Liquor when it is government evidence is property, United States District Judge Henning ruled yesterday in overruling the demurrer of John H. Wynkoop, former chief field agent of the Federal prohibition forces here, who was indicted on charges of illegal diversion of seized liquor.
The demurrer set forth that liquor is not recognized under the law as property and therefore diversion of liquor is tantamount to diversion of something not in existence.
Judge Henning ruled that anything that falls into the hands of a government officer as evidence is property.
