the said three hundred acres of land layd out for the said Teller the germond joyner & the other three hundred acres of Land lyd out for Peter Johnston TO HOLD all singular ye said granted tract of Land & premises with the appurtenances (except before excepted) unto them the said Francis Harrison Mary party to these presents then Mary Talham, Thomas Braine James Graham & John Haskol their heirs & assigns to & for the uses thereafter mentioned that is to say one thousand Acres thereof unto each of them the said Francis Harrison Mary party to these presents thenMary Talham Thomas Braine James Graham & John Haskol & to each of their heirs & assigns forever at under the yearly Quit rent of two shillings & six pence for every hundred ac res thereof to be paid at the Custome House in New York to the collector & receiver general For the time being at the feast day of Saint Michell the arch angle commonly Called [page 354] MICHELLMAS DAY as by the same letters patents relation being thereunto had may more fully appear AND WHEREAS by Indenture & unique partree bearing date the fifteen day of March in the first year of the reigne of our said Now Lord the King made between ye said Francis Harrison Mary Party to these present then Mary Talham of the second parte & Thomas Braine of the third part James Graham of the fourth part & John Haskol of the fifth part as was covenanted Concluded & agreed upon by & between ye said parties first ye said partys did thereby accord Consent & agree that ye said tract of Land as it was then divided in five lotts or parts & marked with the Letters A. B. C. D. E. as by this draught or plan thereof above the said Indenture & unique parties might appear should foreverthereafter be & remain ye division or particon of ye said tract & parcel of Land ye meadow, ground Planting and Land being wholly excepted out of said division by the said part was reserved to & Lay in Common until they should agree to make Division of ye same & further by ye same Indenture & unique parties they ye said Francis Harrison Thomas Braine James Graham & John Haskol did for themselves their heirs executors & administrators Covenant Grant promise & agree to & with ye said Mary party to these presents then Mary Talham her heirs executors administrators & assigns & to ye sole & only proper uses benefit & behoof of her the said Mary party to these presents then Mary Talham her heirs & Assigns forever all that the Lott of Ground marked with the Letter B as in the said Draught bounded on ye south by ye Lott of James Graham on ye north by the Lott of John Haskol on ye East by Hudsons river & on ye west by rear line of said tract Containing one thousand Acres as by ye said Indenture uinque partiese with ye Draught or plan of ye said tract of Land & as its divided into five parts or shares marked as aforesd A. B. C. [E?] the said xxxx Indenture among other things relation being thereunto had may more at large appear AND WHEREAS the said George Emott hath since [page 355] INTERMARRY'D with ye said Mary party to these presents NOW THIS INDENTURE wittnesseth ye the said George Emott & Mary his wife for & in Consideration of ye sum of two hundred pounds current money of New York to them in hand paid at & before ye ensealling & delivery thereof by ye said DANIEL GOMEZ & CHRISTOPHER FELL the receipt whereof they do hereby acknowledge thereof & of every part & parcel thereof they ye said George Emott & Mary his wife for themselves their heirs executors administrators & assigns Do: acquit Release Discharge the said Daniel Gomez & Christopher Fells & e ach of them their & each of their heirs & assigns forever by the presents HAVE Granted bargain'd sold aliened remiss'd released & Confirm'd & by these presents DO grant bargain sell alien remisse releave & confirm unto them the said Daniel Gomez & Christopher Fell in their actual possession now being of ye premises with ye appurtenances herein after mentioned & intended to be hereby bargain'd & Sold by Virtue of a of A bargain sale & lease for one Year thereof to them made by ye said George Emott & Mary his wife by Indenture bearing date the day before ye date hereof & by force of ye statute made transferring use into possession & to their heirs & Assigns forever All that ye said Lott marked with the letter B before described being the fifth part or share of the said tract of Land as its already divided between ye said patentees as aforesaid bounded on ye South by ye Lott of James Graham on ye North by ye Lott of John Haskoll on ye East by Hudsons river & on ye West by ye rear Line of ye said Tract Containing [page 356] ONE Thousand Acres & also ye one fifth part of all the undivided Land of the said tract of Land not yet divided together with all woods underwoods tree timber Seedings pasture meadow marshes Swamps ponds pool Lakes Streams harbours rivers rivolets fishing fowling hunting & hawking & all other benefits profits on in under Comiditys & advantages whatsoever to the same belonging or in ay wise appertaining (except as to the before receited Letters patents is excepted & the reversion & reversions remainder & remainders thereof & also all the estate right title interest property possession reversion Claims & demands whatsoever of them the said George Emott & Mary his wife in & to the hereby bargain'd premises & every