ULSTER COUNTY, NEW YORK DEEDS

ANCIENT ROADS

I’m hoping someone who is acquainted with the area will help us get all these roads and farms straight!

C. M. Woolsey, in his “History of the Town of Marlborough”, states that the oldest road in the Town of Marlborough is the “KING’S HIGHWAY” on the west side of Hudson’s River, running  from New York City to the NORTH to Albany.  Later it was known as the “POST ROAD”, although on later maps the ‘Post Road” seems to be further West of the River.  The mail and newspapers, etc., were carried along this road until it became cheaper to send them on the Steamers that plied the Hudson River.  The lateral roads running EAST to WEST crossed this road at various points along its course through the Town of Marlborough.  It is now is, roughly,  “9W” or “218”.  You can find many of these places on Google Maps (or others).  Type in Ulster County, or Lattintown, or Marlborough, or Plattekill, etc.

There appears to have been two roads, one called the “Lattin Town Road” and the other the “Platter Kill Road”.  These were certainly the oldest roads . . . 1743 . . . . in the Township of Marlborough.  It seems that the name Platter Kill was long used before the town was named.  It was the stream of water running along the west side of what is now Plattekill. . . .

The following  are descriptions of the various “Lateral Roads”, generally running from West to East, starting with the road the furthest North in the Township of Marlborough, and then travelling South down the River to the next “Lateral Road”.

p. 21 9.  01.          The first road on the north is the Smith road, running from Smith’s store for several miles west.

02.          The next road south is what was afterward laid out as the Farmers’ Turnpike & Bridge Co, from the river connecting Sand’s store and dock, and the Sutton dock and running westerly through what is now Modena and crossing the Plattekill.  On the map it is called the “Road to Platte Kill” and is referred to in the laying out of other roads as the “Platte Kill Road.”

03.          The next is the road from the willow tree and post road running west and connecting with the last named road (the “Platte Kill Road”).

04.          Then comes the road from the Powell dock and ferry to Lewis’ farm and the post road and past the Quaker Meeting-house to Lattintown [called the Lattintown road] and on across the mountain to Pleasant Valley.  [This is an East to West road.  On this road and between the “Post Road” and the road from the Lattintown road to Purdy’s bridge, the name “WOOLSEY” appears, and the name “H. WOOLSEY” appears on this same road a little further West of the Lattintown road to Purdy’s bridge  road.  [Also known as the“Highlands Ridge” road]  The Woolsey families are on the Lattintown road and in the region round about there.  This road is still called the “Lattintown Road” on the “Google Maps”.  Lattintown is on the “Old Indian Road” that runs from Hudson River through Lattintown in roughly a semi-circle, then changes to “Mt. Zion Road” then continues on in the semi-circle until it connects back to the “Lattintown Road”.

05.          The next is the road from the Old Man’s creek to the Lattintown road, and thence north and connecting with the road over the mountain at the Penny place, just as it is at present (1904).

06.          The next, The African Lane road, also crosses the mountains to the valley.

07.          The last is the road at the town line [between Marlborough and Newburgh] at the Velie place, which passes what was the Acker mill, and runs thence west over the mountains.  [The above 7 roads are lateral roads, running generally East to  West, named from North to South running down the Hudson River.]

The “Post Road” [running from North to South] along the river from the town of New Paltz (now Lloyd) to the town of Newburgh is crossed by the roads above mentioned.  On Dr. Benjamin Ely’s 1797 “Map of Marlborough” the name “WOOLSEY” appears on the “King’s Highway” or “Post Road” about half-way between the “Lattington Road” and “Old Man’s Creek Road”.  [This is probably the Richard Woolsey (1697) original patent from the Gomez brothers.]

08.          The road from the Lattintown road to Purdy’s bridge is next.  The map marks the land here as a “Ridge of High, Good Land.”  This appears to extend on through to the turnpike.  [This is a North to South road.  It runs roughly parallel to the post road and the name “WOOLSEY” appears once more, this time directly West of the name “WOOLSEY” of the post road.]

