Wynkoop Declared Mayoralty Victor
by One Vote In Court Ruling.

    TRENTON, N. J., Dec. 15.--Election of Carl B. Wynkoop as Mayor of Lavallette, Ocean County, was upheld today by Justice Joseph L. Bodine in the Supreme Court. Wynkoop was declared a winner by one vote over Enoch T. Van Camp after a second recount had been held. The original returns gave Wynkoop 148 to 146 for Van Camp, and the first recount showed 154 for Van Camp and 151 for Wynkoop.
    The result of the contested election hung upon the question of whether voters in writing Van Camp's name upon the ballot had neglected to place a cross or plus sign to the left of it, as required by law. Although some had written in his name they neglected to place the necessary sign opposite it, it was found.
    Justice Bodine held that the voters had received necessary instructions as to how ballots should be marked. If they failed to comply, Justice Bodine held, no authority exists to express their purpose.
