Does liquor exist in the eyes of the law? Al McDonald, attorney for John H. Wynkoop, former chief field agent of the United States prohibition forces in Southern California, who is accused of illegal conversion of seized Scotch, says it doesn't.
United States District Judge Henning therefore yesterday was called upon to decide the issue and set Friday as the day when he will settle the question.
McDonald filed a demurrer to the indictment against Wynkoop yesterday when the former dry agent was to have entered plea. The contention of the defense is that Wynkoop could not convert seven or eight cases of Scotch liquor seized two months ago because the Volstead Act fails to give title to intoxicating beverages.