09.          The next is the Lattintown road from New Paltz town to New Burgh town, called on the map “Road from New Burgh.”

In 1763 the New York Hgwy. commission records of Roads Laid Out 1722-1795 reads

"...An Act for Clearing Mending and Further Laying Out Publick Roads...at request of inhabitants of Eastermost part of Lattin Town of the District of the precinct of Newburgh..laid out One Publick Road...Four Rods in breadth Beginning at Elijah Lewises Landing, ..near small brook then....to school house by Kings Highway, then along Old Road leading south of Thomas Nolston and Thomas Woolseys dwelling houses, then along Old Road until it comes to John Cavilirs, then along the lane ...until it comes into the Kings Road in Lattintown....in the year of our Lord 1763.”  [Lattin Town was pretty much the center of the many Woolsey families in the area.  They were of the Baptist, Congregationalist (Presbyterian) and Methodist Episcopal faiths, so their records are scattered.]

10.          After this is the road from the Plattekill road (Farmers’ Turnpike),  Beginning west of Tucker’s corners and running North to Elting and LeFevre’s corner.  The map gives it as the “Road to Paltz and Baker’s store.”

11.          Further west, we come to the road from the turnpike south to and through the valley to the Newburgh line.

12.          The next is the road from the turnpike, at what is now Modena, south by southeasterly to the Valley;

13.          and then there is a road from the last-mentioned extending westward to the New Hurley church.

p. 184.   “. . . a Petition of the Inhabitants being Freeholders have laid out an open Public Road four Rods wide beginning not far from the North side of the Seven Patentees on the brow of a certain Small Hill thence in the most direct and Convenient place to a certain bridge in the Road that comes from Mr. Brush’s Landing thence Northerly in the most direct and convenient place a little East of the House of David Mackey thro’ the East part of a certain Swamp still running near said swamp in the most Direct and Convenient place to a certain Bridge still Northerly in the most Direct and Convenient place to the Paltz line Oposite the Land of Capt. John Woolsey adjoining a little West of his Block House  We do order the Road above mentioned to be open and publick etc.  26 Mar 1774.  Richard Woolsey, Lewis Dubois, Caleb Merritt.”  [That our Woolseys were on the leading edge of the Pioneer movement in New York is evidenced by the above notice of Capt. John Woolsey’s ‘Block House’.

ANCIENT PATENTS AND LAND GRANTS

 C. M. Woolsey, in his “History of the Town of Marlborough, Ulster County, New York, 1908” gives a good synopsis of “Patents and Land Grants” with this history:

01.  The first patent was granted to John Barbarie in 1709, with a “river front of a mile and a quarter… Mostly all of Milton is on this tract.”

02.  Next was the Bond Patent, 1710, (which he gives in full, p. 28ff, with an appended Queen Anne’s seal, etc.)  “The deed of the Bond Patent is in the hands of the Hallock family at Milton.”, which may help explain why many of these early deeds cannot now be found www.)

03.  The Alexander Griggs & Graham Patent granted in 1712.  “Beginning at the N side of the S branch of the Old Man’s Kill and runs along Hudson’s River, etc.”  [p. 41]  James Graham of the city of New York, the eldest son and heir-at-law of Augustine Graham, dec’d, conveyed to Zachariah Hoffman all that one-half part of the Griggs & Graham Patent of 1,200 acres.  Prior to this time Alexander Griggs conveyed his one-half part to Jurey Quick and Jurey Quick in 1727 leased his part of the tract to Zachariah Hoffman.  In 1741 Quick and his son Thomas Quick sold these lands to Hoffman for 80 pounds.  Hoffman afterward died and his two daughters, Geartry DuBois, and Ida Hoffman, became the owners of the entire patent, and Geartry DuBois conveyed her part to Lewis DuBois by deed, as follows:  “Geartry Dubois, widow of Nathaniel Dubois, Late of the County of Orange and Province of New York, Deceased,  greeting.  Know ye that whereas Jachariah Hoffman, Late of Schawangunk in Ulster Co, deceased; by his last will and Testament 25 Feb 1743 did bequeath tract of land containing 1200 acres  formerly granted to Augustine Graham & Alexander Griggs on Hudson, and then in the Tenure of Jury Quick etc unto his two Daughters, Namely the said Geartry  Dubois and his Daughter Ida etc and whereof the said Geartry Dubois being Possessed of the full equal half Part of the said Tract in her own Right at the time of her marriage with the said Nathaniel Dubois and in considereation of the Love and Affection which she hath towards Lewis Dubois, her son-in-law and for Divers other good causes etc – Quit Claimed – all right the Equal half part of the said 1200 acres, which half part the said Lewis Dubois is now in the Possession thereof.  11 Jun 1763, proved 21 Oct 1764.