part & parcel thereof TO HAVE AND TO HOLD all & singular the premises with the appurtenances hereby granted & released except before excepted unto them the said Daniel Gomez & Christopher Fell their heirs & assigns forever to the only proper use & benefit & behoof of them the said Daniel Gomez & Christopher Fell their heirs & assigns forever more yielding & paying therefore yearly & every Year the one full & equal fifth part or share of the aforesaid Quit rents of two Shillings & six pence for every hundred acres of the said tract of Land herein before described in the aforesaid recited Letters patents reserved in such manner & forme & and at such times as the same as therein made payable AND the said Daniel Gomez & Christopher Fell for themselves their heirs executors administrators & assigns DO Covenant promise & grant to & with the said George Emott & Mary his wife their heirs executors & administrators & every of them by these presents that they the said Daniel Gomez & Christopher Fell their heirs & executors administrators or assigns some or one of them Shall & will yearly & every Year will & truly pay or Cause to be pay'd the one full & equal [page 357] FIFTH part or share of the aforesaid Quitt rent of two shillings & six pence for every hundred Acres of land of the aforesaid tract of Land of five thousand Acres in the said recited Letters Patent reserved in such manner & forme & at such times as the same with the said recited Letters Patents & in these presents made due & payable & shall & will from time to time & at all times hereafter Save harmless & keep indemnify'd them the said George Emott & Mary his wife & their heirs Executors administrators & every7 of them & their & every of their goods & Chattles Lands and tenements of & from the same & the said George Emott & Mary his wife & their heirs all Singular the hereby bargain'd premises with the appurtenances unto them the said Danie Gomez & Christopher Fell & their heirs against them the said George Emott & Mary his wife their and each of their heirs & against all & every other person & persons whatsoever lawfully claiming or to Claim to by from or under their or either of them shall & will warrant & forever defend by these presents AND the said George Emott & Mary his wife for themselves their heirs executors administrators & assigns DOE Covenant promise & grant to & with the said Daniel Gomez & Christopher Fell their heirs & assigns & to & with every of them by them by these presents in manner & forme following that is to say that they the said Daniel Gomez & Christopher Fell their heirs & assigns Shall may from time to time & at all times hereafter freely quietly & peaceably have hold use possess enjoy & keep all & singular the premises with the appurtenances herein and hereby [page 358] BARGAINED & sold & every part & parcel thereof & the rents issues & profits thereof receive perceive & Injoy & take up to & for their own use & behoof without the Lawfull Lett suite trouble denyal interruption or Contradiceon of them the said George Emott & Mary his wife or either of them their heirs executors administrators or assigns or any of them or for by any other person or persons whatsoever lawfully Claiming or to Claim by from or under them any or either of them & that free & Clear & freely clearly & absolutely acquitted released exonerated & discharged of & from all former & other gifts grants bargains sales leases with intails Joynters dowers titles of Dower Judgements Executions extents incumbrances issues fees fines port fines ordinances Charges titles troubles and incumbrances whatsoever had made Committed dower suffered by them the said George Emott & Mary his wife or either of them or any Claiming under them or either of them AND LASTLY that they the said George Emott & Mary his wife & all & every other person & persons whatsoever claiming or which & had or may have Lawfully Claim any estate right title or interest of in or to all or any of the hereby bargain'd premises with the appurtenances by from or under them or either of them Shall & will from time to time & at all times hereafter within the space of fourteen years at the reasonable request Costs & Charges in the Law of them the said Daniel Gomez & Christopher Fell their heirs & assigns further doe acknowledge Levy & execute or Cause or Suffer to be done & executed all & every such further & other reasonable Act & acts thing & things device [page 359] AND Devices Conveyances & Assurances in the Law whatsoever for the further better and more perfect assurance surety & sure making releasing Conveying & assureing of all and Singular the premises with the appurtenances there Bargained & sold be it by deed or deeds enrolled or not enrolled & the feoffe meant recovery or Confirmation or by all or any of the said ways or means or by any other lawfull or reasonable ways or means as by them the said Daniel Gomez & Christopher Fell their heirs assigns or their Councile Earned in them are shall be divised advised or required so as the party or partys so to do the same be not Compellable to travel from his or their place of abode above the space of ten miles for the doing and executing the same. IN WITNESS whereof the partys to these presents have hereunto interchangeably sett their hands and Seals the day and year first above written.