Ida, the daughter of Hoffman, married Cornelius Bruyn and in 1746 she conveyed her undivided one-half part of the patent to Nathaniel DuBois and this descended to his son Lewis DuBois, so that he was the owner of and in possession of the lands in question some time before he received the deed from his step-mother or mother-in-law as above stated.  When he received her deed he was the owner of all of it.  Lewis DuBois was in possession of these lands at the time he got his deed in 1763 from his stepmother, and the presumption is that he had been there several years and was living there under title from his father; for at the time he was interested in various projects and had agreed to give to the Marlborough Society two acres of land.  The subscription list for the church states, “Providing that Lewis DuBois does give two acres of land.”

On 8 Apr 1764 he did execute a deed for the land to John Woolsey and Stephen Case, first trustees.  He was the largest subscriber, giving 15 pounds on the first and 8 pounds on the last subscription, so he must have been a man of means, and doing business at this time.  There was a stone marked “M.B.Y. 1764” set in the ground in the SW corner of the Meeting-house lot.  [see DuBois Deed to John Woolsey and Stephen Case, later.]

Lewis DuBois was a leading man in Marlborough Town activities, especially during the Revoluntionary War.  He raised several militia units and also Lewis DuBois’ Fifth Regiment of the Continental Line, from Ulster and surrounding counties.  There were several Woolseys in the Fifth Regiment, including the ancestor of www, Richard Woolsey (who married Nancy Plumbstead), son of Rev. Thomas Woolsey, of Westchester and Ulster Counties, NY, who moved to Washington County, Virginia, about 1771.  His son Richard (who married Nancy Plumbstead) served in the Revolutionary War in New York at the Battles of Kings Bridge, White Plains and Long Island, then Richard moved his family West to Virginia, to be with his father and siblings, where he may have been, with other Woolseys, in the Battle of Kings Mountain in Virginia.

04.  The next patent is to Lewis Morris and others in 1714:  “Beginning at the north-west corner of the land of Alexander Griggs & Co. and then running as the river line of the said land of said Alexander Griggs & Co. runs, S 54o W 120 chains to the Southermost corner of the said land of said Griggs & Co., thence S 75 chains to the N bounds of the land of Francis Harrison, Esq. & Co, runs W into the woods 160 chains to the foot of the Blew Mountains, then as the said mountain runs travers protracted N  NE 450 chains to a black oak marked with three notches and a cross in all four sides, thence S 61o, E 55 hains to the NW corner of the land of William Bond, thence as the river line of said land of William bond runs S 3 o, E 51 chains to the SW corner of the said land of William Bond and thence S 156  chains to the place where it first began, containing 3600 acres with allowances for broken barren land and highways.

It will be seen that the western line of the patent is so uncertain that I [C. M. Woolsey] cannot tell where it is but it does not include the western part of the town as far north as it goes.  This patent was known and always went by the name of the “Seven Patentees”, as the patent was granted to seven persons:  Lewis Morris, Augustin Graham, Lymon Clarke, Henry Wileman, William Bond, Henry Rainer and Alexander Griggs.

1771 MARLBOROUGH, ULSTER, NEW YORK:
29 June 1771: A Mortgage between Richard Woolsey of New Borough, Co. of Ulster, yeoman and George Clinton of New Windsor, Ulster Co. N.Y. A piece of land where said Richard Woolsey now lives in New Borough & is part of a tract of land formerly granted by letters patent under the Broad Seal of Providence of N.Y. to Lewis Morris Esq, deceased and other persons; Said land begins at a stake being in Meadow in South bounds of Joseph Morey's from northeast corner of the land lately conveyed by said Richard to Jehannis Deyo; George Stantors land is a boundary also; Land formerly conveyed by Richard Woolsey. (Marlborough & New Borough may be the same place.)     Source: Film: 841118: Liber 3 pg: 87  [www thinks that this may be his ancestor, Richard Woolsey who married Nancy Plumbstead and enlisted in the Revolutionary War from New Windsor, Ulster County, or not.  “New Borough” above may mean “New Marlborough”,  the former name of “Marlborough”.]

05.  The next is the Archibald Kennedy Patent for two tracts of land lying on the river, granted in 1715.    These would be of special interest to the descendants of the Woolseys of Ulster County, New York.

1st.  Beginning at the SE corner of the land of Alexander Griggs & Co. and runs W 15 chains, thence S 110 Chains to the land of Francis Harrison, Esq. & Co. then E 170 chains to Hudson’s river, thence as the river runs to the place where it first began : containing 1200 acres.

2nd.  The other certain parcel beginning at the NE corner of the land of said Alexander Griggs & Co and running W 72 chains, thence N 135 chains to the line of William Bond’s land, thence S 61 degree, E 102 Chains to the river and thence as the river runs to the place where it began : containing 800 acres, which with the other parcel aforesaid completes 2000 acres.

This first lot of 1200 acres is the Southernmost patent in the town and marks the town’s Southern boundary.  It adjoins the Francis Harrison Patent.  This tract was sold to Lewis Gomez.

Kennedy sold the second lot of 800 acres to Jacob Gomez, then Gomez’ heirs sold to Richard Woolsey.

06.  The next grant is the George Harrison Patent, granted in 1750: In three tracts, the first adjoins Archibald Kennedy, the second joins John Barbarie and is party in Marlborough and partly in Lloyd.  The third lot is entirely in Plattekill.  George Harrison sold the first tract of his patent, the 705 acres, to Cadwallader Colden; Colden then sold a part to William Wickham, William B. Woolsey and others.  Wickham sold to Thomas Woolsey and William B. Woolsey; William B. Woolsey sold to Caverly, Hait and others.

The first patent along the river on the north was the Barbarie patent, next the Bond, and the next Kennedy, next Grigg & Graham, and the next Kennedy, and next was the George Harrison patent.

These large tracts were afterward divided and sold to actual settlers.  C. M. Woolsey gives a synopsis of each grant, including the Bond patent.

02.  William Bond conveyed his lands to his daughter, Susanna Bond, and she conveyed to William Weynant, 1752, etc.  Susanna Bond also conveyed a tract of land to Jurian Mackey out of the said patent of 600 acres as follows:  “Near Dam’s Commer being a part of the patent of Capt William Bond the W side of Hudston’s River joining N by Barbaree, E by Hudson’s River, S by WOOLSEY, W by Cornel Moresses patent, etc. ….

05.  Kennedy sold his 800 acre tract to Jacob Gomez, then Daniel and Abram, children of Jacob Gomez, sold the tract to Richard Woolsey.  [www did not find this original conveyance.]  [See Richard Woolsey DEED to Richard Harcourt, 1754.   www  - the following deed is an example of the Gomez’ transactions.]

Ulster County, New York DEEDS.                                     FHL film# 944743.               FF:160.

Daniel Gomez [before John Chambers Esqr of New York   31 Mar 1763. [Not found]

C. M. Woolsey continues:  Archibald Kennedy conveyed his tract of 1200 acres to Lewis Gomez; and Mordecai, Daniel and David Gomez as executors of their father, Lewis Gomez, in 1748, conveyed the same to William Campbell and Archibald Duffie and on 28 Mar 1750 Campbell and Duffie of Ulster county conveyed the same to Francis Purdy and George Merrit.  [Then follows some more conveyances]:  From this transfer, it will be seen, that there was a landing and limekilns at the river at that time; the landing was most likely built by Lewis Gomez or his sons, and if so it was very old, if not the oldest in the town.  The lime burnt at the kiln supplied all that part of the country at the time.

On the 14 Aug 1754 Francis Purdy conveyed 606 acres in two lots – 484.5 acres west of the road and 121.5 acres east of the road, along the N side and adjoining the Griggs and Graham patent; the balance was conveyed by Merritt to Purdy.  [Then C. M. Woolsey quotes from the actual Deed “ … in the possession of John C. Merritt, the great-great-grandson of George Merritt, etc.  …]

From this Lewis Gomez, [the name] Gomez’ Jew’s creek derives its name; and the land which Gomez owned then were sometimes assessed to “Mr. Gomez,” and at other times to “Gomez the Jew.”  This creek ran through Gomez’ land.  These limekilns and the landing were on what is now known as the Kerr place.  Gomez the Jew was a New York merchant but resided here part of the time.  In the districting of the highways his residence is spoken of as “the Jew’s house.”

[Note by www:  There is a very interesting website about Luis Gomez, “the oldest Jewish house in America”.  It is thought that Jacob Gomez and Luis Gomez were brothers and were very active in Jewish activities in New York City.]                               http://www.hebrewhistory.info/factpapers/fp030_gomez.htm

Residing at New Marlborough in 1717-1718 was Mr. Gomez; in 1724-1725 was Gomez the Jew; in 1726-1729 was Gomaz the Jew.  Also at New Marlborough during this period were Denis Relje, Jeurian Quick, Wm. Bond, Alexander Griggs, A. Graham and Pieter Jansen and others.

C. M. Woolsey continues:  In 1770, Richard Woolsey conveyed to Thomas Knowlton 211 acres of this tract.  It is described as being in the precinct of Newburgh, the northern part of the Highland precinct having by this time been formed into a separate district called Newburgh Precinct.  This tract is described as being on the north of Harcourt’s land and extending along the river and as far back as Harcourt’s line.  In 1760 Richard Woolsey conveyed another part of this tract to his son, Benjamin, afterward a part to his son, John, and John conveyed 203 acres to his son Henry Woolsey.  [See 1801 Deed John Woolsey to Henry Woolsey]

Richard Woolsey sold 155 acres, on the south side of what he sold to Harcourt, to Edward Hallock, and Edward Hallock sold to John Youngs, June 1776.  In the ancient deed it is described as follows:

All that certain parcel of land situate on the W side of Hudson’s river, bounded as follows:  Beginning at Richard Harcourt’s SE corner of his farm at Hudson’s river thence running along his line N 73o W 75 ch. & 50 links to a stake and stones and in Benj. Woolsey’s corner, thence running along his line S 1o and 50 “ E 40 ch & 95 links to another heap of stones and in John Woolsey’s corner, thence along his line . . . . to a chestnut oak tree, marked on three sides with three notches and a blaze, standing on the bank of Hudson’s river, thence northerly along the said river to the place of beginning : containing 155 acres.

It appears from the amount sold out of this patent that there were over 1000 acres including barren lands.

Susanna Bond also conveyed a tract of land to Jurian Mackey out of the said patent of 600 acres as follows:

She also conveyed a tract of land out of the Bond Patent in 1763 to James Hunter.  In this conveyance she is designated as spinster, and conveys to James Hunter, a free mulatto yeoman, all the Bond patent of 600 acres.  She died by 1765.  She received the above land in Oct 1739.  It seems that James Hunter in 1765 conveyed his 1771.       land to John Belfield.  Belfield, by sheriff, conveyed to Jacob Griffin, 1771.
